unlawful for a public authority to act in a way which is incompatible with aConvention right. “An act’ includes a failure to act” 21 .3.0.22 The European Commission has been developing the concept of victims’ rightswith its proposal for a Directive published in May 2011 22 . Although thisprimarily focuses on the ability of victims to intervene in a court’sconsideration of a case by means of a victim statement, it is indicative of agrowing recognition that the criminal justice system has obligations to thosewho suffer, or may suffer, from the effects of crime. The Review has beenconscious of the need for its recommendations to take into account, not onlythe legitimate protection of the rights of the individual suspect or accused, butalso the need for effective <strong>and</strong> efficient investigation <strong>and</strong> prosecution of crimebecause of their importance in the protection of the rights of citizens in general<strong>and</strong> the victims of crime in particular.21 Human Rights Act s 6 (1) <strong>and</strong> s 6 (6)22 “Proposal for a Directive of the European Parliament <strong>and</strong> of the Council establishing minimumst<strong>and</strong>ards on the rights, support <strong>and</strong> protection of victims of crime” COM(2011) 275 final60
