PROCUREMENTCommon Finding:Grantee is not adhering to the federal requirements <strong>for</strong> procurementof goods <strong>and</strong> services.Federal Regulation:45 CFR Parts 92.36 "Grantees <strong>and</strong> subgrantees will use their ownprocurement procedures which reflect applicable State <strong>and</strong> local laws<strong>and</strong> regulations, provided that the procurements con<strong>for</strong>m toapplicable Federal law <strong>and</strong> the st<strong>and</strong>ards identified in this section."1. Grantees <strong>and</strong> subgrantees will maintain a contract administrationsystem that ensures that contractors per<strong>for</strong>m in accordance with theterms, conditions, <strong>and</strong> specifications of their contracts or purchaseorders.2. Grantees <strong>and</strong> subgrantees will maintain records sufficient todetail the significant history of a procurement. These records willinclude, but are not necessarily limited to, the following: rationale<strong>for</strong> the method of procurement, selection of contract type,contractor selection or rejection, <strong>and</strong> the basis <strong>for</strong> the contractprice.3. All procurement transactions will be conducted in a mannerproviding full <strong>and</strong> open competition consistent with the st<strong>and</strong>ardsof 45 CFR 92.36Recommendation:Each program shall develop <strong>and</strong> implement policies <strong>and</strong> proceduresrequiring the program to document its procurement processBasis <strong>for</strong> the Recommendation:The program will maintain documentation of adherence to the Tribalgovernment's procurement policies <strong>and</strong> procedures.Action Steps:1. Review the Tribal government's procurement policies <strong>and</strong>procedures.2. Develop a program procurement policy that supports the Tribalgovernment's procurement policy.
