4. Bereavement Leave5. Jury DutyA permanent intermittent employee shall be granted bereavement leave inaccordance <strong>with</strong> Article 1.3 and if scheduled to work on the day(s) for whichthe leave is requested and only for the number <strong>of</strong> hours the employee isscheduled to work on the day(s).A permanent intermittent employee may only be granted jury duty leave if theemployee is scheduled to work on the day(s) in which the service occurs andonly for the number <strong>of</strong> hours the employee is scheduled to work on theday(s). If payment is made for such time <strong>of</strong>f, the employee is required toremit to the <strong>State</strong> the fee(s) received. A permanent intermittent employeeshall not be removed from scheduled work hours because he/she is on juryduty.6. Non-Industrial Disability LeaveWhere employment is intermittent, the payments shall be determined on thebasis <strong>of</strong> the proportionate part <strong>of</strong> a monthly rate established by the totalhours actually employed in the 18 monthly pay periods immediatelypreceding the pay period in which the disability begins as compared to theregular rate for a full- time employee in the same group or class. Anemployee will be eligible for NDI payments on the first day <strong>of</strong> the monthly payperiod following completion <strong>of</strong> 960 hours <strong>of</strong> compensated work.F. Each department will establish a date by which its permanent intermittent employeesshall receive their regular pay.G. The Department will notice each permanent intermittent employee when he/shebecomes eligible for Health, Dental and vision benefits programs as follows:1. For purposes <strong>of</strong> this Section, "control periods" are designated as January 1through June 30 and July 1 through December 31 <strong>of</strong> each calendar year.2. An eligible permanent intermittent employee must enroll in the Health, Dental andVision Programs <strong>with</strong>in 60 days from the end <strong>of</strong> the qualifying "control period".3. A permanent intermittent employee becomes eligible for Health, Dental, andVision Program benefits during each calendar year if the employee has beencredited <strong>with</strong> a minimum <strong>of</strong> 480 paid hours in either one <strong>of</strong> the two "control periods".4. To continue benefits, a permanent intermittent employee must be credited <strong>with</strong> aminimum <strong>of</strong> 480 paid hours in either one <strong>of</strong> the two "control periods" or 960 paidhours in two consecutive “control periods”.H. All remaining conditions <strong>of</strong> employment that relate to the permanent intermittentemployee shall be administered in accordance <strong>with</strong> existing rules and regulations, unlessmodified by this contract.I. The call-in/scheduling <strong>of</strong> a permanent intermittent employee and the hours <strong>of</strong> work anindividual permanent intermittent employee may receive is contingent upon the availability <strong>of</strong>work and funds; the employee's training, experience and knowledge <strong>of</strong> the particularassignment; the employee's skill level and productivity; and the employee's availability forwork.110BU <strong>12</strong>(99-01)
