B. Overtime work will be assigned to employees in the classification that customarily isassigned the work.C. The employer shall establish a procedure that requests and utilizes volunteers to performovertime work from among <strong>Unit</strong> <strong>12</strong> employees who are qualified and available <strong>with</strong>in theappropriate work area. In the event there are insufficient volunteers for overtime, suchovertime shall be assigned in reverse seniority.7.8 Overtime CompensationA. Employees in Bargaining <strong>Unit</strong> <strong>12</strong> required to work in excess <strong>of</strong> forty (40) hours per weekshall be compensated for such ordered overtime either by cash or compensating time <strong>of</strong>f(CTO) in the following manner:1. Cash compensation shall be at one and one-half times the hourly rate.2. Compensating time <strong>of</strong>f shall be authorized at one and one-half (1½) hour for eachovertime hour worked.B. Not<strong>with</strong>standing any other contract provision, departmental policy or practice, the traveltime <strong>of</strong> employees who are covered by FLSA shall only be considered as time worked if itmeets the definitions and requirements <strong>of</strong> travel time in Sections 785.34 through 785.41 <strong>of</strong>Title 29 <strong>of</strong> the Code <strong>of</strong> Federal Regulations.C. Bargaining <strong>Unit</strong> <strong>12</strong> employees shall be compensated for ordered overtime <strong>of</strong> at leastone-quarter hour at any one time. Overtime will be credited on a one-quarter hour basis<strong>with</strong> a full quarter <strong>of</strong> an hour credit granted if half or more <strong>of</strong> the period is worked. Smallerfractional units will not be accumulated.D. The first 40 hours <strong>of</strong> ordered overtime during a fiscal year shall be compensated <strong>with</strong>either CTO or cash, at the employee’s discretion. Thereafter, compensation (CTO or cash)shall be determined by the employer.E. At the employer’s option, unused CTO in excess <strong>of</strong> 40 hours on the books may becashed out on June 30 <strong>of</strong> every fiscal year.F. It is understood that there are some operations that will not allow employees to use theirCTO during certain parts <strong>of</strong> the year. Accrual shall not exceed 240 hours at any time.G. CTO may be taken only <strong>with</strong> prior supervisory approval.7.9 Immediate Response Status- CDFA. Any employee who, in responding to a declared emergency situation, is directed toremain after his or her scheduled shift, in a remote response “base camp”, “fire camp”,“assembly point” or similarly designated location, shall be compensated for all hours whileconfined to such remote response location. For purposes <strong>of</strong> this section, employees whoare relieved <strong>of</strong> duty and permitted to retire to a motel shall be compensated if directed toremain available for immediate response during <strong>of</strong>f-duty hours.B. Employees in the classification <strong>of</strong> Heavy Equipment Mechanic in the Department <strong>of</strong>Forestry and Fire Protection, shall record all work activity while the employee is assigned toa “fire camp” or other emergency response work location on a form FC-33 or its equivalent.51BU <strong>12</strong>(99-01)
