REGENTS’ POLICY MANUALSECTION 2—ACADEMICSCharge: The Committee may hear an appeal by a fellow who, (1) thinks he or she has beenunfairly evaluated by a program or that his or her rights as a fellow have been infringed, and(2) has been unable to resolve the matter in conference with the program director and theAssistant/Associate Dean. While the responsibility for evaluations rests with the program, theprimary responsibility <strong>of</strong> the Committee is to mediate or adjudicate disputes which have notbeen satisfactorily resolved at the program level in order to protect both fellows and facultyfrom arbitrary and capricious decisions.7) The Post-Doctoral Fellows Appeals Committee shall hear the grievance. The fellow may bringany person(s) whom he or she thinks will be able to contribute to his or her presentation to theCommittee. The Post-Doctoral Fellow Appeals Committee hearing will be recorded. Thefellow may be advised at his or her own expense by legal counsel, if desired. The fellow mustnotify the Committee Chairman at least seven days before the hearing if legal counsel will bepresent. If the fellow is accompanied by legal counsel at the hearing or at any steps where theresident and a University <strong>of</strong>ficial meet, University Legal Counsel shall also be present. Neithercounsel for the fellow nor for the University may directly address the Committee in anyhearing except in answer to a specific question by a committee member. The Committee shalldetermine the procedure and conduct <strong>of</strong> the hearing incorporating the basic principles <strong>of</strong> dueprocess.8) If after the Committee hearing the parties fail to achieve a mutually satisfactory settlement, theCommittee will render a written report containing findings <strong>of</strong> fact and recommendationsregarding the dispute in question to the Dean for his consideration.9) The Dean <strong>of</strong> the College shall review the hearing proceedings and the report <strong>of</strong> the appealscommittee and render a final decision regarding the grievance and take appropriate action.Any fellow about whom the Committee makes an adverse recommendation to the Dean willhave the opportunity to talk with the Dean before the Dean makes a final decision.10) There is no appeal beyond the Dean.(RM, 12-4-92, p. <strong>23</strong>178; 12-3-02, p. 28355)THE UNIVERSITY OF OKLAHOMA 76
