Instructions to <strong>Bid</strong>ders5.4. Unless otherwise provided in the BDS, the <strong>Bid</strong>der must have completed atleast one contract similar to the Project the value <strong>of</strong> which, adjusted to currentprices using the National Statistics Office consumer price index, must be atleast equivalent to a percentage <strong>of</strong> the ABC stated in the BDS.For this purpose, contracts similar to the Project shall be those described in theBDS, and completed within the relevant period stated in the Invitation to <strong>Bid</strong>and ITB Clause 1<strong>2.</strong>1(a) (iii).5.5. Unless otherwise provided in the BDS, the <strong>Bid</strong>der must submit a computation<strong>of</strong> its Net Financial Contracting Capacity (NFCC) or a commitment from aUniversal or Commercial Bank to extend a credit line in its favor if awardedthe contract for this Project (CLC).The NFCC, computed using the following formula, must be at least equal tothe ABC to be bid:NFCC = [(Current assets minus current liabilities) (K)] minus the value <strong>of</strong>all outstanding or uncompleted portions <strong>of</strong> the projects under ongoingcontracts, including awarded contracts yet to be started coinciding with thecontract for this Project.Where:K = 10 for a contract duration <strong>of</strong> one year or less, 15 for a contractduration <strong>of</strong> more than one year up to two years, and 20 for a contractduration <strong>of</strong> more than two years.The CLC must be at least equal to ten percent (10%) <strong>of</strong> the ABC for thisProject. If issued by a foreign bank, it shall be confirmed or authenticated by aUniversal or Commercial Bank. In the case <strong>of</strong> local government units (LGUs),the <strong>Bid</strong>der may also submit CLC from other banks certified by the BangkoSentral ng Pilipinas (BSP) as authorized to issue such financial instrument.6. <strong>Bid</strong>der’s Responsibilities6.<strong>1.</strong> The <strong>Bid</strong>der or its duly authorized representative shall submit a swornstatement in the form prescribed in Section VIII. Sample Forms as required inITB Clause 1<strong>2.</strong>1 (b) (iii).6.<strong>2.</strong> The <strong>Bid</strong>der is responsible for the following:(a)(b)(c)(d)(e)Having taken steps to carefully examine all <strong>of</strong> the <strong>Bid</strong>dingDocuments;Having acknowledged all conditions, local or otherwise, affecting theimplementation <strong>of</strong> the contract;Having made an estimate <strong>of</strong> the facilities available and needed for thecontract to be bid, if any; andHaving complied with its responsibility to inquire or secureSupplemental/<strong>Bid</strong> Bulletin(s) as provided under ITB Clause 10.<strong>3.</strong>Ensuring that it is not “blacklisted” or barred from bidding by the GOPor any <strong>of</strong> its agencies, <strong>of</strong>fices, corporations, or LGUs, includingforeign government/foreign or international financing institution whoseblacklisting rules have been recognized by the GPPB;Page 4 <strong>of</strong> 40
