PAINTED DESERT<strong>RULES</strong> & <strong>REGULATIONS</strong>SCOPEPURPOSE: The purpose of the Painted Desert CommunityAssociation (PDCA) Rules and Regulations is to give all<strong>Resident</strong>s, both Homeowners and Tenants, as well as all Visitorsan understanding of the restrictions as published in the PaintedDesert Master Declaration of Covenants, Conditions andRestrictions, commonly referred to as the PDCA CC&Rs.A Brief History to help you understand why we have Rules andRegulations.In March of 1987 The Developer, referred to as the Declarant,published the PDCA CC&Rs. This Governing Document, alongwith the PDCA Articles of Incorporation and PDCA By-laws,required all purchasers of homes or Condominiums in PaintedDesert, all Sub-Associations, and Delegate Districts, to followthese Documents without exception. These Documents wereintended to ensure that the living standards were maintained ashigh as possible so that no <strong>Resident</strong> could have a negative effecton any of their neighbors’ property, lessening the value of theproperties, tranquility and overall appearance.The Association Members are PDCA Homeowners as well asVolunteers. The PDCA Board of Directors has the responsibilityto enforce these documents, as was required when theAssociation was turned completely over to the Homeowners.According to PDCA Governing Documents, the Board of Directorshas the right to adopt and/or amend such Rules and Regulationsas it deems proper for the use of the Association Property. (SeeSection 5.02 PDCA CC&Rs)- 1 -NEVADA REVISED STATUTES:NRS 116.31065 RulesThe rules adopted by an association:1. Must be reasonably related to the purpose for which theyare adopted.2. Must be sufficiently explicit in their prohibition, direction orlimitation to inform a person of any action or omissionrequired for compliance.3. Must not be adopted to evadeassociation.any obligation of the4. Must be consistent with the governing documents of theassociation and must not arbitrarily restrict conduct orrequire the construction of any capital improvements by aunit’s owner that is not required by the governingdocuments of the association.5. Must be uniformly enforced under the same or similarcircumstances against all units’ owners. Any rule that is notso uniformly enforced may not be enforced against anyunit’s owner.6. May be enforced by the association through the impositionof a fine only if the association complies with therequirements set forth in NRS 116.31031.- 2 -


QUICKPASS VISITOR MANAGEMENT <strong>AND</strong>ACCESS CONTROL SYSTEMThe QuickPass Visitor Management and Access Control System benefitsall PDCA <strong>Resident</strong>s. Here are just a few ways:1. <strong>Resident</strong> vehicles with a valid QuickPass transponder may use theright “Transponder Only” lane for automatic entry. All <strong>Resident</strong>vehicles without a QuickPass transponder must enter all mannedPDCA gates through left “Non-transponder” lane and wait in line forentry authorization. QuickPass transponders may be purchased atthe PDCA Community Center office.2. Gives Gate Guards the ability to more closely monitor the left “Nontransponder”lane to verify all vehicles allowed access are authorizedto enter PDCA and take a photo of the vehicle license.3. Allows <strong>Resident</strong>s to go online and update their own QuickPass profileinformation 24 hours a day via the internet or have the clerks at thePDCA Center do it for you during business hours if you do not have acomputer or internet access. After logging on to your PDCAQuickPass profile the first time using the system generated “Login”and “Password” you may change them at any time. All data issecured through the same security measures currently used in onlinebanking.4. <strong>Resident</strong>s can provide all guests and vendors with turn by turndriving directions to their home, which will be automatically printeddirectly on the PDCA Visitors Pass, by inputting the detailed drivingdirections on their QuickPass profile using the “Directions” tab.5. When a property is sold or there is a change in Tenants the PDCACommunity Manager has the ability to delete the old transpondernumber immediately prohibiting further automatic entry by the oldOwner or Tenant. Homeowners are required to provide thisinformation to the PDCA Community Manager.6. Homeowners who have Tenants living in their homes have the abilityto set up a separate QuickPass “Tenant Profile” allowing the Tenantto manage their own visitors. The Homeowner can see all the dataand activity on the Tenant’s profile; however the Tenant cannot seethe Homeowner’s profile data.7. All <strong>Resident</strong>s have the ability to communicate important informationdirectly to the Guards on duty through the “Notes” field on yourinternet profile. Anything put in this field pops up automaticallywhen a Guard pulls up your “Admit List.” You may note such thingsas “Do not admit John Smith” or “Will be on vacation from Aug 1through Aug 15 th . Do not admit anyone during this time period.”- 3 -PAINTED DESERT<strong>RULES</strong> <strong>AND</strong> <strong>REGULATIONS</strong>As amended and adopted: June 19, 2008Although no Sub-Association can have less restrictive Rules andRegulations than PDCA some Sub-Associations may have morerestrictive R&Rs. Contact your Sub-Association for thoseGoverning Document restrictions.ADMINISTRATION:1) There shall be NO abusive or harassing behavior, eitherverbal or physical, or any form of intimidation or aggressiondirected toward any <strong>Resident</strong>, Guest, Security personnel,Management and/or its Employees, Contractor, or Vendors.Violators are subject to automatic fines. (See Section 5.02 PDCACC&Rs and NRS 116.31065 Rules)2) Constructive Notice and Acceptance: Every person whoowns, occupies or acquires any right, title, estate or interest inor to any Lot or Condominium shall be conclusively deemed tohave consented and agreed to every limitation, restriction,easement, reservation, condition and covenant, whether or notany reference to the Governing Documents was contained inthe instrument by which such person acquired an interest inthe Properties, or any portion thereof. (See Section 12.09 PDCACC&Rs)3) All Homeowners are solely responsible for their Guests,Tenants,Invitees, or any Persons or Animals grantedpermission by the <strong>Resident</strong>, to enter the PDCA property. (SeeSections 6.04 and 9.01 PDCA CC&Rs)4) It is the responsibility of each Homeowner to provide copies ofallGoverning Documents, including the Rules andRegulations, to each Tenant, and to ensure that each Tenantabides by all the Governing Documents. (See Fifth AmendmentSection 7.19 PDCA CC&Rs)5) It is the responsibility of each Homeowner to informprospective purchasers and make available to them a copy ofall Governing Documents, including the Rules andRegulations, for review. (See NRS 116.4109 Resale of units)- 4 -


6) There shall be NO hazardous or unlawful activity withinPDCA including, but not limited to, setting off of all Fireworks(includingSafe-N-Sane), explosives, volatile chemicals,discharge of all firearms, etc. There shall be NO storage ofhazardous or unlawful materials within PDCA including, butnot limited to, fireworks, explosives, volatile chemicals, etc.Police Activity within Painted Desert will be considered aHealth and Safety violation subject to the maximum finesunder law. Exceptions to this rule would be home break ins;trespassing; burglaries-home or vehicle etc.(See Sections 7.01and 7.09 PDCA CC&Rs)7) Homeowners/Tenants shall be considerate of theirneighbor’s rights to reside free of any nuisance. (See Sections7.04 and 7.05 PDCA CC&Rs)8) All complaints must be submitted in writing to the PDCAProperty Manager as soon as possible. If the situationrequires immediate action, Management may be called, willdeal with the complaint, and inform you of the outcome. Incases where PDCA Management is not available, then andonly then you may report it directly to Security. Gate Guardscan contact the Security Supervisor. (You must still submityour complaint in writing as soon as possible.) (See Section12.02 PDCA Bylaws, 5.02 PDCA CC&Rs and NRS 116.31065 Rules)9) All Lots and Condominiums in PDCA shall be improved andused solely for Single Family residential use by theHomeowner or their Tenant. (See Section 7.15 PDCA CC&Rs)BUSINESS USE OF A RESIDENCE:10) Operation of a business of any type from a residence isprohibited, except a business without any external evidencethereof and which does not create a nuisance. (See Section7.15 PDCA CC&Rs)ENTRY TO PAINTED DESERT COMMUNITY:11) All unlicensed or uninsured vehicles will be denied entry toPDCA and except for Golf Carts (See Rules 37-41) are notpermitted on PDCA streets at anytime.- 5 -12) All new Homeowners/Tenants must fill out a QuickPassprofile and register their vehicles with PDCA at theCommunity Center office within 14 days of eitherpassing escrow or signing a lease.13) <strong>Resident</strong> vehicles with a valid Quick Pass transponder mayuse the right “Transponder Only” lane for automatic entry.All <strong>Resident</strong> vehicles without a Quick Pass transponder mustenter all manned PDCA gates through the left “Nontransponder”lane and wait in line for entry authorization.Quick Pass transponders may be purchased at the PDCACommunity Center office. As of January 1, 2009 Quick Passtransponders.are mandatory for all PDCA vehicles except forresidents of Villa Trinidad/Tierra Del Sol.14) Any vehicle without a QuickPass transponder caughtpiggybacking in through the right “Transponder Only”lane will result in an immediate Health and Safetyviolation fine for the responsible Homeowner.15) RESIDENT VEHICLE REGISTRATION:Prior to January 1st of each calendar year allHomeowners/Tenants are required to update their <strong>Resident</strong>Profile data in the QuickPass System via the internet(internet access is available at the Community Center ifneeded) and have the responsibility to keep all informationcurrent. In connection with this information, a PDCAVehicle ID and/or Annual decal will be issued and a <strong>Resident</strong>QuickPass transponder may be purchased. AllHomeowners/Tenants must have a PDCA Vehicle ID andcurrent Annual decal for all vehicles registered to a PDCAaddress.- 6 -


Failure to comply within 45 days from a change mayresult in warnings and fines. Failure to notify PDCAManagement of any changes may nullify an issuedPDCA Vehicle ID and QuickPass transponder. (For GolfCart ID see Rules 37-41.)DOCUMENTATIONREGISTRATION:Valid Driver’s License for each driverREQUIRED FOR PDCA VEHICLEDOCUMENTATION REQUIRED FOR EACH VEHICLE:PROOF OF INSURANCE –must be current(continued from previous page)CURRENT PDCA VEHICLE ID (if applicable),The Make, Model, Color, Year, State, and License platenumber, for each vehicle.STATE VEHICLE REGISTRATION–must be current (Ifnew unregistered vehicle, a “DEALER’S REPORT OF SALE” isacceptable until State Registration is obtained)16) The PDCA Vehicle ID, Annual decal and QuickPasstransponder must be removed from all vehicles before theyare sold or will no longer be used on PDCA property. Thischange must be reported to PDCA Management to allow thePDCA Vehicle ID and transponder number to be deletedand a new PDCA Vehicle ID and QuickPass transponderissued, if required, for a new vehicle.- 7 -ENTRY FOR GUESTS/VISITORS TO PDCA:17) It is the responsibility of the PDCA <strong>Resident</strong> to notify theappropriate Gate Guard of the destination address includingunit number, Visitor/Company name, date and approximatetime of arrival of all guests, tradesmen, services, and/ordeliveries. <strong>Resident</strong>s must enter proper name (nonicknames) visitor information in the QuickPass System viathe internet (internet access is available at the CommunityCenter if needed) or call the appropriate gate at the followingnumbers and provide the necessary information prior toarrival:Gate 1 645-3649Gate 2 645-5128Gate 3 645-5139Gate 4 645-5149All guests and residents that do not have the current yearsticker willbe asked to show the Gate Guard current photo ID.ENTRY FOR COMMERCIAL/SERVICE VEHICLES:18) All health-related, Emergency, Public Utility Services, fooddelivery, florist delivery, Real Estate agents showing listedproperties (subject to the homeowner submitting notice) and<strong>Resident</strong> personal transportation vehicles which will beparked in a garage or signage covered in compliance withSub-Association restrictions are allowed in at all times.- 8 -


EMERGENCY REPAIR ONLY VEHICLES ARE ALSOALLOWED ENTRY AT ALL TIMES.These include:Garage door repair (safety issue)Window repair (safety issue)A/C or heater repair (safety issue)Flooded residence (plumbers, water extractors)Cable TV outageWater heater repair/replacement19) Except as noted in Rule 18 all Commercial Moving vans(including rental U-Haul types), trailers, tradesmen, day-todayservice personnel, and deliveries (furniture, appliances,etc) will be denied entry to PDCA before 7:00a.m. and maynot enter or remain in PDCA after 6:00p.m, Monday throughSaturday. Entry to PDCA is prohibited on all Sundays andall Federal Holidays as outlined in Rule 21.20) All PDCA <strong>Resident</strong> owned motor homes, trailers, RV’s, mayenter PDCA for the purpose of loading/off-loading onlyduring the hours noted in Rule 21; and must be removedfrom PDCA immediately. (See Section 7.18 PDCA CC&Rs )21) Construction/Labor/Service Schedules:Construction, Labor and Service hours are limited to Mondaythrough Saturday from 7:00a.m. to 6:00p.m. Entry isprohibited on all Sundays and all Federal Holidays.New Year’s Day Labor DayMartin Luther King Day Columbus DayPresident’s Day Veteran’s DayMemorial Day Thanksgiving DayIndependence Day (July 4) Christmas Day- 9 -ENTRY FOR PEDESTRIANS:22) Pedestrians will enter and exit the PDCA community throughthe pedestrian gates only and shall not enter or exit throughthe vehicle gates or over any wall or fence or locked gates.(Pedestrians shall be considered anyone not in or on amotorized vehicle.) (See 5.02 PDCA CC&Rs and NRS 116.31065)23) It shall be the responsibility of any Homeowner or Tenantintending to use the pedestrian gates to obtain a Pedestriangate key at the PDCA Community Center. A refundabledeposit is required. (See 5.02 PDCA CC&Rs and NRS 116.31065)24) Pedestrians should carry identification with their name andresidence when in PDCA common areas and shouldproduce it if requested by PDCA Security or Management.(See 5.02 PDCA CC&Rs and NRS 116.31065)EXTERIOR MAINTENANCE:25) Homeowners and Sub-Associations shall properly maintaintheir property. No property within the Painted DesertCommunity will be allowed to fall into disrepair. (See Section7.06 PDCA CC&Rs)26) There shall be no interference with the established drainagepattern over any Lot or Condominium so as to affect anyother Lot or Condominium. (See Section 7.07 PDCA CC&Rs)27) Pools shall not be drained into the street or any adjoiningproperty. Pools must only be drained into that property’smain sewer cleanout drain. (See Water District (How to drain yourpool) web site: http://www.lvvwd.com/html/index.html )28) No clotheslines, exposed trash, trash container or any otherunsightly articles shall be visible outside any property. Trashcontainers/tied trash bags shall not be put out for collectionmore than 12 hours before scheduled collection time andshall be removed out of sight no more than 12 hours aftercollection time. (See Section 7.10 PDCA CC&Rs)- 10 -


EXTERIOR MODIFICATION <strong>AND</strong> CONSTRUCTION:29) All Homeowners who intend to make any exteriorimprovement, alteration, or modification must submit aPDCA Architectural Review Request Form along with thewritten ARC approval of their Sub-Association (if applicable)to the PDCA Architectural Review Committee for approval.Request forms, application procedures and specificguidelines for obtaining approval of the PDCA ARC areavailable at the PDCA Community Center. No Request formwill be considered if not completely filled out and submittedby the Homeowner or person having a legal Power ofAttorney. WRITTEN APPROVAL MUST BE GIVEN BYTHE SUB-ASSOCIATION <strong>AND</strong> PDCA ARCs BEFOREWORK COMMENCES. Notification of commencement mustbe given to PDCA and Sub-Association Management.Construction, Labor and Service hours are limited toMonday through Saturday from 7:00a.m. to 6:00p.m.Entry is prohibited on all Sundays and all FederalHolidays. (see Entry Rule #21)New Year’s Day Labor DayMartin Luther King Day Columbus DayPresident’s Day Veteran’s DayMemorial Day Thanksgiving DayIndependence Day (July 4) Christmas DayConstruction/Modification must be completed within 1 yearafter commencement. Failure to comply with this rule mayresult in a work stop order, removal of the alteration at theHomeowners expense, a hearing and possible fine. (SeeSections 7.13 and 8.07 (d) PDCA CC&Rs)30) Homeowners shall be responsible for the conduct of theirContractors and his/her employees and agents while in thePainted Desert Community. Homeowners and contractorsunderstand and agree that violations of these Rules andRegulations may result in a warning, a Stop-Work Order, anassessment, and/or a revocation of the contractor’s right toenter Painted Desert. (See Sections 6.04 and 9.01 PDCA CC&Rs)31) NO DUMPING of any kind is permitted. (See Section 7.05 PDCACC&Rs)- 11 -Dumpsters and/or construction materials will not be placed inthe streets unless prior approval is given by the Sub-Association and the PDCA Board of Directors. Adequatesteps must be taken to protect the streets from damage i.e.(plywood under legs or wheels). Dumpsters or othermaterials left in the streets must have adequate reflectors orsimilar warning devices for the safety of <strong>Resident</strong>s. (SeeSection 7.09 PDCA CC&Rs)32) No temporary structures of any kind will be permitted on anyproperty unless approved in writing by the Sub-Associationand the PDCA Architectural Review Committee. (See Section7.16 PDCA CC&Rs)FLAGS & FLAG POLES:33) Notwithstanding NRS 116.31067 all flags and flag polesmust have the approval of the Sub-Association and PDCAARC before installation.(See www.leg.state.nv.us/NRS/NRS-116.html and Federal Flag Codewww.bcpl.net/~etowner/flagcode.html)GOLF COURSE USE:34) The Painted Desert Golf Course is private property. OnlyGolf Course employees and golfers cleared through the“starter” station are allowed on the course. All others are inviolation and will be subject to fines and penalties fortrespassing. (See Section 12.15 PDCA CC&Rs)GOLF BALLS, ERRANT: PDCA WAIVER OF LIABILITY:35) By acceptance of a deed to a Lot or Condominium in theProperties, the Master Association and each Homeowner,for himself/herself and on behalf of his/her family, Guestsand Tenants, release PDCA, the Owner of the Golf CourseProperty, and their respective lessees, agents, employees,directors, officers, shareholders, partners, and contractors,from all claims, demands, expenses, damages, costs,causes of action, obligations and liabilities, including, withoutlimitation,damage to the Residence and damages forpersonal injury or death, which in any way arise from orrelate to the impact of a golf ball which enters upon thePDCA Property or within any Residence from the GolfCourse Property. (See Section 12.14 PDCA CC&Rs)- 12 -


GOLF CARTS:The following Golf Cart rules apply to PDCA private streetsonly. Sub-Associations may have more restrictive rules.36) All persons operating a Golf Cart must have a currentDrivers License. All Golf Cart owners must provide proof ofcurrent insurance prior to obtaining an ID Number fromeither the Painted Desert Golf Course or PDCA.37) All Golf Carts must display one of the following IdentificationNumbers:(a) Current Painted Desert Golf Course Trail Membersdecal with ID Number issued by the Golf Course.OR(b) PDCA Vehicle ID issued by PDCA Management38) All Golf Cart Owners must record/reconfirm the appropriateID of their cart on their annual PDCA <strong>Resident</strong> QuickPassProfile update. Make, Model, and Color would also beappreciated.39) No Golf Cart is allowed on the Golf Course without a currentTrail Members decal issued by the Golf Course. The Ownerof any Golf Cart on the Golf Course without permission fromthe Golf Course is subject to fines and penalties fortrespassing.40) All Golf Carts operating after darkness must have headlightsand taillights in proper working order.L<strong>AND</strong>SCAPING:41) All Homeowners must install and maintain attractiveLandscaping on the property under their control and notmaintained by a Sub-Association or PDCA. All unimprovedlots must be kept free of weeds and debris. (See Section 7.17PDCA CC&Rs)- 13 -LEASE/RENTAL RESTRICTIONS:42) No Homeowner shall lease or rent their Lot or Condominiumfor less than six (6) months or for transient or hotelpurposes. (See Section 7.19 PDCA CC&Rs)43) No Homeowner shall lease or rent more than three (3) lots orCondominiums concurrently and they must be leased orrented in their entirety. No parking spaces may be leased orrented separately. All lease agreements shall be subject toreview by the PDCA Board of Directors to assurecompliance. Prior to executing a lease it is theHomeowner’s responsibility to contact the PDCA Board ofDirectors to confirm entering into the lease does not violatethe Rental Restrictions. (See Section 7.19 PDCA CC&Rs)44) All Homeowners shall submit copies of the lease within 15days of executing the lease and pay the Registration Fee toPDCA Management. All leases shall be in writing, executedby all parties, requiring the Tenant to comply with all PDCAGoverning Documents, and state: “Any failure by the Tenantto comply with the Governing Documents shall be in defaultunder the lease.” (See Section 7.19 PDCA CC&Rs)45) ENFORCEMENT: Any Homeowner leasing their Lot orCondominium in violation of the Rental Restrictions shall besubject to enforcement as determined by the PDCA Board,in compliance with PDCA Governing Documents. TheHomeowner shall be fully responsible and liable to the PDCAfor all violations by their Tenants, and shall be responsiblefor payment of any assessments or fines incurred by theirTenants. (See Section 7.19 PDCA CC&Rs)MISCELLANEOUS <strong>RULES</strong>:46) <strong>Resident</strong>s and Guests shall obey posted notices and/orsigns at all times.47) No littering of any kind is allowed in PDCA.48) Holiday Decorations/Special Events: Outside decorations onany residence (such as Christmas/party lights) must beremoved within 15 days of the event.- 14 --


49) Any exception to the PDCA Rules and Regulations, due tospecial circumstances, must have prior written approval ofthe PDCA Board of Directors.50) A violation of any one of the CC&Rs or the Rules andRegulations shall be subject to enforcement proceduresand/or assessments.PARTIES & GATHERINGS:51) <strong>Resident</strong>s having a large gathering (20 or more non-PDCA<strong>Resident</strong>s) shall notify PDCA Management at least 10 daysprior to the gathering/party of the arrangements and supplyan alphabetized list of invitees. Gathering/party shall beconducted in a manner as to not be a nuisance to thecommunity. Check with your Sub-Association as they mayhave more restrictive Rules and Regulations.PETS & ANIMALS:52) No unrestrained animals of any kind (including Cats) arepermitted to roam freely in any Sub-Association or PDCAproperty. The maximum number of pets allowable on anyproperty is two (2) unless written approval is obtained fromthe Sub-Association and the PDCA Board. (See Section 7.04PDCA CC&Rs)53) All animals within PDCA must be kept in an enclosed yard oron a leash or other restraint by a person capable of completecontrol of the animal. (See Section 7.04 PDCA CC&Rs)54) No animals, fowls, reptiles, poultry, fish or insects of any kindshall be raised, bred or kept on any Lot or Condominiumwithin PDCA for any commercial purpose, or inunreasonable quantities (any number of Tropical fish may bekept in an indoor tank, if not for any commercial use). (SeeSection 7.04 PDCA CC&Rs)55) All animals except service animals are prohibited from allPDCA recreational facilities and/or Community Center. No pets may be walked on anyoneelse’s property, improved or unimproved (including GolfCourse private property). All pet Owners will carry in plainsight a bag or other device to pick up after their pets andmust do so immediately. The waste must be disposed ofproperly at the Owner’s residence or the residence at whichhe/she is a Guest. No animal waste shall be allowed toaccumulate on any property in any Sub-Association orPDCA, as to allow odors to emanate.56) No animal will be allowed to bark, howl, or whine excessivelyin any way that creates a nuisance for any neighbor. 67) The PDCA requires that garage doors be closed at all timesexcept for ingress/egress or when a member of thehousehold, contractor or service personnel is working in thegarage or on the property. (See Section 7.18 PDCA CC&Rs)68) NO Homeowner, Tenant or Overnight Guest may park, storeor keep any vehicle that has expired tags, any recreationalvehicle (including, but not limited to, any camper unit,house/car or motor home); any bus, trailer, trailer coach,camp trailer, boat, aircraft or mobile home; or any inoperablevehicle or any other similar vehicle or commercial typevehicle that does not fit in the garage with the door closed.Vehicles having commercial signs, exposed tools, ladders orspecial racks to hold such items and/or supplies) must beparked in the garage with the door closed.69) NO Homeowner or Tenant shall park, store, or keepanywhere within the PDCA any vehicle or vehicularequipment, mobile or otherwise, deemed to be a nuisanceby the PDCA Board of Directors.
