Faaliyet Raporu 2009 - YASED Uluslararası Yatırımcılar Derneği

Fikri ve Sınai Mülkiyet HaklarıKomite toplantılarına aktif katılım sağlanmış ve eylemplanında yer alan konular ile ilgili olarak YASED Fikri veSınai Mülkiyet Hakları Çalışma Grubu’nun ortakbenimsediği görüş ve öneriler paylaşılmıştır. Grup Üyeleriiçin öncelik taşıyan Markalar Kanun Taslağı, Patent veFaydalı Model Kanun Taslağı, telif hakları ve verimünhasıriyeti gibi tartışmalı konulardaki görüşlerbelirtilmiştir.Kurumsal YönetimSPK başkanlığında toplanan komite toplantılarına katılımgösterilerek eylem planlarında yer alan aksiyonlar vekomitenin tartıştığı konularda görüş bildirilmiştir. Sözkonusu komite çalışmaları kapsamında YASED olarak“borsadışı şirketler için finansal olmayan raporlamastandartları” hakkında çalışmalarda bulunulmuş, taslakbir rapor hazırlanarak teknik komiteye sunulmuştur.ArGeYASED, ArGe Teknik Komitesi toplantılarına aktifkatılımıyla, komitenin gündemini oluşturan üyelerdenbiri olmuştur. 2009 yılında mevcut ArGe Mevzuatı veuygulamalarında yapılabilecek iyileştirmelerin yanında,YASED iki konuyu komitenin gündemine getirerek katkıdabulunmuştur: Araştırmacı akademisyenlerin şirketlerleberaber gerçekleştirdikleri ArGe projelerinde “DönerSermaye” sebebiyle aldıkları ücretin büyük bölümününÜniversiteye kalması (Bu durumu düzeltecek kanun tasarısıhazırlanmış, ilgili komisyonlarca görüşülmektedir.) YASEDArGe Çalışma Grubunun ODTÜ Bilim ve TeknolojiPolitikaları Merkezi ile birlikte gerçekleştirecekleri “TürkiyeEkonomisinde Yabancı Sermayeli Firmaların ArGeEtkinliklerinin Analizi: Mevcut Durum, Sorunlar ve ÇözümÖnerileri” çalışmasının aşamaları ve sonuçlarının YOİKKArGe Teknik Komitesinde görüşülmesi ve önerilerindeğerlendirilmesi kararı alınmıştır.Intellectual and Industrial Property RightsYASED has participated and contributed actively in theCommittee meetings during the year. Views and proposalsadopted by YASED’s Intellectual and Industrial PropertyRights Working Group have been shared with theCommittee. YASED’s views as to the Trademark Draft Law,Patent and Utility Draft Law, Copyrights, Data Exclusivity,which are the priorities of YASED’s Working Groupmembers have been conveyed.Corporate GovernanceYASED Corporate Governance Working Group hasparticipated in the CCIIE Committee meetings chaired bythe Capital Markets Board and has voiced its views onthe action plan items and the issues debated at theCommittee. Efforts were given as YASED, within the scopeof the subject Committee works, on “Non-financialreporting standards for companies not listed on the stockexchange”, and a draft report was prepared and presentedto the Technical Committee.R&DYASED has been one of the members of the R&D TechnicalCommittee which has set the agenda of the Committeewith its active participation in the Committee meetings.In addition to the suggestions for the improvements thatcan be made in the existing R&D legislation and itsimplementation, YASED has contributed to the Committeeworks in 2009, by introducing two issues to the agendaof the Technical Committee. These are:- The major portion of the compensations paid to researchacademicians through “Revolving Funds” for the R&Dprojects these staff carry out jointly with companies, arekept by the university administrations. (The draft bill tocorrect this drawback has been prepared and is pendingin the related commissions on the Parliament).- It was also decided to review the stages and results ofthe work titled “An Analysis of the R&D Activities ofForeign Capital Companies in Turkey’s Economy: TheCurrent Situation, Problems and Solution Proposals” tobe accomplished by YASED’s R&D Working Group jointlywith ODTU-TEKPOL, at CCIIE’s Technical Committee, andevaluate the prospective proposals.21
