10611.2 In the light of this discussion, clause (i) of sec. 7(1) needs to beamended for conferring powers to the Bar Council of India to recognize auniversity or to issue direction to any university to disaffiliate a law collegein consultation with the Legal Education Committee of the Bar Council ofIndia.11.3 We recommend that section 7(1)(i) should be substituted as follows:“(i) to recognize universities whose degree in law shall be aqualification for enrolment as an advocate or to de-recognise suchUniversity or to issue direction to any University to disaffiliate a lawcollege in consultation with the Bar Council Legal EducationCommittee ”We further recommend that in section 49 (1), following clauseshould be inserted:“(aj) the procedure regarding recognition and de-recognition of suchuniversities as referred to in clause (i) of sub-section(1) of section 7and the procedure regarding the issuing of direction to a university todisaffiliate a Law college.”
107Chapter XIITraining and Apprenticeship12.0 Before the Advocates Act, 1961 was enacted, there was a system bywhich a law graduate had to undergo training by way of apprenticeship inthe chambers of a lawyer for one year and pass a separate Bar examinationconducted by the Bar Council on the subjects of the Code of CivilProcedure, 1908 and the Code of Criminal Procedure, 1898. It was onlyafter a law graduate successfully completed his apprenticeship and the Barexamination that he became eligible to be enrolled as an Advocate. (Priorto 1961, the enrolment had to be moved in the court of the Chief Justice ofthe High Court concerned and the motion for enrolment was to be by asenior advocate practicing in the High Court. There was convention of abrief interview in the chambers of the Chief Justice of the High Courtbefore the enrolment was later moved in open court on the same day).12.1 After the Advocates Act, 1961 came into force, the procedure forapprenticeship was continued by virtue of clause (d) of subsection (1) ofsec. 24. (The enrolment was, however, to be before the enrolmentcommittee of the State Bar Council.) That clause required the graduate inlaw to undergo a course of “training in law and pass an examination aftersuch training”, before he could be enrolled. Certain categories of personswere exempted under a proviso to the said sub-clause.12.2 In the year 1964 there were certain amendments to sec. 24 but it isnot necessary to refer to them in as much as in 1973, by Act 60/73, clause(d) of subsection (1) of sec. 24 was omitted and the amendments made in
