7.2 CORROBORATIONIntroduction7.2.1 The requirement for corroboration was cited in McLean as one of severalelements in the criminal justice system that contributed to the overall fairnessof the trial procedure. The Review’s Terms of Reference expressly set out thatthis is an area which must be examined. It is one of the issues that hasattracted most comment in the consultation responses, workshops and othermeetings. It has also been the focus of considerable media attention. Morethan any other feature of the criminal justice system, it is seen by many as adefining and distinctive characteristic of the Scots Law of evidence in criminalcases.7.2.2 The Review has no doubt that a majority of persons, especially lawyers,practising in criminal law, regard corroboration of testimony as an importantaspect of their professional lives 1 . Many see it as an important tool, whichhelps them to make decisions at various stages in the investigative and trialprocesses. The police officer has regard to it in deciding whether to report acase to the procurator fiscal. The procurator fiscal looks to see if there iscorroborated evidence before drafting a complaint or moving for fullcommittal on a petition. The defence solicitor or advocate has to examine theprosecution case in order to form a view on whether there is sufficientcorroborated evidence before advising his/her client on how to plead.
