G. Donations shall be made on a form to be developed by the <strong>State</strong>, signed by the donatingemployee, and verified by the donating department. These donations are irrevocable.H. This section is not subject to the Grievance and Arbitration article <strong>of</strong> this contract.10.9 Jury DutyA. An employee shall be allowed such time <strong>of</strong>f <strong>with</strong>out loss <strong>of</strong> compensation as is requiredin connection <strong>with</strong> mandatory jury duty. If payment is made for such time <strong>of</strong>f, the employeeis required to remit to the <strong>State</strong> jury fees received. When night jury service is required <strong>of</strong> anemployee, the employee shall be allowed time <strong>of</strong>f <strong>with</strong>out loss <strong>of</strong> compensation for suchportion <strong>of</strong> the required time that coincides <strong>with</strong> the employee's normal work schedule. Thisincludes any necessary travel time.B. An employee shall notify his/her supervisor immediately upon receiving notice <strong>of</strong> juryduty.C. If an employee elects to use accrued vacation leave or compensating time <strong>of</strong>f while onjury duty, the employee is not required to remit jury fees.D. For purposes <strong>of</strong> this Section, "jury fees" means fees received for jury duty excludingpayment for mileage, parking, meals or other out-<strong>of</strong>-pocket expenses.E. In department work units <strong>with</strong> multiple shift operations, employees on a graveyard orswing shift shall be reassigned to day shift for duration <strong>of</strong> the jury duty. Employees on theday shift shall be reassigned to the swing or graveyard shift (if the work unit has a swing orgraveyard shift) during their assignment to night jury duty.F. An employee may be allowed time <strong>of</strong>f <strong>with</strong>out loss <strong>of</strong> compensation if approved by thedepartment head or designee for voluntary jury duty such as county grand jury. If approvedby the department, paragraphs C and D apply.G. In the event <strong>of</strong> a mandatory reassignment as described in Paragraph E, the <strong>State</strong>reserves the right to concurrently reassign the least senior employee from another shift toensure adequate coverage on all shifts. For purposes <strong>of</strong> this section, seniority shall bedetermined as service <strong>with</strong>in the classification, <strong>with</strong>in the department on a shift that wouldnot result in another shift change. Once the jury duty obligation has been fulfilled, theemployer shall return both employees to their former shift assignments.10.10 Union LeaveA. During the term <strong>of</strong> this agreement, IUOE shall have the choice <strong>of</strong> requesting an unpaidleave <strong>of</strong> absence or a paid leave <strong>of</strong> absence (union leave) for a IUOE representative. Anunpaid leave <strong>of</strong> absence may be granted by the <strong>State</strong> pursuant to the unpaid leave <strong>of</strong>absence provisions in this Contract. A union leave may also be granted at the discretion <strong>of</strong>the affected department head or designee in accordance <strong>with</strong> the following:1. A union leave shall assure an employee the right to his/her former position upontermination <strong>of</strong> the leave. The term "former position" is defined in Government CodeSection 18522.2. IUOE agrees to reimburse the affected department(s) for the full amount <strong>of</strong> theaffected employee's salary, plus an additional amount equal to 35 percent <strong>of</strong> theaffected employee's salary, for all the time the employee is <strong>of</strong>f on a union leave.65BU <strong>12</strong>(99-01)
