ARTICLE 9 – HOLIDAYS7. The Department <strong>of</strong> Water Resources reserves the right to revert back to the 8-hour shift in 8.2 if in its judgment such action is necessary to maintain the operation<strong>of</strong> the <strong>State</strong> Water Project. This includes success in obtaining shift coverage. Thedepartment agrees to give affected employees and IUOE notice <strong>of</strong> its intent tocancel the program and give IUOE the opportunity to discuss this matter. If the issueis not resolved, DWR may cancel the program upon 30 days notice at conclusion <strong>of</strong>discussions.8. Upon IUOE request a blind election shall be held to determine if 85 percent <strong>of</strong>rotating shift workers in a field division wish to revert back to the 8-hour shift in 8.2 A.If so, the field division will revert back to the 8-hour shift in 8.2 A.9 If a dispute arises over <strong>12</strong>-hour shift, an employee may grieve it in accordance<strong>with</strong> Section 14 <strong>with</strong> the Board <strong>of</strong> Adjustment's decision being the final step. Anydispute involving the interpretation or application <strong>of</strong> the express terms <strong>of</strong> thissubsection is not subject to arbitration procedure in Section 14 <strong>of</strong> the MOU.A. With the exception <strong>of</strong> those employees covered by the Department <strong>of</strong> Water Resourcesrotating shift provisions in Article 8, all full-time employees shall be entitled 104 hours <strong>of</strong>holiday credit as provided in section "B" and "C" below, and shall receive additional holidaycredits for any <strong>of</strong>ficial holidays declared by the Governor.B. The holiday credits for full-time employees shall accrue as follows:On January 1 stOn the third Monday in JanuaryOn February <strong>12</strong> thOn the third Monday in FebruaryOn the last Monday <strong>of</strong> MayOn July 4 thOn the first Monday <strong>of</strong> SeptemberOn the second Monday <strong>of</strong> OctoberOn November 11 thOn Thanksgiving DayOn the day after ThanksgivingOn December 25 th8 hours <strong>of</strong> holiday credit8 hours <strong>of</strong> holiday credit8 hours <strong>of</strong> holiday credit8 hours <strong>of</strong> holiday credit8 hours <strong>of</strong> holiday credit8 hours <strong>of</strong> holiday credit8 hours <strong>of</strong> holiday credit8 hours <strong>of</strong> holiday credit8 hours <strong>of</strong> holiday credit8 hours <strong>of</strong> holiday credit8 hours <strong>of</strong> holiday credit8 hours <strong>of</strong> holiday creditC. Intermittent employees shall receive holiday credit as provided in Addendum 3.F. Employees excused from work on an observed holiday shall be required to expendholiday credits on the day that a holiday is observed.
