THE INTERIM CONSTITUTION OF NEPAL, <strong>2063</strong> (<strong>2007</strong>)AS AMENDED BY THE FIRST TO SIXTH AMENDMENTS*55A. Vote <strong>of</strong> confidence(1) If the Prime Minister considers it necessary or appropriate to make it clearthat the Legislature-Parliament has confidence in him, he may propose a vote<strong>of</strong> confidence to the Legislature Parliament any time.2) At least one-fourth <strong>of</strong> the total number <strong>of</strong> the members <strong>of</strong> the Legislature-Parliament may propose a no-confidence motion stating that the Legislature-Parliament has no confidence in the Prime Minister.Provided that a no-confidence motion against the same Prime Ministershall not be moved more than once within six months.(3) A decision on the motion pursuant to Clause (1) or (2) shall be made by #a majority <strong>of</strong> the members <strong>of</strong> the Legislature-Parliament present.56. Privileges(1) <strong>The</strong>re shall be full freedom <strong>of</strong> speech in the meeting <strong>of</strong> the Legislature-Parliament and no member shall be arrested or detained or prosecuted in anycourt for anything expressed or for any vote cast in that meeting.(2) <strong>The</strong> Legislature-Parliament shall have full power to regulate its business,and it shall have the exclusive right to decide whether or not any proceeding <strong>of</strong>the Legislature-Parliament is regular. No question shall be raised in any courtin this regard.(3) No comment shall be made about the good faith <strong>of</strong> any proceedings <strong>of</strong> theLegislature-Parliament, and no person shall make or disseminate anythingabout comments or suggestions made by any member, deliberatelymisinterpreting or distorting their meaning.(4) No proceedings shall be initiated in any court against any person forpublication made under authority given by the Legislature-Parliament <strong>of</strong> anydocument, report, vote or proceeding.Explanation: For the purposes <strong>of</strong> clauses (1), (2), (3) and (4), the word"Legislature-Parliament" shall mean the Legislature-Parliament and any <strong>of</strong> itscommittees.116(5) No member <strong>of</strong> Legislature-Parliament shall be arrested during the session<strong>of</strong> the Legislature-Parliament.* Article 55A added on 2064 Jestha 30 (June 13, <strong>2007</strong>) by the <strong>Interim</strong> <strong>Constitution</strong> <strong>of</strong> <strong>Nepal</strong> (Second Amendment), 2064.# Amended on 2065 Ashad 28 (July 12, 2008) by the <strong>Interim</strong> <strong>Constitution</strong> <strong>of</strong> <strong>Nepal</strong> (FifthAmendment) Act, 2065.
