It shall extend to the whole of the State of <strong>Punjab</strong>.(2) It shall come <strong>in</strong>to force at once.Def<strong>in</strong>itions2. In this <strong>Act</strong> unless a different <strong>in</strong>tention appears from the subject or context:-(a) the expression "land" means land with<strong>in</strong> any area preserved and protected or otherwisedeal with <strong>in</strong> manner <strong>in</strong> this <strong>Act</strong> provided, and <strong>in</strong>cludes benefits to arise out of land, andth<strong>in</strong>gs attached to the earth or permanently fastened to anyth<strong>in</strong>g attached to the earth;(b) the expression "Cho" means a stream or torrent flow<strong>in</strong>g through or from the Siwalikmounta<strong>in</strong> range with <strong>in</strong> <strong>Punjab</strong>;(c) the expression "tree", "timber", "forest produce" and "cattle", respectively, shall have themean<strong>in</strong>gs severally assigned thereto <strong>in</strong> section 2 of the Indian Forest <strong>Act</strong>, 1927;(d) the expression "person <strong>in</strong>terested" <strong>in</strong>cludes all persons claim<strong>in</strong>g any <strong>in</strong>terest <strong>in</strong>compensation to be made on account of any measures taken under this <strong>Act</strong>;(e) the expression "Deputy Commissioner" <strong>in</strong>cludes any officer or officers at any timespecially appo<strong>in</strong>ted by the State Government to perform the functions of aDeputy Commissioner under this <strong>Act</strong>;(f) -------- the expression "right-holder" <strong>in</strong>cludes-(i) persons not be<strong>in</strong>g tenants or mortgagees hav<strong>in</strong>g rights to or <strong>in</strong> land; and(ii) persons hav<strong>in</strong>g rights of collection of forest produce or of graz<strong>in</strong>g or pasture; and(g) the expression "erosion" <strong>in</strong>cludes the removal or displacement of earth, soil, stones orother material by the action of w<strong>in</strong>d or water.NOTIFICATION AND REGULATION OF AREASNotification areas3. Whenever it appears to the State Government that it is desirable to provide for theconservation of subsoil water or the prevention of erosion <strong>in</strong> any area subject to erosion or likelyto become liable to erosion, such Government may – by notification make a directionaccord<strong>in</strong>gly.- 5 -


4. In respect of areas notified under section 3 generally or 'the whole or anypart of any such area the State Government may be general or special order,temporarily regulate, restrict or prohibit-Power to regulate,restrict or prohibit, bygeneral or specialorder, with<strong>in</strong> notifiedareas, certa<strong>in</strong> matters.(a)(b)(c)(d)(e)(f)the clear<strong>in</strong>g or break<strong>in</strong>g up or cultivat<strong>in</strong>g of land not ord<strong>in</strong>arily undercultivation prior to the publication of the notification under section 3;the quarry<strong>in</strong>g of stone or the burn<strong>in</strong>g of lime at places where such stone orl<strong>in</strong>e had not ord<strong>in</strong>arily been so-quarried or burnt prior to the publication ofthe notification under section 3 ;the cutt<strong>in</strong>g or trees or timber, or the collection or removal or subjection toany manufactur<strong>in</strong>g process, otherwise than as described <strong>in</strong> clause (b) of thissubsection of any forest-produce other than grass, save for bona fidedomestic or agricultural purposes of right-holder <strong>in</strong> such area;the sett<strong>in</strong>g on fire of trees, timber or forest produce;the admission, herd<strong>in</strong>g, pastur<strong>in</strong>g or retention of sheep goats or camels;the exam<strong>in</strong>ation of forest-produce pass<strong>in</strong>g out pf any such area; and(g)the grant<strong>in</strong>g of permits to the <strong>in</strong>habitants of towns and villages situatedwith<strong>in</strong> the limits or <strong>in</strong> the vic<strong>in</strong>ity of any such area, to take any tree, timberor forest produce for their own Use therefrom, or to pasture sheep goats orcamels or to cultivate or erect build<strong>in</strong>gs there<strong>in</strong> and the production andreturn of such permits by such persons,5. In respect of any specified village or villages, or part or parts thereof, comprisedwith <strong>in</strong> the limits of any area notified under section 3 the State Government may,by special order temporarily regulate, restrict or prohibit-(a) the cultivat<strong>in</strong>g of any land ord<strong>in</strong>arily under cultivation prior to thepublication of the notification under section 3:(b) the quarry<strong>in</strong>g of any stone or the burn<strong>in</strong>g of any lime at places where suchstone or lime had ord<strong>in</strong>arily been so quarried or burnt prior to thepublication of the notification under section 3;(c) the cutt<strong>in</strong>g of trees and timber or 'the collection or removal or subjectionto any manufactur<strong>in</strong>g process, otherwise than as described <strong>in</strong> clause (b) ofthis sub-section of any forest-produce for any purposes; andPower <strong>in</strong> certa<strong>in</strong>cases, to regulate,restrict or prohibitby special order,with<strong>in</strong> notifiedareas, certa<strong>in</strong>further matters- 6 -


him, such cost shall be recoverable as an arrear of land revenue and a certificate issued by theDeputy Commissioner <strong>in</strong> this behalf shall be f<strong>in</strong>al and conclusive evidence of the sum sorecoverable and the person liable for the same.(9) Every order issued under this section shall be published <strong>in</strong> such manner as may beprescribed m the rules made under this <strong>Act</strong>, and upon such publication every person affectedthereby shall unless the contrary be proved, be deemed to have had due notice thereof.(10) The Deputy Commissioner may by general or special order authorise any revenueofficer subord<strong>in</strong>ate to him to enquire <strong>in</strong>to any objection that may be brought under this section;Provided that no f<strong>in</strong>al order on any such objection shall be passed except by the DeputyCommissioner himself. .(11) In mak<strong>in</strong>g an order on objections brought under this section, the Deputy Commissionershall be guided by such rules, if any, as the State Government may make <strong>in</strong> this be half.(12) For the purposes of this section, the expression "estate" shall have the mean<strong>in</strong>g assignedthereto <strong>in</strong> the <strong>Punjab</strong> <strong>Land</strong> Revenue <strong>Act</strong>, 1887.CONTROL OVER THE BEDS OF CHOS.8. (1) Wherever it appears to the State Government that it is desirable thatmeasures should be taken <strong>in</strong> the bed of any cho for the purpose of-(a) regulat<strong>in</strong>g the flow of water with<strong>in</strong> and prevent<strong>in</strong>g the widen<strong>in</strong>g or extension ofsuch bed, or of(b) reclaim<strong>in</strong>g or protect<strong>in</strong>g any land situate with<strong>in</strong> the limits of such bed;such Government may, either proceed at once <strong>in</strong> manner <strong>in</strong> subsection (2)provided, or, <strong>in</strong> the first <strong>in</strong>stance, by notification specify<strong>in</strong>g the nature and extent of themeasures to be taken, and the locality <strong>in</strong> and the time with<strong>in</strong> which such measures are tobe taken, require all persons possess<strong>in</strong>g proprietary or occupancy right <strong>in</strong> land situate <strong>in</strong>such locality to themselves carry out the measures specified <strong>in</strong> such notificationaccord<strong>in</strong>gly.<strong>Act</strong>ion when StateGovernment mentconsiders itdesirable to takemeasures toregulate the beds ofchos. vest<strong>in</strong>g ofsuch beds <strong>in</strong> StateGovernment(2) If the whole or any part of the bed of any cho be unclaimed, or if, <strong>in</strong> the op<strong>in</strong>ionof the State Government the measures deemed necessary under subsection (1) are of sucha character, <strong>in</strong> regard to extent and cost, that the <strong>in</strong>terference of the State Government isabsolutely necessary, or <strong>in</strong> the event of the owner or occupier of any portion of- 10 -


the bed of any cho fail<strong>in</strong>g to comply with the requirements. of any notification issuedunder subsection (1), such Government may, by notification, declare that the whole or anypart of the area comprised with<strong>in</strong> the limits of the bed of any cho shall vest <strong>in</strong> the StateGovernment for such period and subject to such conditions (if any) as may be specified <strong>in</strong>the notification. .Provided that no such declaration shall be made <strong>in</strong> respect of or shall affect any land<strong>in</strong>cluded with<strong>in</strong> the limits of the bed of any such cho, which, at the date of the publicationof the notification mak<strong>in</strong>g such declaration, is cultivated or culturable, or yields anyproduce of substantial value.(3) When the owners or occupiers of such locality are unable to agree among themselvesregard<strong>in</strong>g the carry<strong>in</strong>g out of such measures, the decision of those pay<strong>in</strong>g the largeramount of land revenue shall be held to be b<strong>in</strong>d<strong>in</strong>g on all.Effect ofnotification tosuspend orext<strong>in</strong>guishprivate rights <strong>in</strong>the area notifiedunder section 8(4) The State Government may, from time to time, by like notification, extend the perioddur<strong>in</strong>g which any such area shall rema<strong>in</strong> vested <strong>in</strong> the State Government.9. Upon the mak<strong>in</strong>g of any declaration under subsection (2) of section 8, all privaterights of whatever k<strong>in</strong>d exist<strong>in</strong>g <strong>in</strong> or relat<strong>in</strong>g to any land comprised with<strong>in</strong> the areaspecified <strong>in</strong> the notification conta<strong>in</strong><strong>in</strong>g such declaration at the time of the publicationthereof, shall be suspended for the period specified <strong>in</strong> the declaration and for suchfurther period (if any) to which such period may at any time be extended.Provided that, as far as circumstances admit, such rights of way and water shall be reserved, <strong>in</strong> respect oPower of DeputyCommissioner todelimit the bed andto decide whatconstitutes such bed.Power to takepossession of bedwhen vested <strong>in</strong> StateGovernment.10. (1) The Deputy Commissioner shall, for the purposes of every notification issuedunder subsection (2) of section 8, fix the limits of the comprised with<strong>in</strong> the bed of thechoto to which such notification is to apply.(2) Upon the publication of a notification conta<strong>in</strong><strong>in</strong>g any declaration undersubsection (2) of section 8, it shall be lawful for the Deputy Commissioner, to -(a) take possession of the area specified <strong>in</strong> such declaration;(b) eject all persons there from ; and to(c) deal with such area while it rema<strong>in</strong>s vested <strong>in</strong> the State Government as if it were theabsolute property of the State Government.- 11 -


11. No person shall be entitled to any compensation for anyth<strong>in</strong>g at any time done, <strong>in</strong>good faith <strong>in</strong> exercise of any power conferred by section 8, section 9 or section 10.12. (Condition as to sale of land acquired under the <strong>Act</strong> and obligation of LocalGovernment to keep account of moneys expended on such land) Repealed by <strong>Act</strong> VIII of 1926,section 4.POWER TO ENTER UPON AND DELIMIT NOTIFIED AREAS AND BEDS13. It shall be lawful for the Deputy Commissioner and for subord<strong>in</strong>ate officers, servants,care takers, and workmen, from time to time, as occasion may require.(A) to enter upon any survey any land comprised with<strong>in</strong> any area <strong>in</strong> regard to which anynotification has been issued under section 3 or section 8 or <strong>in</strong> regard to which a notification isproposed to be issued under section 5-Aarea <strong>in</strong> regard to which any notification has been issuedunder section 3 or section 8 or <strong>in</strong> regard to which a notification is proposed to be issued undersection 5-A;(b) to erect bench-marks on and to delimit and demarcate the boundaries of any sucharea; and(c) to do all other acts and th<strong>in</strong>gs which may be necessary <strong>in</strong> order adequately to preserveor protect any land or to give effect to all or any of the provisions of this <strong>Act</strong> :Provided that reasonable compensation to be assessed and determ<strong>in</strong>ed <strong>in</strong> the manner <strong>in</strong> this <strong>Act</strong>provided shall be made <strong>in</strong> respect of any damage or <strong>in</strong>jury caused to the property or rights of anyperson <strong>in</strong> carry<strong>in</strong>g out any operations under the provisions of this section, but no suchcompensation shall be payable <strong>in</strong> respect of any this done under the said provisions with<strong>in</strong> thelimits of any area notified under section. 8INQUIRY INTO CLAIIVISAND AWARD OF COMPENSATION14. ( 1) . The Deputy Commissioner shall(a) fix a date for <strong>in</strong>quir<strong>in</strong>g <strong>in</strong>to all claims made under section 7 and may <strong>in</strong> his discretionfrom time to time adjourn the <strong>in</strong>quiry to a date to be fixed by him;(b) record <strong>in</strong> writ<strong>in</strong>g all statements made under section 7;(c) <strong>in</strong>quire <strong>in</strong>to all claims duly preferred under section 7; and(d) make and award upon each such claim, sett<strong>in</strong>g out there<strong>in</strong> the nature and extent ofthe right claimed,- 12 -


the person or persons mak<strong>in</strong>g such claim, the extent (if any) to which, and the person, or persons<strong>in</strong> whose favour, the right claimed is established, the extent to which it is to be restricted orprohibited that the nature and amount of the compensation (if any)awarded.(2) For the purposes of every such <strong>in</strong>quiry, the Deputy, Commissioner may exercise all orany of the power of a Civil Court <strong>in</strong> the trial of suits under the Code Civil Procedure <strong>Act</strong> XIV of1882.(3) The Deputy Commissioner shall announce his award to such persons <strong>in</strong>terested, or theirrepresentatives, as are present, and shall record the acceptance of those who accept it. To such asare not present, the Deputy Commissioner shall cause immediate notice of his award to be given.15. (1) In determ<strong>in</strong><strong>in</strong>g the amount of compensation, the. Deputy Commissioner shall beguided, so far as may be, by the provisions of sections 23 and 24 of the <strong>Land</strong> Acquisition <strong>Act</strong>,1894 and as to matters which cannot be dealt with under those provisions by what is just andreasonable <strong>in</strong> the circumstances of each case. . .(2) The Deputy Commissioner may, with the sanction of the State Government and theconsent of the person titled, <strong>in</strong>stead of money award compensation <strong>in</strong> land or by reduction <strong>in</strong>revenue or <strong>in</strong> any other form.(3) If <strong>in</strong> any case, the exercise of any right is prohibited for a time only, compensation shallbe awarded only <strong>in</strong> respect of the period dur<strong>in</strong>g which the exercise pf such right is so prohibited.Record ofrights <strong>in</strong>respect ofnotifiedarea.PROCEDURE RECORDS AND APPEAL16. (1) For every area, notified under section 3 or section 8, the Deputy Commissionershall prepare a record sett<strong>in</strong>g forth the nature, description, local situation and extent of all rightsmentioned <strong>in</strong> section 4 and section 5-(a) exist<strong>in</strong>g with<strong>in</strong> such area at the time of the publication of the notification relat<strong>in</strong>gthereto under section 3 or section8,(b) regulated, restricted or prohibited by an order under section 4 or section 5(2) When any award is made under section 14, its effect upon any right shall also be recordedthere<strong>in</strong>.Mode ofproclaim<strong>in</strong>gnotificationsand of serv<strong>in</strong>gnotices, ordersand processesissued underthe <strong>Act</strong>.17. (1) Upon the publication of a notification issued under any of the provisions ofthis <strong>Act</strong>, the Deputy Commissioner shall cause public notice of the substance thereof to begiven at convenient places <strong>in</strong> the locality to which such notification relates.- 13 -


(2) The procedure prescribed <strong>in</strong> sections 20, 21 and 22 of the <strong>Punjab</strong> <strong>Land</strong> Revenue <strong>Act</strong>,1887, shall be followed, as far as may be, <strong>in</strong> proceed<strong>in</strong>gs under this <strong>Act</strong>.18. Every order passed and every award made by a Deputy Commissioner under this<strong>Act</strong>, shall, for the purposes of appeal, review and revision, respectively be deemed to be theorder of a Collector with<strong>in</strong> the mean<strong>in</strong>g of sections 13,14 15 and 16 of the <strong>Punjab</strong> <strong>Land</strong> Revenue<strong>Act</strong>, 1887.Provided that noth<strong>in</strong>g <strong>in</strong> this <strong>Act</strong> conta<strong>in</strong>ed shall be deemed to exclude the jurisdiction ofany Civil Court to decide any dispute aris<strong>in</strong>g between the persons <strong>in</strong>terested <strong>in</strong> any compensationawarded as to the apportionment or distribution thereof amongst such persons or any of them.PENALTIES, BAR OF SUITS AND RULES19. Any person who, with<strong>in</strong> the limits of any area notified under section 3,commits any breach of any regulation made, restriction or prohibition imposed, order passedor requisition made under sections 4, 5, 5-A, or 7-A shall be punished with imprisonment fora term which may extend to one month, or with a f<strong>in</strong>e which may extend to one hundredrupees , or with both.20. The provisions of section, 52, 54, 55, 56, 57, 58, 59 , 61, 61 ,62, 64, (exclud<strong>in</strong>g the last sentence), 66, 67,68 and 73 of the Indian Forest <strong>Act</strong>, 1927, shall so far asapplicable, be read as part of this <strong>Act</strong>, and for the purposes of those provisions, every offencepunishable under section 19 shall be deemed to be a “forest offence” , and every officeremployed <strong>in</strong> the management of any area notified under section 3 or section 8, as caretaker orotherwise, shall be deemed to be a forest officer.21. No suit shall lie aga<strong>in</strong>st the Government for anyth<strong>in</strong>g done under this <strong>Act</strong>,and no suit shall lie aga<strong>in</strong>st any public servant for anyth<strong>in</strong>g done, or purport<strong>in</strong>g to have beendone, by him, <strong>in</strong> good faith under this act.22. (1) The State Government may make rules, consistent with this <strong>Act</strong>, -(a) regulat<strong>in</strong>g the procedure to be observed <strong>in</strong> any <strong>in</strong>quiry or proceed<strong>in</strong>g under this<strong>Act</strong>; and(b) generally for the purpose of carry<strong>in</strong>g <strong>in</strong>to effect all or any of the provisions ofthis <strong>Act</strong>.(2) All rules made under this section shall be published <strong>in</strong> the Official Gazette.- 14 -
