C. Permanent Shift ChangeA permanent shift change is defined as a change in the hours <strong>of</strong> work in a dayand/or the days <strong>of</strong> work in a week where such change shall be for a duration greaterthan thirty (30) calendar days. Permanent shift changes shall be made inaccordance <strong>with</strong> Article 17 (Reassignments and Transfers) <strong>of</strong> this agreement.For short shift changes and temporary shift changes as described above, noticerequirements shall not be required in the event that the change is necessitated by an eventthat poses immediate danger to life or property or as a result <strong>of</strong> natural disasters.7.5 Rest PeriodsAn employee will be granted a rest period not to exceed 15 minutes during each four (4)hours <strong>of</strong> his/her work shift unless there is an emergency or other operating needs precludeit. The rest period shall not exceed 30 minutes total for any day. Rest periods shall beconsidered hours worked. Rest periods not taken shall not be accumulated, used forovertime purposes, nor may they be used to "make-up" time. The <strong>State</strong> shall determine thetime when the rest period is to be taken. A rest period normally will not be granted duringthe first or last hour <strong>of</strong> the work shift. Except <strong>with</strong> the consent <strong>of</strong> the <strong>State</strong>, an employeeshall not leave his or her assigned work location.7.6 Meal PeriodsA. <strong>Unit</strong> <strong>12</strong> employees normally will be allowed an unpaid meal period <strong>of</strong> not less than 30minutes nor more than 60 minutes which shall be scheduled by the employee's supervisoras near as possible to the middle <strong>of</strong> the work shift. Employees on an unpaid meal periodwill not be restricted to any special area during the meal period. It shall be the responsibility<strong>of</strong> each employee to be at the work site and prepared to begin work at the conclusion <strong>of</strong> themeal period.B. When employee’s shift includes a scheduled unpaid meal and the employee is requiredto work through any part <strong>of</strong> that period, the employee shall be paid at the appropriate hourlyrate for such meal period in the amount equivalent to the lost meal time or may be releasedfrom work an equivalent amount <strong>of</strong> time prior to the conclusion <strong>of</strong> the work shift.For purposes <strong>of</strong> this section, it is agreed that the employees who are assigned to overseethe work <strong>of</strong> public service workers will be considered to work through their meal periodwhen they are at a work site <strong>with</strong> them during the meal period and shall receive theappropriate hourly rate for such period as determined by the hours <strong>of</strong> work andcompensation section <strong>of</strong> this contract.C. Employees required to work a full shift <strong>with</strong>out a scheduled meal period shall bepermitted to eat their meal while performing their duties.7.7 Overtime DistributionA. Supervisors shall endeavor to equally distribute overtime hours to all <strong>Unit</strong> <strong>12</strong> employees<strong>with</strong>in a work location. Within such work areas, the employees or the union may requestposting <strong>of</strong> a record <strong>of</strong> overtime hours <strong>of</strong>fered to each employee. This record shall be keptsolely for the purpose <strong>of</strong> determining equitable distribution <strong>of</strong> overtime.50BU <strong>12</strong>(99-01)
