ARTICLE 16 - CAREER DEVELOPMENT16.1 TrainingA. The State agrees to reimburse Unit 12 employees for expenses incurred as a result ofcompleting training or education courses required by the department to assure adequateperformance or increase job proficiency. Such reimbursement shall be limited to:1. Tuition and/or registration fees2. Cost of course-required books3. Transportation or mileage expenses4. Toll and parking fees5. Lodging and subsistence expensesB. Reimbursement for the above expenses shall be in accordance with the Business andTravel Expense provision of this Agreement. When training occurs during normal workinghours, the employee shall receive his/her regular salary. When required training occursoutside of normal working hours, Unit 12 employees in accordance with their workweekgroup shall be reimbursed in cash, CTO, or the work hours shall be adjusted on anhour-by-hour basis for the hours of classroom or field instruction or training in a mannerdetermined by the employer.C. If the State agrees with a Unit 12 employee's participation in job related or career-relatedtraining, the State may reimburse the employee for up to 100% of tuition, fees, andcourse-required books, not to exceed department limits after the employee has satisfactorilycompleted the course. Travel, per diem and miscellaneous expenses are not reimbursable.Release time without loss of compensation may be for up to 100% of the time required forcourse attendance. Both parties agree and understand that a different amount ofreimbursement and release time may be provided to employees in the same or similarsituations.D. An employee may receive reimbursement only if application is made prior to enrollmentin non-required career-related training.E. An employee who does not satisfactorily complete a non-required career-related trainingcourse shall not be eligible for reimbursement of expenses and shall agree to return anyadvance payment received. The employee or his/her estate shall receive reimbursementfor authorized expenses if the training is terminated prior to completion either:1. at the convenience of the State, provided that the training facility reportssatisfactory performance by the employee during the training; or2. because of death, prolonged illness, disability or other eventuality beyond thecontrol of the employee.F. Effective with the signing of this agreement, each department, at the request of anemployee required to upgrade their current driver's license to a Class A or Class Bcommercial driver's license and appropriate endorsements because of the new State Laweffective January 1, 1989, will make available to the employee any information prepared bythe Department of Motor Vehicles covering the commercial driver's license examination andany video training programs, relating to the obtaining of a commercial driver's license, whichbecome available to the State.100BU 12(99-01)
G. Heavy Equipment Mechanics in CDF will receive 12 hours of wild land fire safety trainingwithin 12 months following appointment to the classification. The training will be provided atthe ranger unit and/or CDF Academy by field/Academy training officers. Currentincumbents will receive the training within one year of ratification of this Memorandum ofUnderstanding.16.2 Private RoomsA. When staying overnight on State-required training in a commercial establishment, theState will accommodate individual requests for private rooms on a space available basis.Commercial establishments shall be functional, emphasizing clean and comfortable rooms.The rooms must meet the basic needs of comfort and cleanliness.B. For academies and other training situations where the State has contracted forcommercial rates based upon double occupancy, the employer will attempt toaccommodate individual requests for private rooms on a space available basis; however, ifsuch a request is accommodated, the employee requesting a private room will assume theadditional costs.16.3 Training CommitteeA. The State and the Union shall establish a joint Labor Management Committee for thepurpose of evaluating training and upgrading in Unit 12.B. The Committee shall be comprised of four representatives selected by the Union andfour representatives selected by the State.C. The Committee shall determine who among the eight members of the committee shall bethe chairperson.D. In the event the committee recommends the establishment of training programs in Unit12, the recommendation shall be adopted and the State shall participate in trainingprograms utilizing IUOE training funds and contributing to such funds consistent with othercontributing employers.16.4 Joint Apprenticeship CommitteesA. The state and the union support the establishment and operation of apprenticeshipprograms where deemed appropriate within State Unit 12.B. IUOE and the State agree that any apprenticeship program that is established for Stateemployees within any Agency, Department or subdivision of the State that would produce,upon successful completion of such a program, placement in a position or title that isassigned within the exclusive representation unit determined by PERB for Unit 12, shall beadministered in accordance with the following provisions:1. The classification of positions and the selection process shall be governed andadministered in accordance with State Personnel Board rules and regulations;2. Each Apprenticeship program shall be in accord and conform in all respects withthe rules and regulations for apprenticeship of the Division of ApprenticeshipStandards, Department of Industrial Relations;101BU 12(99-01)
