C. In the event <strong>of</strong> a dispute regarding appropriate designated beneficiaries, the HighwayMaintenance Worker Life Insurance benefit will not be paid until the disputants legally verifythat they have settled their dispute or a court <strong>of</strong> competent jurisdiction resolves the matterfor them.ARTICLE 4 - HEALTH AND SAFETY4.1 Health and Safety CommitteesA. The <strong>State</strong> shall attempt to provide a safe and healthy work place for <strong>State</strong> employees.IUOE supports a positive and strong health and safety program and shall cooperate <strong>with</strong> the<strong>State</strong>'s efforts in this regard.B. The parties agree that Joint IUOE/ Management Health and Safety Committees areappropriate in many areas <strong>of</strong> <strong>State</strong> employment. At IUOE's request, each department shallestablish at least one Joint IUOE/Management Health and Safety Committee. AdditionalJoint IUOE/Management Health and Safety Committees may be established as appropriatefor the larger departments. These Committees may consist <strong>of</strong> no more than fourrepresentatives from IUOE. The <strong>State</strong> may appoint an equal number <strong>of</strong> <strong>State</strong>representatives.C. The Committee shall meet at least quarterly for the purpose <strong>of</strong> discussing safetyproblems and recommending appropriate actions, making recommendations from time totime on the subjects <strong>of</strong> safety, safety promotion, and how to encourage employees to bemore conscious <strong>of</strong> safety.D. Employees appointed to serve on the Committee shall serve <strong>with</strong>out loss <strong>of</strong>compensation.E. To the extent permitted by law, all copies <strong>of</strong> employee occupation injury and accidentreports will be furnished to the appropriate Joint IUOE/Management Health and SafetyCommittee members and remain confidential.4.2 Safety DevicesThe <strong>State</strong> shall furnish all safety devices, wearing apparel and other equipment deemednecessary by the <strong>State</strong> for the protection and safety <strong>of</strong> <strong>Unit</strong> <strong>12</strong> employees such as goggles,gloves, eye glasses, face shields, respirators and machine guards. Employees issued<strong>State</strong>-provided safety devices shall be held responsible for loss <strong>of</strong> and/or damage to thesafety device other than that incurred as the result <strong>of</strong> normal wear or through no fault <strong>of</strong> theemployee. When a safety device is provided the employee shall wear the protective devicein accordance <strong>with</strong> the instruction provided by the department.37BU <strong>12</strong>(99-01)
