D. The tool allowance for all classes listed in paragraph A. above will be paid in September<strong>of</strong> each year to all eligible employees who are on the payroll as <strong>of</strong> the first day <strong>of</strong> the Augustpay period.E. At any time during the life <strong>of</strong> this Agreement, the employer may elect to provide tools to<strong>Unit</strong> <strong>12</strong> employees currently receiving a tool allowance and stop paying the tool allowanceto those employees.F. If an employee in the trades (i.e., plumber, carpenter, electrician, mechanic or painter)who receives employer-provided hand tools believes the tools do not meet the standardscontained in the Department <strong>of</strong> General Services hand tool specifications, the employeemay request his or her supervisor to verify that the hand tools do meet those standards. Ifthe hand tools do not meet the standards, and where the specific tools are reasonablyavailable, they shall be replaced <strong>with</strong> tools consistent <strong>with</strong> the specifications.G. Employees covered in Sections A, B or C above shall provide an inventory <strong>of</strong> tools whichshall be maintained at the work facility in a format deemed acceptable by localmanagement.H. The <strong>State</strong> will support the Board <strong>of</strong> Control claim <strong>of</strong> any employee covered in Sections A.B., OR C. above when <strong>State</strong>-required personal tools are stolen while the employee isperforming assigned duties or are stolen while stored in a <strong>State</strong> facility or vehicle providedthe employee immediately reports the loss to his or her supervisor and an investigation <strong>of</strong>the incident verifies that the employee had an approved tool inventory on file and had takenreasonable care to secure the tools. The <strong>State</strong>'s liability under this provision is limited to thereplacement value <strong>of</strong> stolen tools listed on the employee's approved tool inventory.Recovered stolen tools that are positively identified belong to the <strong>State</strong> if the Board <strong>of</strong>Control has approved a claim for their replacement.I. If an employee elects to use his or her own tools as a matter <strong>of</strong> preference over<strong>State</strong>-issued tools, the <strong>State</strong> will neither pay a tool allowance for employee-preference toolsnor support a Board <strong>of</strong> Control claim should these employee-preference tools be stolen.<strong>12</strong>.7 Uniform ReimbursementA. When the <strong>State</strong> requires a uniform to be worn and does not provide for such a uniform,the <strong>State</strong> will authorize, based upon the employee submitting a receipt, a uniformreimbursement for an amount to be determined by the <strong>State</strong> but not to exceed $385 peryear. A <strong>Unit</strong> <strong>12</strong> employee may submit a request for uniform reimbursement after he/shehas been employed in a permanent position, which requires a uniform, for the equivalent <strong>of</strong>one (1) year. "Uniform" means outer garments, excluding shoes, which are required to beworn exclusively while carrying out the duties and responsibilities <strong>of</strong> the position and whichare different from the design or fashion <strong>of</strong> the general population. This definition includesitems that serve to identify the person, agency, functions performed, position, or time inservice. <strong>Unit</strong> <strong>12</strong> employees shall be responsible for the purchase <strong>of</strong> required uniforms as acondition <strong>of</strong> employment. <strong>Unit</strong> <strong>12</strong> employees shall wear their required uniforms only in an<strong>of</strong>ficial capacity.B. Uniform reimbursement shall not be considered compensation for retirement purposes.C. All permanent intermittent <strong>Unit</strong> <strong>12</strong> employees will continue to receive uniformreimbursement allowances in accordance <strong>with</strong> existing laws, rules and regulations.85BU <strong>12</strong>(99-01)
