Instructions to <strong>Bid</strong>ders(c)(d)(e)be addressed to the Procuring Entity’s BAC in accordance with ITBClause <strong>1.</strong>1;bear the specific identification <strong>of</strong> this bidding process indicated in theITB Clause <strong>1.</strong>2; andbear a warning “DO NOT OPEN BEFORE…” the date and time forthe opening <strong>of</strong> bids, in accordance with ITB Clause 2<strong>1.</strong>20.5. If bids are not sealed and marked as required, the Procuring Entity will assumeno responsibility for the misplacement or premature opening <strong>of</strong> the bid.2<strong>1.</strong> Deadline for Submission <strong>of</strong> <strong>Bid</strong>sD. Submission and Opening <strong>of</strong> <strong>Bid</strong>s<strong>Bid</strong>s must be received by the Procuring Entity’s BAC at the address and on or beforethe date and time indicated in the BDS.2<strong>2.</strong> Late <strong>Bid</strong>sAny bid submitted after the deadline for submission and receipt <strong>of</strong> bids prescribed bythe Procuring Entity, pursuant to ITB Clause 21, shall be declared “Late” and shallnot be accepted by the Procuring Entity.2<strong>3.</strong> Modification and Withdrawal <strong>of</strong> <strong>Bid</strong>s2<strong>3.</strong><strong>1.</strong> The <strong>Bid</strong>der may modify its bid after it has been submitted; provided that themodification is received by the Procuring Entity prior to the deadlineprescribed for submission and receipt <strong>of</strong> bids. The <strong>Bid</strong>der shall not be allowedto retrieve its original bid, but shall be allowed to submit another bid equallysealed, properly identified, linked to its original bid marked as “TECHNICALMODIFICATION” or “FINANCIAL MODIFICATION” and stamped“received” by the BAC. <strong>Bid</strong> modifications received after the applicabledeadline shall not be considered and shall be returned to the <strong>Bid</strong>der unopened.2<strong>3.</strong><strong>2.</strong> A <strong>Bid</strong>der may, through a Letter <strong>of</strong> Withdrawal, withdraw its bid after it hasbeen submitted, for valid and justifiable reason; provided that the Letter <strong>of</strong>Withdrawal is received by the Procuring Entity prior to the deadlineprescribed for submission and receipt <strong>of</strong> bids.2<strong>3.</strong><strong>3.</strong> <strong>Bid</strong>s requested to be withdrawn in accordance with ITB Clause 2<strong>3.</strong>1 shall bereturned unopened to the <strong>Bid</strong>ders. A <strong>Bid</strong>der may also express its intention notto participate in the bidding through a letter which should reach and bestamped by the BAC before the deadline for submission and receipt <strong>of</strong> bids. A<strong>Bid</strong>der that withdraws its bid shall not be permitted to submit another bid,directly or indirectly, for the same contract.2<strong>3.</strong>4. No bid may be modified after the deadline for submission <strong>of</strong> bids. No bid maybe withdrawn in the interval between the deadline for submission <strong>of</strong> bids andthe expiration <strong>of</strong> the period <strong>of</strong> bid validity specified by the <strong>Bid</strong>der on theFinancial <strong>Bid</strong> Form. Withdrawal <strong>of</strong> a bid during this interval shall result in theforfeiture <strong>of</strong> the <strong>Bid</strong>der’s bid security, pursuant to ITB Clause 18.5, and theimposition <strong>of</strong> administrative, civil and criminal sanctions as prescribed by RA9184 and its IRR.Page 13 <strong>of</strong> 40
