REGENTS’ POLICY MANUALSECTION 2—ACADEMICSalternates selected for the Hearing Committee within 5 working days <strong>of</strong> the date suchchallenges for cause are resolved.All decisions regarding initial disqualifications shall be made prior to the first meeting <strong>of</strong> theCommittee. Within 20 working days after the Hearing Committee and the alternates have beenfinalized the Hearing Committee shall elect its own chair and set the date <strong>of</strong> the hearing. Everyreasonable effort should be made by the Hearing Committee and both parties to hold thehearing as soon as possible.5) Members <strong>of</strong> the Hearing Committee who are disqualified, ill, or otherwise unable to serve, shallbe replaced from among alternate members by the Chair <strong>of</strong> the Faculty Appeals Board.Alternates who are disqualified, ill or otherwise unable to serve, or who become members <strong>of</strong>the Hearing Committee will be replaced from among the reserve pool (3.15.2(c)(2)) by theChair <strong>of</strong> the Faculty Appeals Board.6) A finalized list <strong>of</strong> Hearing Committee members and alternates will be given to all parties within10 working days <strong>of</strong> resolving any challenges <strong>of</strong> the membership <strong>of</strong> the hearing committee oralternates by the complainant or the respondent. If no challenges are <strong>of</strong>fered the finalized listmust be completed within 20 working days <strong>of</strong> the initial selection <strong>of</strong> the Hearing Committeeand alternates by the Chair <strong>of</strong> the Faculty Appeals Board.7) If a member <strong>of</strong> a Hearing Committee ceases to be a tenured, full-time member <strong>of</strong> the faculty, heor she shall be replaced from among the alternates.8) If the duties <strong>of</strong> a Hearing Committee member become primarily administrative, the membershall inform the Chair <strong>of</strong> the Faculty Appeals Board. The Chair <strong>of</strong> the Faculty Appeals Boardwill inform all parties. The member will continue to serve unless either party objects in writingto the Chair <strong>of</strong> the Faculty Appeals Board within five working days <strong>of</strong> receipt <strong>of</strong> notice.9) The pool <strong>of</strong> three alternate members shall be maintained according to selection procedures inSection 3.15.2(c)(2). Alternate members shall attend all meetings <strong>of</strong> the Hearing Committee.Handling <strong>of</strong> Charges(a) Within 20 working days after the respondent has submitted the written response outlined in section3.15.2(b), the Chair <strong>of</strong> the Faculty Appeals Board shall meet for a second pre-hearing conferencewith the parties involved, as appropriate, and attempt to solicit an agreement which can be put intowriting in an effort to resolve the matter at this point.(b) If the issues cannot be resolved at this point, the complainant and respondent, with the Chair <strong>of</strong> theFaculty Appeals Board shall attempt to agree in writing upon the hearing procedures and othermatters concerning the handling <strong>of</strong> the case including which issues are to be heard. In the absence <strong>of</strong>an agreement on procedures, the Chair <strong>of</strong> the Faculty Appeals Board shall determine the hearingprocedures. In either case, the procedures should be finalized within 30 working days.(c) The parties may agree to waive a hearing and submit the case to the Hearing Committee on agreedstipulation. The Hearing Committee will then make its findings and recommendations upon evidencecontained in or referred to in the stipulation within 30 working days.THE UNIVERSITY OF OKLAHOMA 67
