The project was referred to the Australian Government Department <strong>of</strong> Sustainability,Environment, Water, Population and Communities (SEWPaC) on 10 January 2012 fora determination as to whether the project constituted a ‘controlled action’ under theEPBC Act, due to the likely potential impacts on matters <strong>of</strong> national environmentalsignificance (MNES).On 7 February 2012, the Australian Government Environment Minister determined thatthe project is a controlled action under the EPBC Act (decision notice EPBC2012/6240). The controlling provisions under the EPBC Act are:• World Heritage properties (sections 12 and 15A)• National Heritage places (sections 15B and 15C)• listed threatened species and communities (sections 18 and 18A)• listed migratory species (sections 20 and 20A)• Commonwealth marine areas (sections 23 and 24A)• Great Barrier Reef Marine Park (sections 24B and 24C).Therefore the project requires assessment and approval under the EPBC Act and theproject will require approval from the Australian Government Environment Ministerunder Part 9 <strong>of</strong> the EPBC Act before it can proceed.The Australian Government assessment will be administered by SEWPaC and willoccur separately to the state-based assessment.3.1. Coordinator-General’s reportAt the conclusion <strong>of</strong> the EIS process, the Coordinator-General will prepare a reportevaluating the EIS (Coordinator-General’s report). If the report states conditions underthe following <strong>Queensland</strong> Acts, the Coordinator-General is required to provide theresponsible minister(s) with a copy <strong>of</strong> the report:• Mineral Resources Act 1989• Environmental Protection Act 1994 (EP Act)• Petroleum and Gas (Production and Safety) Act 2004• Greenhouse Gas Storage Act 2009.4.
