THE INTERIM CONSTITUTION OF NEPAL, <strong>2063</strong> (<strong>2007</strong>)AS AMENDED BY THE FIRST TO SIXTH AMENDMENTS(7) For the purpose <strong>of</strong> election to the Constituent Assembly, every <strong>Nepal</strong>icitizen who has attained the age <strong>of</strong> eighteen years by the end <strong>of</strong> Mangsir, <strong>2063</strong>(15th December 2006) shall be entitled to vote, as provided for in the law.#(7A) In the situation where the seat <strong>of</strong> a member elected or nominated pursuantto Clause (3) falls vacant, the seat shall be filled by application <strong>of</strong> law in force inrelation to the process <strong>of</strong> election or nomination.Ω(7B) Notwithstanding anything contained in Clause (7), if the position <strong>of</strong> a memberelected pursuant to paragraph (A) <strong>of</strong> sub-clause (3A) falls vacant owing to any reasonand needs to be filled by an election pursuant to sub-clause (7A), every <strong>Nepal</strong>i citizen,who has attained the age <strong>of</strong> 18 years by the end <strong>of</strong> Chaitra (mid-April) <strong>of</strong> the previousyear immediate to the election year, will be entitled to vote as provided for in the law.(8) Subject to the provisions <strong>of</strong> this Article, elections to the Constituent Assemblyand other matters pertaining thereto shall be regulated as provided for in thelaw.64. Term <strong>of</strong> the Constituent AssemblyUnless otherwise dissolved earlier by a resolution passed by the ConstituentAssembly, the term <strong>of</strong> the Constituent Assembly shall be two years from thedate <strong>of</strong> its first meeting.Provided that the term <strong>of</strong> the Constituent Assembly may be extended forup to six months by a resolution <strong>of</strong> the Constituent Assembly, in the event thatthe task <strong>of</strong> drafting the <strong>Constitution</strong> is not completed due to the proclamation<strong>of</strong> a State <strong>of</strong> Emergency in the country.65. Qualifications <strong>of</strong> membersIn order to be a member <strong>of</strong> Constituent Assembly a person must have thefollowing qualifications(a) be a <strong>Nepal</strong>i citizen,(b) have attained at least twenty-five years <strong>of</strong> age,(c) not have been punished for any criminal <strong>of</strong>fence involvingmoral turpitude,*(c1) not be ineligible under any law,(d) not be holding an <strong>of</strong>fice <strong>of</strong> pr<strong>of</strong>it.# Added on 2065 Ashad 28 (July 12, 2008) by the <strong>Interim</strong> <strong>Constitution</strong> <strong>of</strong> <strong>Nepal</strong> (FifthAmendment) Act, 2065.Ω Added on 2065 Mangsir 26 (December 11, 2008) by the <strong>Interim</strong> <strong>Constitution</strong> <strong>of</strong> <strong>Nepal</strong> (Sixth Amendment) Act, 2065.*Added on 2064 Jestha 30 (June 13, <strong>2007</strong>) by the <strong>Interim</strong> <strong>Constitution</strong> <strong>of</strong> <strong>Nepal</strong> (Second Amendment) Act, 2064.128
