RFQ <strong>document</strong> <strong>for</strong> <strong>development</strong> <strong>of</strong> Four Laning <strong>of</strong> Rewa Ring Road on BOT (Toll + Annuity) basis6. MISCELLANEOUS6.1 The Bidding Process shall be governed by, and construed in accordancewith, the laws <strong>of</strong> India and the Courts at Bhopal shall have exclusivejurisdiction over all disputes arising under, pursuant to and/ or in connectionwith the Bidding Process.6.2 The Authority, in its sole discretion and without incur<strong>ring</strong> anyobligation or liability, reserves the right, at any time, to;(a)(b)(c)(d)suspend and/ or cancel the Bidding Process and/ or amendand/ or supplement the Bidding Process or modify the dates orother terms and conditions relating thereto;consult with any Applicant in order to receive clarification orfurther in<strong>for</strong>mation;pre-qualify or not to pre-qualify any Applicant and/ or to consultwith a n y Applicant in order to receive clarification or furtherin<strong>for</strong>mation;retain any in<strong>for</strong>mation and/ or evidence submitted to the Authorityby, on behalf <strong>of</strong>, and/ or in relation to any Applicant; and/ or(e) independently verify, disqualify, reject and/ or accept anyand all submissions or other in<strong>for</strong>mation and/ or evidence submittedby or on behalf <strong>of</strong> any Applicant.6.3 It shall be deemed that by submitting the Application, the Applicantagrees and releases the Authority, its employees, agents andadvisers, irrevocably, unconditionally, fully and finally from any and allliability <strong>for</strong> claims, losses, damages, costs, expenses or liabilities in anyway related to or arising from the exercise <strong>of</strong> any rights and/ orper<strong>for</strong>mance <strong>of</strong> any obligations hereunder and the Bidding Documents,pursuant hereto, and/ or in connection with the Bidding Process, to thefullest extent permitted by applicable law, and waives any and all rightsand/ or claims it may have in this respect, whether actual or contingent,whether present or in future.NIT No. MPRDC/BOT (T+A)/PQ/2012/ 7783 Bhopal, dated 27.09.2012 - 42 -
