REGENTS’ POLICY MANUALSECTION 2—ACADEMICS(a)(b)it can be established that specified procedural irregularities were so substantial as toeffectively deny the student a fair hearing; ornew and significant evidence becomes available which could not have been discoveredby a reasonably diligent student before or during the original hearing.8.2 APPEAL PROCEDURESAppeals based on procedural irregularities or new evidence shall be made in writing to the SeniorVice President and Provost. Consideration <strong>of</strong> such appeals may be made by the Senior VicePresident and Provost upon the basis <strong>of</strong> written statements and such other evidence as the SeniorVice President and Provost may require. Harmless deviations from prescribed procedures maynot be used to invalidate the decision or proceeding.Technical departures from these procedures and errors in their applications shall not be groundsto withhold disciplinary action unless, in the opinion <strong>of</strong> the Senior Vice President and Provost,the technical departure or errors were such as to have prevented a fair determination <strong>of</strong> the issues.8.3 REHEARING AND PETITION FOR REVIEWIn all cases, the President and the Board <strong>of</strong> Regents <strong>of</strong> the University reserve the right to review,at their discretion, any decision <strong>of</strong> a hearing body for manifest error or inequity.9 ACADEMIC MISCONDUCT IN OFF-CAMPUS COURSESThe principles <strong>of</strong> academic integrity, due process, and confidentiality apply fully in all courses<strong>of</strong>fered by any Norman Campus academic unit. When an allegation <strong>of</strong> academic misconductarises in a course in which instruction is primarily given or received in a place other than theNorman Campus, procedures shall be employed which protect the rights <strong>of</strong> all parties as providedby law, the Faculty Handbook, and the Student Bill <strong>of</strong> Rights. The definition <strong>of</strong> academicmisconduct in such classes and the procedure for filing a charge shall be the same as those for theNorman Campus. Procedures for notification, hearing, appeal, and sanction shall be determinedand published by the Senior Vice President and Provost. Such procedures shall provide a chargedstudent with a reasonable opportunity to employ the Norman Campus procedures on the NormanCampus, provided that all travel and related costs shall be borne by the student.(RM, 11-8-79, p. 15763; 6-18-81, p. 16490; 6-9-98, p. 25912; 6-24-2003, p. 28616)(The text below should appear in both the HSC Campus Faculty Handbook and the StudentHandbook <strong>of</strong> the HSC.)NOTIFICATION OF CHARGENotification <strong>of</strong> DeanNotification <strong>of</strong> the dean shall be in writing with a brief description <strong>of</strong> the evidence and shall be madewithin ten University business days after discovery <strong>of</strong> the incident, exclusive <strong>of</strong> University breaks oracademic intersessions.If the incident is discovered in a particular course, the faculty member must fail the student on theexamination or paper and notify his or her dean <strong>of</strong> the incident as well as the student’s dean if different.For other incidents including discovery <strong>of</strong> the misconduct by other personnel (e.g., academic records) orreported to those personnel by a student or other person or if no particular class is involved (e.g.,submission <strong>of</strong> falsified records), the student’s dean shall be notified.THE UNIVERSITY OF OKLAHOMA 101
