Tea Board/Kolkata/2011-12- QCL Tender Document-Originalwithin 90 days reckoned from the date of receipt of complete equipmentwith spares and accessories, as ordered if such equipments or part, portionor consignment thereof is not, in all respect, in conformity withspecifications and terms and conditions of the contract whether on accountof any loss, deterioration or damage before despatch or delivery or duringtransit or otherwise howsoever.(b)(C)That if the Contractor fails to observe or perform any conditions of thiscontract or become insolvent or he or his Agent offers any bribe inconnection with contract then, notwithstanding any previous waiver of suchdefault or action, the Purchaser will have the power on behalf of theGovernment to terminate the contract forthwith and without prejudice toother rights and remedies of the Government to forfeit the said Securitydeposit of Rs. ______ ___________________________in the form of Bank Guarantee at his discretion and also recover from theContractor any loss suffered by the Government on account of the contractbeing so terminated prematurely.That in case of any dispute or difference that may arise in connection withthis contract the settlement of which is not hereinbefore provided for, thesame shall be referred for the Arbitration to the Chairman, Tea Board, 14,B. T.
