ASSAM UNIVERSITY, SILCHARTERMS AND CONDITIONS FOR SUPPLYING, INSTALLATION &COMMISSIONING OF VIDEO CONFERENCING EQUIPMENTSRef : AUS/CC/2012/21 Dated: 21/08/20121. Only manufactures / Distributors/ Authorized dealers (Herein after called party) ofreputed brands having wide experience in dealing with Tools and Machines only maysubmit the tenders.2. The manufacturer having ISO 9002 certificate or similar certification would bepreferred.3. The party must submit the latest Income tax, PAN Card & Sales tax clearancecertificates with the tender.4. The party must have experience in supply, installation & commissioning ofNetworking Devices in Govt. organization / public sector etc with last three years.Certificates in this regard from the responsible officer of that organization with contactno. e-mail address etc. is to be submitted.5. The tender should be submitted in a sealed envelope superscribed as “TENDER FORSUPPLY OF VIDEO CONFERENCING EQUIPMENTS” addressed to theRegistrar, <strong>Assam</strong> <strong>University</strong>, <strong>Silchar</strong>.6. The tender should be accompanied with a Demand Draft of Rs.50000/-(FiftyThousand) from any nationalized bank pledged in favour of the Finance Officer,<strong>Assam</strong> <strong>University</strong>, <strong>Silchar</strong> as earnest money.7. The party should quote one rate per item, which should be inclusive of all taxes exceptVAT and any other charges etc. The rate so quoted should be F.O.R <strong>Assam</strong> <strong>University</strong>,Durgakona, <strong>Silchar</strong>. The standard warranty period should be 3 years from the date ofinstallation.8. The rate quoted should be for the items & specification as mentioned in the list. Theparty should not quote for specification. If the party wishes to quote for a higher/superior specification, it must be separately stated along with proof that thespecification is higher/superior. In no case they should quote for lower/inferiorspecification. In that case the tender will not be considered.9. Being an educational Institute, <strong>Assam</strong> <strong>University</strong>, <strong>Silchar</strong> is entitled for custom &central excise duty exemption for procurement of scientific equipment etc. Theinterested party while quoting rates should indicate the excise duty component and taxcomponent separately.10. The bidders shall have to submit their tenders within 01.00 PM of 11/09/2012 at EstateSection of Administrative building , <strong>Assam</strong> <strong>University</strong>, <strong>Silchar</strong>. No tender shall beentertained after the scheduled time and date of submission of tenders. The same willbe opened on 11/09/2012 at 2 pm.11. A committee of experts constituted by the <strong>University</strong> authority will check the technicaland financial implications of each tender to prepare the panel of successful <strong>Tender</strong>s.Page 4 of 10


12. The selected bidder after receipt of supply order has to deposit 10% of supply ordervalue in the form of FDR from any nationalized bank in favour of Finance Officer.<strong>Assam</strong> <strong>University</strong> payable at <strong>Silchar</strong> as Security deposit. The security deposit will bereleased only after completion of warranty period.13. The successful bidder shall have to supply the materials strictly as per theconfiguration as stated in the supply order and should conform to the made /brandquoted and shall have to complete the supply within 3 Weeks from the date of issue ofPurchase order. Otherwise, the order shall automatically stand cancelled and thesecurity deposit of the bidder shall be forfeited. No communication in this regard willbe entertained. In such eventuality the <strong>University</strong> will have the right to place order tothe next bidder from the panel.14. Earnest money of the bidders will be released after finalization of the deal.15. No request for advance payment shall be entertained in any circumstances. Aftercompletion of the supply, the firm will submit bills in triplicate for payment, with acertificate of successful installation of the materials from the Warden of concernedHostels. Where applicable, AGST will be deducted at source before release of paymentto supplier.16. The successful bidder shall have to provide on site warranty support for at least 3 yearsfrom the date of successful installation. If any breakdown ,non –functioning ormalfunctioning of the machine occurs during the warranty period, the supplier shallhave to attend to the complain within 24 hours (or in next working day in case ofholidays ) after receiving verbal /written /e-mail complain and will make the machinesfunctional free of cost .In case the system has to be taken out of the <strong>University</strong> campus,the bidder should provide a stand by support system /peripheral with same or higher/new configuration / specification.17. If the vendor/supplier /bidder fails to attend to the breakdown calls made within thewarranty period, a portion or whole of the security Deposits as decided by the<strong>University</strong> shall be forfeited.18. The vendor should give a written undertaking separately that spares for repairing thesupplied tools and machines will be available with them for at least 3 years from thedate of installation. And they will supply them as per company’s price list ( A list ofspares and their price is to be submitted after Installation of the systems) after theexpiry of warranty period even if the <strong>University</strong> does not sign any maintenancecontract with the vendor after expiry of warranty period.19. Discretionary power : The competent authority, <strong>Assam</strong> <strong>University</strong> <strong>Silchar</strong>, reserves theright to accept or reject any or all tenders without assigning any reason there of and also tomodify in exceptional case any of the stipulated terms and conditions on merit on genuineand justifying grounds if it is in the larger interest of the <strong>University</strong>. The final acceptanceof the tenders rests entirely with the competent authority of <strong>Assam</strong> <strong>University</strong> <strong>Silchar</strong>whose decision shall be final and binding.Page 5 of 10


22. A) Rate: Various charges and taxes must be clearly mentioned separately.B) SALE TAX/VAT: Rate inclusive of sales Tax/VAT will be preferred however, wherequoted separately, the rates payable should be clearly cited in accordance with provision ofrelevant Act and rules.C) Form ‘C’ & ‘D’: <strong>Assam</strong> <strong>University</strong> <strong>Silchar</strong> is not authorized to issue ‘C’ & ‘D’ Formagainst CST.23. A) Consignee: All stores are required to be consigned to the Registrar, <strong>Assam</strong> <strong>University</strong>,<strong>Silchar</strong>-788011 (<strong>Assam</strong>).B) Mode of despatch: The consignment is required to be dispatched by Road Transport ordelivered at this <strong>University</strong> under supplier’s own arrangement free of additional charges.All offers of delivery should be made ex-stock and clear note should be inserted in case ofdamage or loss in transit, if any will be borne by the supplier.C) Despatch of Document: The consignment note along with the quadruplicate of copy ofrelevant bill and two copies of priced challan should dispatch to the Director,ComputerCentre, <strong>Assam</strong> <strong>University</strong>, <strong>Silchar</strong>-788011 (<strong>Assam</strong>) immediately on completion ofdispatch of consignment. If these documents do not reach the said office in time all wharfage/damage incurred, if any will be recoverable from the suppliers.24. Delivery: The equipments/tools are required to be delivered/dispatched within 3 Weeksfrom the date of receipt of the supply order. Suppliers are requested to take care that all theitems mentioned above are to be supplied in full set basis and the items are required to beinstalled in various locations of the <strong>University</strong> as desired by the authority. The place ofinstallation shall be intimated to the selected bidder along with the order.25. Quality Specification: The stores offered should be of the best/standard quality availableunless, otherwise specified conforming strictly to the specification cited. The <strong>University</strong>reserves the right to reject such stores as are found unacceptable on these grounds. Itemsof only reputed manufacturers will be given preference.26. Liquidated damages: If a firm accepts the order and fails to execute the order in full orpart as per terms and conditions stipulated therein, it will be open to the CompetentAuthority to recover liquidated damaged from the firm at the rate of 1% per month or thepart thereof, subject to a maximum of 5% of the value of the undelivered stores. It will alsobe open to the Competent Authority, alternatively to arrange procurement of the requiredstores from any source, at the risk and expense of the firm that has accepted the order andfailed to execute the order according in stipulations agreed upon. This will also entailremoval of the defaulters name from the approved/registered list of suppliers.27. Quantities: The approximate quantities of item proposed to be purchased as mentioned inthe list are liable to be increased or decreased at the time of placement of purchase order.28. Special discount/rebate: Special discount/rebate admissible to Educational Central<strong>University</strong> may be specifically indicated in the quotation.29. Rejection of offer: <strong>Tender</strong>s not conforming to the terms and conditions and procedure sooutlined are liable to be rejected summarily.30. Guarantee/Warranty: The tools and machines should be covered by warranty ofquality/warranty of performance and manufactures defect for a minimum period of Threeyears from the date of satisfactory installation as the case may be.31. Special condition: Special condition, if any, printed on the quotation sheets of the tendersor condition attached with the tender will not be applicable to the contract unless these arePage 6 of 10


expressly accepted in writing by the OEM. Due weight age will be given to bidder offeringwarranty for a longer period.32. ISI Marks : The tenders shall specify whether the articles offered bear bureau of Indianstandard certification mark or not. In such cases they shall produce copies of certificationmark along with their tender in support of it. Also specific make and model No. of theequipment is to be mentioned.33. Discretionary power : The competent authority, <strong>Assam</strong> <strong>University</strong> <strong>Silchar</strong>, reserves theright to accept or reject any or all tenders without assigning any reason there of and also tomodify in exceptional case any of the stipulated terms and conditions on merit on genuineand justifying grounds if it is in the larger interest of the Institute. The final acceptance of thetenders rests entirely with the competent authority, <strong>Assam</strong> <strong>University</strong> <strong>Silchar</strong>.34. The following updated documents should also accompany with the tenders:• Trade Licence• Income Tax clearance certificate• PAN Card• Sale Tax clearance certificate• CST/VAT clearance certificate if quoted in the tender for CST/VAT35. If there be any dispute, it will be referred to an arbitrator to be appointed by the<strong>University</strong> for his/her decision and award. The award or decision of the arbitrator shall befinal and binding on both the parties.36. Civil Court shall have no jurisdiction to entertain any dispute regarding this tender.Those tenderers, who accept the above terms and conditions, may submit their tenders in theprescribed format along with all relevant documents / brochures in the <strong>Tender</strong> Box in theEstate Section of the Administrative Building of <strong>Assam</strong> <strong>University</strong>, <strong>Silchar</strong> on or before thestipulated date.
