RFQ <strong>document</strong> <strong>for</strong> <strong>development</strong> <strong>of</strong> Four Laning <strong>of</strong> Rewa Ring Road on BOT (Toll + Annuity)basisitself or as member <strong>of</strong> a Consortium) which has been barred by theCentral Government, or any entity controlled by it, fromparticipating in any project (BOT or otherwise), and the barsubsists as on the date <strong>of</strong> Application, or has been declared bythe Authority as non per<strong>for</strong>mer/blacklisted would not be eligibleto submit an Application, either individually or as member <strong>of</strong> aConsortium.2.20 Clarifications2.20.1 To facilitate evaluation <strong>of</strong> Applications, the Authority may, at itssole discretion, seek clarifications from any Applicantregarding its Application. Such clarification(s) shall be providedwithin the time specified by the Authority <strong>for</strong> this purpose. Anyrequest <strong>for</strong> clarification(s) and all clarification(s) in responsethereto shall be in writing.2.20.2 If an Applicant does not provide clarifications sought underClause 2.20.1 above within the prescribed time, its Applicationshall be liable to be rejected. In case the Application is notrejected, the Authority may proceed to evaluate theApplication by construing the particulars requi<strong>ring</strong> clarification tothe best <strong>of</strong> its understanding, and the Applicant shall be barredfrom subsequently questioning such interpretation <strong>of</strong> theAuthority.E. QUALIFICATION AND BIDDING2.21 Pre-qualification and notificationAfter the evaluation <strong>of</strong> Applications, the Authority wouldannounce a list <strong>of</strong> pre- qualified Applicants (Bidders) who willbe eligible <strong>for</strong> participation in the Bid Stage. At the same time,the Authority would notify the other Applicants that they have notbeen pre-qualified. RFQ <strong>document</strong> <strong>for</strong> <strong>development</strong> <strong>of</strong> Four Laning <strong>of</strong> Rewa Ring Road on BOT (Toll + Annuity)basisOnly pre-qualified Applicants shall be invited by the Authorityto submit their Bids <strong>for</strong> the Project. The Authority is likely toprovide a comparatively short time span <strong>for</strong> submission <strong>of</strong> theBids <strong>for</strong> the Project. The Applicants are there<strong>for</strong>e advised tovisit the site and familiarise themselves with the Project by thetime <strong>of</strong> submission <strong>of</strong> the Application. No extension <strong>of</strong> time islikely to be considered <strong>for</strong> submission <strong>of</strong> Bids pursuant toinvitation that may be issued by the Authority.2.23 Proprietary dataAll <strong>document</strong>s and other in<strong>for</strong>mation supplied by the Authorityor submitted by an Applicant to the Authority shall remain orbecome the property <strong>of</strong> the Authority. Applicants are to treat allin<strong>for</strong>mation as strictly confidential and shall not use it <strong>for</strong> anypurpose other than <strong>for</strong> preparation and submission <strong>of</strong> theirApplication. The Authority will not return any Application orany in<strong>for</strong>mation provided along therewith.2.24 Correspondence with the ApplicantSave and except as provided in this RFQ, the Authority shall notentertain any correspondence with any Applicant in relation to theacceptance or rejection <strong>of</strong> any Application.2.25 Undertaking regarding EPC ContractorApplicant/Consortium would provide an undertaking to theAuthority that the EPC works <strong>of</strong> the project would be executedonly by such EPC contractors who have completed at least asingle package <strong>of</strong> more than 20% <strong>of</strong> the Estimated Project Costor Rs. 500.00 crores whichever is less.________________________________________________________________________________________________________________________________NIT No. MPRDC/BOT (T+A)/PQ/2012/ 7783 Bhopal, dated 27.09.2012 - 33 -
