RFQ <strong>document</strong> <strong>for</strong> <strong>development</strong> <strong>of</strong> Four Laning <strong>of</strong> Rewa Ring Road on BOT (Toll + Annuity) basis(b)a legal, financial or technical adviser <strong>of</strong> the Authority in relation toany matter concerning the Project;“fraudulent practice” means a misrepresentation or omission <strong>of</strong>facts or suppression <strong>of</strong> facts or disclosure <strong>of</strong> incomplete facts, in order toinfluence the Bidding Process ;(c) “coercive practice” means impai<strong>ring</strong> or harming or threatening toimpair or harm, directly or indirectly, any person or property toinfluence any person’s participation or action in the Bidding Process;(d) “undesirable practice” means (i) establishing contact with anypersonconnected with or employed or engaged by the Authority withthe objective <strong>of</strong> canvassing, lobbying or in any mannerinfluencing or attempting to influence the Bidding Process; or(ii) having a Conflict <strong>of</strong> Interest; and(e)“restrictive practice” means <strong>for</strong>ming a cartel or arriving atany understanding or arrangement among Applicants with theobjective <strong>of</strong> restricting or manipulating a full and faircompetition in the Bidding Process.NIT No. MPRDC/BOT (T+A)/PQ/2012/ 7783 Bhopal, dated 27.09.2012 - 40 -

PRE-APPLICATION CONFERENCE5.1 A Pre-Application conference <strong>of</strong> the interested parties shall be convenedat the designated date, time and place. Only those persons who havepurchased the RFQ <strong>document</strong> shall be allowed to participate in thePre-Application conference. A maximum <strong>of</strong> three representatives <strong>of</strong> eachApplicant shall be allowed to participate on production <strong>of</strong> authority letterfrom the Applicant.5.2 Du<strong>ring</strong> the course <strong>of</strong> Pre-Application conference, the Applicants will befree to seek clarifications and make suggestions <strong>for</strong> consideration <strong>of</strong> theAuthority.
