4.3 FootwearA. The State shall provide safety shoes/boots when required by the State. Safetyshoes/boots are those intended to protect the employee from specific types of injury to theankle, foot, or toes. Safety shoes/boots include those with a steel toe or shank. Safetyshoes/boots provided pursuant to this section are State property and shall be properly fittedand be the responsibility of the employee to maintain. The State shall be responsible forreplacement of safety shoes/boots in the process of normal wear. State provided safetyshoes/boots lost or damaged due to the negligence of the employee shall be replaced bythe employee at his/her expense.B. In addition, with regard to specified State agencies and as articulated below, the Stateshall provide a footwear allowance:1. Caltrans will pay each of its permanent, full-time Unit 12 employees on payroll asof April 1 each year $50 as an allowance toward purchasing work footwearconsistent with Caltrans policy. This allowance will be remitted to employees duringMay of each year. Employees shall wear such footwear at all times while on duty.2. DWR will pay each of its permanent, full-time Unit 12 employees on payroll as ofApril 1 each year $50 as an allowance toward purchasing work footwear consistentwith DWR policy. This allowance will be remitted to employees during May of eachyear. Employees shall wear such footwear at all times while on duty.3. In the Department of Parks and Recreation reimbursement for required footwearshall be provided under the uniform replacement allowance, Article 12.9, UniformReimbursement-DPR.C. Departments not covered by paragraphs 1, 2 or 3 above, shall only require footwearappropriate to the work being performed. IUOE recognizes that when an agency simplyrequires appropriate footwear, the responsibility for purchase and maintenance of sameshall rest with the employee.4.4 Protective ClothingWhen the State requires protective clothing to be worn, the State shall provide theprotective clothing. The parties recognize that the State may choose to provide suchprotective clothing by any number of means, including but not limited to, issuance at thework site or requiring employees to report to a contracted retail or wholesale vendor.Protective clothing provided pursuant to this section is State-owned property which will bemaintained as the State deems necessary. Employees issued State-provided protectiveclothing shall be held responsible for loss of and/or damage to the protective clothing otherthan that incurred as the result of normal wear or through no fault of the employee. Whenprotective clothing is provided, the employee shall wear the protective clothing inaccordance with the instructions provided by the State. Protective clothing means particularcolors or types of shirts or pants which are required to be worn, or attire that is worn over orin place of regular clothing and is necessary to protect the employee's personal clothingfrom damage, extreme temperature, or stains which would be present in the normalperformance of duties; for example, aprons, lab smocks, shop coats, certain required workpants, shirts, or coveralls.38BU 12(99-01)
