PROCUREMENTCommon Finding:Grantee is not adhering to the federal requirements for procurementof goods and services.Federal Regulation:45 CFR Parts 92.36 "Grantees and subgrantees will use their ownprocurement procedures which reflect applicable State and local lawsand regulations, provided that the procurements conform toapplicable Federal law and the standards identified in this section."1. Grantees and subgrantees will maintain a contract administrationsystem that ensures that contractors perform in accordance with theterms, conditions, and specifications of their contracts or purchaseorders.2. Grantees and subgrantees will maintain records sufficient todetail the significant history of a procurement. These records willinclude, but are not necessarily limited to, the following: rationalefor the method of procurement, selection of contract type,contractor selection or rejection, and the basis for the contractprice.3. All procurement transactions will be conducted in a mannerproviding full and open competition consistent with the standardsof 45 CFR 92.36Recommendation:Each program shall develop and implement policies and proceduresrequiring the program to document its procurement processBasis for the Recommendation:The program will maintain documentation of adherence to the Tribalgovernment's procurement policies and procedures.Action Steps:1. Review the Tribal government's procurement policies andprocedures.2. Develop a program procurement policy that supports the Tribalgovernment's procurement policy.
