THE INTERIM CONSTITUTION OF NEPAL, <strong>2063</strong> (<strong>2007</strong>)AS AMENDED BY THE FIRST TO SIXTH AMENDMENTS39. State Ministers and Assistant Ministers(1) <strong>The</strong> Prime Minister may, on the recommendation <strong>of</strong> the political partyconcerned, appoint any Minister <strong>of</strong> State from among the members <strong>of</strong>Legislature-Parliament.(2) <strong>The</strong> Prime Minister may, on the recommendation <strong>of</strong> the political partyconcerned, appoint any Assistant Minister from among the members <strong>of</strong>Legislature-Parliament to assist any Minister in carrying out his/herresponsibility.40. Appointment <strong>of</strong> non-member <strong>of</strong> Legislature-Parliament as MinisterNotwithstanding anything contained in Articles 38 and 39, the Prime Ministermay appoint any person who is not a member <strong>of</strong> Legislature-Parliament asDeputy Prime Minister, Minister, State Minister or Assistant- Minister †on thebasis <strong>of</strong> political consensus.41. Remuneration and other benefits<strong>The</strong> remuneration and other benefits <strong>of</strong> the Prime Minister, Deputy PrimeMinister, Ministers, State Ministers and Assistant Ministers shall be asdetermined by an Act. Until so determined, they shall be as specified by theGovernment <strong>of</strong> <strong>Nepal</strong>.42. Oath<strong>The</strong> Prime Minister shall take his/her oath <strong>of</strong> <strong>of</strong>fice and secrecy *before thePresident, and the Deputy Prime Minister, Ministers, State Ministers andAssistant Ministers shall take their oath <strong>of</strong> <strong>of</strong>fice and secrecy before the PrimeMinister.43. Conduct <strong>of</strong> business <strong>of</strong> the Government <strong>of</strong> <strong>Nepal</strong>(1) <strong>The</strong> conduct <strong>of</strong> business <strong>of</strong> the Government <strong>of</strong> <strong>Nepal</strong> shall be carried outconsistently with the aspirations <strong>of</strong> the united people's movement, politicalconsensus and culture <strong>of</strong> mutual cooperation. <strong>The</strong> common minimumprogramme prepared through mutual agreement shall be the basis <strong>of</strong> thepolicies <strong>of</strong> the Government <strong>of</strong> <strong>Nepal</strong>.104† Words added on 2064 Jestha 30 (June 13, <strong>2007</strong>) by the <strong>Interim</strong> <strong>Constitution</strong> <strong>of</strong> <strong>Nepal</strong> (Second Amendment) Act, 2064.*Amended on 2065 Jesth 15 (May 28, 2008) by the <strong>Interim</strong> <strong>Constitution</strong> <strong>of</strong> <strong>Nepal</strong> (Fourth Amendment) Act, 2065.
