10.14 Unpaid Leave of AbsenceA. A department head or designee may grant an unpaid leave of absence for a period not toexceed one (1) year. The employee shall provide substantiation to support the employee'srequest for an unpaid leave of absence.B. Except as otherwise provided in Subsection C below, an unpaid leave of absence shallnot be granted to any employee who is accepting some other position in State employment;or who is leaving State employment to enter other outside employment; or does not intendto, nor can reasonably be expected to, return to State employment on or before theexpiration of the unpaid leave of absence. A leave, so granted, shall assure an employeethe right to his/her former position upon termination of the leave. The term "former position"is defined in Government Code Section 18522.68BU 12(99-01)
C. An unpaid leave of absence may be granted for, but not limited to, the following reasons:1. Union activity;2. for temporary incapacity due to illness or injury;3. to be loaned to another governmental agency for performance of a specificassignment;4. to seek or accept other employment during a layoff situation or otherwise lessenthe impact of an impending layoff;5. education; or6. research project.D. Extensions of an unpaid leave of absence may be requested by the employee and maybe granted by the department head or designee.E. A leave of absence shall be terminated by the department head or designee (1) at theexpiration of the leave; or (2) based on departmental business needs, prior to the expirationdate with written notice at least thirty (30) work days prior to the effective date of therevocation.10.15 Personal LeaveA. Personal leave on a employee’s leave account shall be requested and used by theemployee in the same manner as vacation or annual leave. Requests to use personalleave must be submitted in accordance with departmental policies on vacation or annualleave.B. Upon permanent separation from State employment, an employee shall be paid forunused personal leave credits in the same manner as vacation or annual leave.C. Nothing in this section precludes the employer from offering a cash out program for all ora portion of unused personal leave. Personal leave credit shall be cashed out at theemployee’s salary rate at the time the personal leave payment is made. Cash outprograms, if offered, may differ from department to department and employee to employee.ARTICLE 11 – RETIREMENT11.1 First Tier Retirement Formula (2% at 55)A. The Union and the State (parties) to enhance the current age benefit factors on whichservice retirement benefits are based for Miscellaneous and Industrial members of the FirstTier plan under the Public Employees’ Retirement System (CalPERS). The parties furtheragree that the provisions of this article will be effective only upon the CalPERS boardadopting a Resolution that will employ, for the June 30, 1998 valuation and thereafter, 95%of the market value of CalPERS’ assets as the actuarial value of the assets, and to amortizethe June 30, 1998 excess assets over a 20 year period, beginning July 1, 1999. The partiesagree to jointly request the CalPERS board to extend the 20 year amortization period in theevent the cost of these benefits or unfavorable returns on investments results in anincreased employer contribution by the State.B.
