Matters scheduled for hearing by the Board <strong>of</strong> Control;5. Matters pending before the <strong>State</strong> Personnel Board;6. Investigations <strong>of</strong> GrievancesB. IUOE shall provide DPA <strong>with</strong> a written list <strong>of</strong> IUOE stewards and BusinessRepresentatives on an annual basis and shall notify DPA <strong>of</strong> any changes <strong>of</strong> such stewardsand representatives.C. Upon request <strong>of</strong> an aggrieved employee, or on behalf <strong>of</strong> IUOE, an IUOE steward shall beallowed reasonable time <strong>of</strong>f during working hours, <strong>with</strong>out loss <strong>of</strong> compensation, forrepresentational purposes, as defined above, provided the employee represented is in thesteward's department and in an <strong>of</strong>fice or building that is <strong>with</strong>in close proximity. Releasetime for these purposes is subject to prior notification and approval by the steward'simmediate supervisor <strong>of</strong> the reasonable amount <strong>of</strong> time and when it may be taken.5.2 Employee Time Off5.3 AccessEmployees shall be entitled to reasonable time <strong>of</strong>f at the worksite as specified in Section 5.1<strong>with</strong>out loss <strong>of</strong> compensation for representational matters subject to approval by theemployee's supervisor <strong>of</strong> the reasonable amount <strong>of</strong> time and when it may be taken. If theemployees confer <strong>with</strong> IUOE representatives, Section 5.3 applies.A. IUOE representatives shall be allowed access to Bargaining <strong>Unit</strong> employees at theworksite during working hours for representational purposes as defined in Section 5.1 ifIUOE representatives request access from the department head or designee prior to thevisit.B. Immediately upon being notified <strong>of</strong> an accident involving serious injury or death <strong>of</strong> a <strong>Unit</strong><strong>12</strong> employee, the Departmental Labor Relations Office will notify the Bargaining <strong>Unit</strong> <strong>12</strong>Central Office <strong>of</strong> such a death or injury. The employer will provide, if known, the employee’sname, specific locale <strong>of</strong> the accident, approximate time <strong>of</strong> the accident, and any availabledetails regarding the accident. Departments will not unreasonably deny access to accidentsites.C. Access may be delayed for operational reasons and may be restricted to certain worksites or areas for reasons <strong>of</strong> safety, security, or patient care including patient privacy; whereaccess is restricted, other reasonable accommodations shall be made. Access shall notinterfere <strong>with</strong> the work <strong>of</strong> other employees.5.4 Steward ProtectionThe <strong>State</strong> shall be prohibited from imposing or threatening to impose reprisals, fromdiscriminating against IUOE stewards, or otherwise interfering <strong>with</strong>, restraining or coercingIUOE stewards because <strong>of</strong> the exercise <strong>of</strong> any rights provided by the Dills Act or thisAgreement.44BU <strong>12</strong>(99-01)
