3. An employee whose required CDL and/or required endorsement is/are revoked ornot renewed for any reason, or who is not performing commercial vehicle operationsatisfactorily, may be subject to administrative transfer to a position not requiring thepossession <strong>of</strong> a CDL. An employee so transferred will cease to be eligible for the5% differential as described in “1.” above.4. The Union recognizes that the 5% differential will not be paid to incumbents inthose classes in which the <strong>California</strong> <strong>State</strong> Personnel Board specification mandatespossession <strong>of</strong> a CDL as part <strong>of</strong> the minimum qualifications <strong>of</strong> the class.5. Less than full time employees shall receive the differential on a pro-rata basisconsistent <strong>with</strong> hours worked in the month.6. Employees using a CDL are subject to drug and alcohol testing under Federalregulations. Consequently, employees in classifications that require a CDL as aminimum qualification or who receive a CDL differential for maintaining the licensewill be placed in the <strong>State</strong>’s or Caltrans’ random drug and alcohol testing pool.7. At the discretion <strong>of</strong> the employer, and upon written notice to IUOE, additionalclasses or positions may be designated to receive CDL differential in conformance<strong>with</strong> all provisions <strong>of</strong> this section.8. Not<strong>with</strong>standing classification specifications, employees so designated asrequiring a CDL and/or endorsements, can be required to operate vehicles asdeemed necessary by the employer.2.17 Special Assignment PayA. Bargaining <strong>Unit</strong> <strong>12</strong> employees who are assigned for their full work shift to oversee thework <strong>of</strong> six (6) or more “special programs people” will receive special assignment pay <strong>of</strong>$0.30 per hour for that shift. Employees who have worked forty (40) hours in their workweek and who are then assigned to this duty will receive overtime for that day's assignmentand will not receive special assignment pay for that day.B. This special assignment pay also does not apply when supervisory or custody personnelare present for the day and the employee is present merely to provide technical assistanceregarding the work to be done and is not responsible for supervision <strong>of</strong> the specialprograms people.C. It is understood by the Union that the decision to assign or not to assign an employee tosuch duty rests solely <strong>with</strong> the Department and is grievable only up to and including thedepartment head.D. IUOE recognizes that volunteers may donate their time to perform needed functions in avariety <strong>of</strong> settings. Working in cooperation <strong>with</strong> such volunteers does not qualify a <strong>Unit</strong> <strong>12</strong>employee for special assignment pay.2.18 Agricultural Pest Control License DifferentialA. Full-time <strong>Unit</strong> <strong>12</strong> employees who is required to possess a Qualified Applicator’sCertificate (QAC), as defined in Department <strong>of</strong> Pesticide Regulation, and possess the QAC<strong>with</strong> the appropriate outdoor category(s) to perform the duties, shall receive a monthly $50differential while so assigned.18BU <strong>12</strong>(99-01)
