3. Each apprenticeship program shall operate under the Joint Committee concept.That is, each committee shall contain an equal number of representatives selectedby each IUOE and the State. The size of the committee may vary, but no committeeshall contain more than five IUOE and five State representatives nor fewer thanthree IUOE and three State representatives;4. Each Joint Apprenticeship Committee (JAC) shall oversee the training programfor the classes included within that JAC’s program;5. JAC’s shall meet no less than once every three months;6. IUOE representatives who have been selected as Committee members shallserve with no loss of compensation when officially participating in committeemeetings, other committee assigned activities and travel to and from such meetingsand activities;7. The State retains the right to hire, evaluate and discipline any employeeparticipating in an apprenticeship program, taking into consideration therecommendations of the affected JAC;8. The State reserves the right to cancel an apprenticeship program when suchaction is deemed in the best interest of the State. However, subject to the need tolayoff or discipline any apprentice currently in the program shall be allowed tocomplete the program. The State agrees to give IUOE thirty (30) calendar daysnotice prior to canceling an apprenticeship program.C. IUOE and the State agree to jointly explore areas of possible expansion of the existingJAC’s listed in subsection "C" above for other operations in Unit 12. Any claimedapprenticeship program by any Agency or Department of the State that is not in accord withthis section shall immediately be canceled or suspended by the State until such a claimedapprenticeship program is in conformance with the provisions of this section.16.5 Release Time for State Civil Service ExaminationsA. Employees who are participating in a State civil service examination shall be grantedreasonable time off without loss of compensation (wages) to participate in an examination ifthe examination has been scheduled during his/her normal work hours and the employeehas provided reasonable (normally two working days) notice to his/her supervisor. For thepurposes of this Section, hiring interviews for individuals certified from employment listsshall be considered part of the examination process. The State shall attempt toaccommodate a shift change request from an employee who is scheduled to work a swingor graveyard shift for the shift preceding or following a State Personnel Board examination.102BU 12(99-01)
B. Release time will include necessary travel time to and/or from the examination site if suchtravel time occurs during scheduled work time. In cases where the examination site is inanother city and the employee is permitted to use a private vehicle for the travel, necessarytravel time will be limited to include only that which would be necessary by the mostexpeditions mode of travel (e.g. airplane and ground transportation versus private vehicle)and that results in the least disruption to the employer.C. Release time to participate in civil service exams will not result in overtime compensationor reimbursement of travel expenses.16.6 Promotional List EligibilityA. Employees desiring promotion to a different geographical area where their promotionallist eligibility is not effective may request a transfer of list eligibility by submitting a writtenrequest to the personnel department administering the list in the desired area.B. The parties recognize that list eligibility is under the jurisdiction of the State PersonnelBoard and accordingly is not grievable or arbitrable.16.7 Performance Appraisal of Permanent EmployeesA. The performance appraisal system of each department may include annual writtenperformance appraisals for permanent employees. Such performance appraisals shall becompleted at least once each 12 calendar months after an employee completes theprobationary period for the class in which he/she is serving. In the event a newperformance appraisal is not provided within each 12 calendar months, the employee’sperformance shall be deemed to have been satisfactory in all areas.B. A Unit 12 employee may file a grievance about his/her performance appraisal whenhe/she receives a substandard rating in a majority of the performance factors.C. This section is not subject to the arbitration procedure.16.8 Personnel and Evaluation MaterialsA. An employee's official departmental personnel file shall be maintained at a locationidentified by each department head or designee.B. Information in an employee's official departmental personnel file shall be confidential andavailable for inspection only to the employee's department head or designee in connectionwith the proper administration of the department's affairs and the supervision of theemployee; except, however, that information in an employee's official departmentalpersonnel file may be released pursuant to court order or subpoena. An affected employeewill be notified of the existence of such a court order or subpoena.C. Evaluation material or material relating to an employee's conduct, attitude, or serviceshall not be included in his/her official personnel file without being signed and dated by theauthor of such material. Before the material is placed in the employee's file, the departmenthead or designee, where possible, shall provide the affected employee an opportunity toreview the material, and sign and date it. A copy of evaluation material relating to anemployee's conduct shall be given to the employee.103BU 12(99-01)
