47the proposals for the consultation process are contained in the proposedsec. 10AA to be inserted in the Advocates Act, 1961.4.19 <strong>The</strong> consultation process will be as stated in para 4.3, 4.4, 4.5 aboveand in the other paras <strong>of</strong> the Chapter.4.20 We, therefore, recommend that new section in the form <strong>of</strong> section10AA be inserted in the Advocates Act, 1961 for providingconsultation procedure as follows:-Consultation procedure by the <strong>Legal</strong> <strong>Education</strong> Committee <strong>of</strong> theBar Council <strong>of</strong> <strong>India</strong>:“ 10AA. <strong>The</strong> procedure for consultation under clause (h) <strong>of</strong>sub-section (1) <strong>of</strong> section 7, shall be as follows, namely:-(a) in respect <strong>of</strong> proposals relating to standards <strong>of</strong> pr<strong>of</strong>essionallegal education, the Bar Council <strong>Legal</strong> <strong>Education</strong>Committee, shall first consult the State Bar Councils andarrive at provisional proposals and the same shall becommunicated to the University Grants <strong>Commission</strong> <strong>Legal</strong><strong>Education</strong> Committee for its views on such proposals.(b) after receiving the views <strong>of</strong> the University Grants<strong>Commission</strong> <strong>Legal</strong> <strong>Education</strong> Committee, the Bar Council<strong>Legal</strong> <strong>Education</strong> Committee , shall consider the same andarrive at its final decision.(c) the final decision <strong>of</strong> the Bar Council <strong>Legal</strong> <strong>Education</strong>Committee, arrived at under clause (b) shall be enforced bythe Bar Council <strong>of</strong> <strong>India</strong> and shall be binding on alluniversities and all law colleges affiliated to universities, inso far as they relate to standards <strong>of</strong> legal educationnecessary for students to get enrolled at the Bar forpracticing the pr<strong>of</strong>ession <strong>of</strong> law;(d) the University Grants <strong>Commission</strong> <strong>Legal</strong> <strong>Education</strong>Committee may send any proposal in regard to the mattersreferred to in clause (a) for consideration <strong>of</strong> the BarCouncil <strong>Legal</strong> <strong>Education</strong> Committee;
