Operational Aspects of EIAIf the Authority disagrees with the recommendations of the Appraisal Committee,then reasons shall be communicated to concerned Appraisal Committee and applicantwith in 45 days from the receipt of the recommendations. The Appraisal Committeeconcerned shall consider the observations of the Authority and furnish its views onthe observations within further period of 60 days. The Authority shall take a decisionwith in the next 30 days based on the views of appraisal Committee.If the decision of the Authority is not conveyed within the time, then the proponentmay proceed as if the environmental clearance sought has been granted or denied bythe regulatory authority in terms of the final recommendation of the concernedappraisal Committee. For this purpose, the decision of the Appraisal Committee willbe public document, once the period specified above for taking the decision by theAuthority is over.Incase of the Category B projects (B1 & B2), application shall be received by theMember-Secretary of the SEIAA and clearance shall also be issued by the sameSEIAA.Deliberate concealment and/or submission of false or misleading information or datawhich is material to screening or scoping or appraisal or decision on the applicationshall make the application liable for rejection, and cancellation of prior environmentalclearance granted on that basis. Rejection of an application or cancellation of a priorenvironmental clearance already granted, on such ground, shall be decided by theregulatory authority, after giving a personal hearing to the applicant, and followingthe principles of natural justice.If approvedThe concerned Authority (MoEF/SEIAA) will issue an environmental clearance forthe project.The project proponent should make sure that the award of Environment <strong>Clearance</strong> isproperly publicized in at least two local newspapers of the district or state where theproposed project is located. For instance, the executive summary of theenvironmental clearance may be published in the newspaper along with theinformation about the location (website/office where it is displayed for public) wherethe detailed environmental clearance is made available. The MoEF and theSEIAA/UTEIAA, as the case may be, shall also place the environmental clearance inthe public domain on Government Portal. Further copies of the environmentalclearance shall be endorsed to the Heads of local bodies, Panchayats and Municipalbodies in addition to the relevant offices of the GovernmentThe environmental clearance will be valid from the start date to actualcommencement of the production of the developmental activity.Usual validity period will be 5 years from the date of issuing environmentalclearance, unless specified by EAC/SEAC.A prior environmental clearance issued to a project proponent can be transferred toanother legal person entitled to undertake the project, upon application by thetransferor to the concerned Authority or submission of no-objection of the transferorby the transferee to the concerned Authority for the concurrence. In this case,EAC/SEAC concurrence is not required, but approval from the concerned authority isrequired to avail the same project configurations, validity period transferred to thenew legally entitled person to undertake the project.TGM for Tanneries August 20104-41
Operational Aspects of EIA4.12 Post-clearance Monitoring ProtocolThe MoEF, Government of India will monitor and take appropriate action under the EPAct, 1986.In respect of Category A projects, it shall be mandatory for the project proponent tomake public the environmental clearance granted for their project along with theenvironmental conditions and safeguards at their cost by advertising it at least in twolocal newspapers of the district or State where the project is located and in addition,this shall also be displayed in the project proponents website permanently.In respect of Category B projects, irrespective of its clearance by MoEF/SEIAA, theproject proponent shall prominently advertise in the newspapers indicating that theproject has been accorded environment clearance and the details of MoEF websitewhere it is displayed.The MoEF and the SEIAAs/UTEIAAs, as the case may be, shall also place theenvironmental clearance in the public domain on Government Portal.The copies of the environmental clearance shall be submitted by the projectproponents to the Heads of the local bodies, Panchayats and Municipal bodies inaddition to the relevant offices of the Government who in turn has to display the samefor 30 days from the date of receipt.The project proponent must submit half-yearly compliance reports in respect of thestipulated prior environmental clearance terms and conditions in hard and soft copies tothe regulatory authority concerned, on 1st June and 1st December of each calendar year.All such compliance reports submitted by the project management shall be publicdocuments. Copies of the same shall be given to any person on application to theconcerned regulatory authority. The latest such compliance report shall also be displayedon the web site of the concerned regulatory authority.The SPCB shall incorporate EIA clearance conditions into consent conditions in respectof Category A and Category B projects and in parallel monitor and enforce the same.TGM for Tanneries August 20104-42
