Washington CountyPublic NoticeOhio EPA Issues Notice <strong>of</strong> Tentative Decision to Issue a VarianceOn December 5, 20<strong>12</strong>, the director <strong>of</strong> Ohio EPA issued a draft notice tentativelygranting a variance to Skye Metals Recovery, Inc. (Skye) for its facility located at 110Blue Knob Road, Building 1D, Marietta, Ohio 45750 in Washington County, pursuant toOhio Administrative Code rule 3745-50-26. If issued as a final variance, certainmaterials that Skye handles would not be wastes under Ohio’s hazardous waste laws.The Agency is proposing to issue this variance because Skye recycles wastes, anduses and manages these materials more like products than wastes. Sky will operateand maintain a metals recycling facility. The metals <strong>of</strong> interest to Skye associated withthis variance are nickel, cobalt, and molybdenum. Skye will accept metal hydroxidebearing filter cake generated from the dewatering <strong>of</strong> sludge generated from thetreatment <strong>of</strong> wastewater from electroplating operations, and spent hydrotreating orhydrorefining catalyst from the petroleum refining operations for reclaiming. Oncereceived, Skye recycles the filter cake and spent catalyst by concentrating the levels <strong>of</strong>the metals using a calciner. The product is sold to the steelmaking industry for use inmaking steel and other alloys. Without this variance, Skye’s activities would beregulated as hazardous waste management activities and Skye would need ahazardous waste facility installation and operation permit.When issued, this variance will allow Skye to store and process the electroplatingwastewater filter cake and spent catalyst from petroleum refining without obtaining ahazardous waste permit. The draft variance contains the conditions under which thefacility must operate if the variance receives final approval. <strong>To</strong> issue this draft variance,Ohio EPA evaluated the request considering the factors in rule 3745-50-24 <strong>of</strong> the OhioAdministrative Code relevant to the modification requested.You may submit written comments to Ohio EPA, Division <strong>of</strong> Materials and WasteManagement, P.O.
