F. Upon termination from <strong>State</strong> employment, the employee shall be paid for accrued annualleave credits for all accrued annual leave time.G. The time when annual leave shall be taken by the employee shall be determined by thedepartment head or designee. If on January 1, <strong>of</strong> each year an employee's annual leavebank exceeds the cap in Subsection "E", the department may order the employee to takeannual leave.H. Annual leave request must be submitted in accordance <strong>with</strong> departmental policies on thissubject. However, when two or more employees on the same shift (if applicable) in a workunit (as defined by each department head or designee) request the same annual leave timeand approval cannot be given to all employees requesting it, employees shall be grantedtheir preferred annual leave period in order <strong>of</strong> seniority (length <strong>of</strong> service <strong>with</strong>in thedepartment).I. Each department head or designee will make every effort to act on annual leave requestsin a timely manner.J. Annual leave that is used for purposes <strong>of</strong> sick leave is subject to the requirements setforth in Article 10.2, Sick Leave, <strong>of</strong> this Agreement.K. The enhanced non-industrial disability insurance (ENDI) in Section 3.<strong>12</strong> applies only tothose in the annual leave program described above in this Section.L. Employees who are currently subject to vacation and sick leave provisions may elect toenroll in the annual leave program at any time after 24 months has elapsed from date <strong>of</strong> lastenrollment. The effective date <strong>of</strong> the election shall be the first day <strong>of</strong> the pay period inwhich the election is received by the appointing power. Once enrolled in annual leave, anemployee shall become entitled to an enhanced NDI benefit (50 percent <strong>of</strong> gross salary).10.4 Bereavement LeaveA. A department head or designee shall authorize bereavement leave <strong>with</strong> pay for apermanent ("permanent" means an employee who has successfully passed probation inthe current class or any prior appointment) full-time <strong>State</strong> employee due to the death <strong>of</strong>his/her parent, step parent, spouse, child, grandchild, grandparent, brother, sister, stepchild, adopted child, or death <strong>of</strong> any person residing in the immediate household <strong>of</strong> theemployee at the time <strong>of</strong> death. Such bereavement leave shall be authorized for up to threeeight-hour days (24 hours) per occurance. The employee shall give notice to his/herimmediate supervisor as soon as possible and shall, if requested by the employee'ssupervisor, provide substantiation to support the request.B. If the death <strong>of</strong> a person as enumerated above requires the employee to travel over fourhundred (400) miles one-way from his/her home, upon request, additional time <strong>of</strong>f <strong>with</strong> payshall be granted for two (2) additional days which shall be deducted from accrued sickleave. Should additional leave be necessary, the department head or designee mayauthorize the use <strong>of</strong> CTO, vacation or authorized leave <strong>with</strong>out pay. Such leave shall bedenied or granted according to the Agreement article on such leave.C. Fractional time base (part-time) employees will be eligible for bereavement leave on apro rata basis, based on the employee's fractional time base.
