B. Release time will include necessary travel time to and/or from the examination site if suchtravel time occurs during scheduled work time. In cases where the examination site is inanother city and the employee is permitted to use a private vehicle for the travel, necessarytravel time will be limited to include only that which would be necessary by the mostexpeditions mode <strong>of</strong> travel (e.g. airplane and ground transportation versus private vehicle)and that results in the least disruption to the employer.C. Release time to participate in civil service exams will not result in overtime compensationor reimbursement <strong>of</strong> travel expenses.16.6 Promotional List EligibilityA. Employees desiring promotion to a different geographical area where their promotionallist eligibility is not effective may request a transfer <strong>of</strong> list eligibility by submitting a writtenrequest to the personnel department administering the list in the desired area.B. The parties recognize that list eligibility is under the jurisdiction <strong>of</strong> the <strong>State</strong> PersonnelBoard and accordingly is not grievable or arbitrable.16.7 Performance Appraisal <strong>of</strong> Permanent EmployeesA. The performance appraisal system <strong>of</strong> each department may include annual writtenperformance appraisals for permanent employees. Such performance appraisals shall becompleted at least once each <strong>12</strong> calendar months after an employee completes theprobationary period for the class in which he/she is serving. In the event a newperformance appraisal is not provided <strong>with</strong>in each <strong>12</strong> calendar months, the employee’sperformance shall be deemed to have been satisfactory in all areas.B. A <strong>Unit</strong> <strong>12</strong> employee may file a grievance about his/her performance appraisal whenhe/she receives a substandard rating in a majority <strong>of</strong> the performance factors.C. This section is not subject to the arbitration procedure.16.8 Personnel and Evaluation MaterialsA. An employee's <strong>of</strong>ficial departmental personnel file shall be maintained at a locationidentified by each department head or designee.B. Information in an employee's <strong>of</strong>ficial departmental personnel file shall be confidential andavailable for inspection only to the employee's department head or designee in connection<strong>with</strong> the proper administration <strong>of</strong> the department's affairs and the supervision <strong>of</strong> theemployee; except, however, that information in an employee's <strong>of</strong>ficial departmentalpersonnel file may be released pursuant to court order or subpoena. An affected employeewill be notified <strong>of</strong> the existence <strong>of</strong> such a court order or subpoena.C. Evaluation material or material relating to an employee's conduct, attitude, or serviceshall not be included in his/her <strong>of</strong>ficial personnel file <strong>with</strong>out being signed and dated by theauthor <strong>of</strong> such material. Before the material is placed in the employee's file, the departmenthead or designee, where possible, shall provide the affected employee an opportunity toreview the material, and sign and date it. A copy <strong>of</strong> evaluation material relating to anemployee's conduct shall be given to the employee.103BU <strong>12</strong>(99-01)
