REGENTS’ POLICY MANUALSECTION 2—ACADEMICS2.3 ACTION BY INSTRUCTOR: ADMONITION2.3.1 An instructor may conclude that an incident that meets the definition <strong>of</strong> misconduct under sec.1.2.1 nevertheless merits an admonition rather than a disciplinary penalty as defined in Section 7<strong>of</strong> this Code. In particular, an instructor might conclude (but is not required to conclude) that theincident is more appropriately treated as an instructional rather than a disciplinary matter. Whenthe instructor concludes that an admonition is the more appropriate action, the instructor mayelect to reduce a student’s grade and/or require additional, remedial academic work without firstfiling a charge <strong>of</strong> academic misconduct, subject to the following limitations and conditions:(A) The admonition option is intended for assignments and examinations that do not involve asemester-long activity and the incident in question is not <strong>of</strong> an egregious nature. The instructormay not use the admonition option for an incident <strong>of</strong> misconduct on a final examination, a termpaper or project, an examination that determines the status <strong>of</strong> graduate students (e.g. qualifying,candidacy, general, comprehensive and certification examinations and defenses <strong>of</strong> theses anddissertations), a master’s thesis, or a doctoral dissertation;(B) An instructor who elects to use the admonition option may impose no grade reduction greaterthan loss <strong>of</strong> all credit for the assignment; and,(C) An instructor who elects to use the admonition option must do the following before imposingthe grade reduction or other requirement: (1) inform the student <strong>of</strong> the nature <strong>of</strong> and basis for themisconduct; (2) give the student an opportunity to explain; (3) admonish the student and explainthe grade reduction or other requirement to be imposed; (4) where appropriate, instruct thestudent to resolve any confusion the student may have had regarding what constitutes properacademic conduct; and (5) inform the student how to appeal the decision. Notice <strong>of</strong> proceduresfor appeal shall be provided in writing; such notice shall be presumed adequate if provided in thecourse syllabus with a reference to the information published by the Provost on the consequences<strong>of</strong> accepting the admonition and the procedures for appeal.2.3.2 Unless the Provost imposes a disciplinary penalty as described below, a student who accepts anadmonition and resulting grade reduction under this subsection shall not be deemed to haveadmitted guilt for an act <strong>of</strong> academic misconduct; provided, the record <strong>of</strong> the admonition may beused in any subsequent academic misconduct proceeding, as appropriate, to establish thestudent’s prior familiarity with the fundamental rules <strong>of</strong> academic integrity.2.3.3 The instructor shall notify the Campus Judicial Coordinator <strong>of</strong> the incident, ordinarily within 15regular class days <strong>of</strong> discovery. The Campus Judicial Coordinator shall forward notice <strong>of</strong> theincident to the budget dean, the student’s dean, and the Provost, ordinarily within 15 class days <strong>of</strong>receipt <strong>of</strong> notice from the instructor.2.3.4 In cases <strong>of</strong> repeated <strong>of</strong>fenses or otherwise as appropriate, the Provost may announce adisciplinary penalty as provided in section 7. Prior to imposing such a sanction the Provost shallsend notice to the student via the Campus Judicial Coordinator, ordinarily within 15 class days <strong>of</strong>receipt <strong>of</strong> notice from the budget dean but in no case more than 45 regular class days afterdiscovery <strong>of</strong> the incident. Notice <strong>of</strong> the Provost’s intent to impose a sanction shall be treated as a“complaint” for purposes <strong>of</strong> notice and hearing as provided in Sections 3 and 4 <strong>of</strong> this Code, andthe disciplinary penalty shall not be imposed until the student is permitted the opportunity torespond as provided in sections 4 and 5 <strong>of</strong> this Code.2.3.5 The student may contest the admonition by contacting the Campus Judicial Coordinator withinfifteen (15) regular class days from the date <strong>of</strong> the instructor’s notice to the student andscheduling a meeting as provided below in Section 3.
