11.0 TIME AND EXTENSION FOR DELAYIf in the opinion of the Engineer-in-Charge the works is delayed by:a) Force majeure.b) Reasons of civil commotion, location combination of workers on strike or lock-out affectingany of the building trades.c) In consequence of the contractor <strong>for</strong> not having received in due time necessary instructionsfrom the Engineer-in-charge <strong>for</strong> which he shall have specifically applied in writing.d) Reasons of Engineer-in-charge instruction the Engineer-in-charge shall make a fair <strong>and</strong>reasonable extension of time <strong>for</strong> completion of the contract works. Then upon thehappenings of any such event causing delay, the Contractor shall immediately give noticethereof in writing to the Engineer-in-charge but shall nevertheless use constantly his bestendeavor’s to prevent or make good the delay <strong>and</strong> shall do all that may be reasonablyrequired to the satisfaction of the Engineer-in-charge to proceed with the works.11.1 Request <strong>for</strong> rescheduling of date of completion <strong>and</strong> extension of time, to be eligible <strong>for</strong>consideration, shall be made by the Contractor in writing immediately after the happenings of theevent causing delay. The Contractor may also, if practicable, indicate in such a request the period <strong>for</strong>which extension is desired.11.2 In such case, the Engineer-in-charge may give a fare <strong>and</strong> reasonable extension of time <strong>and</strong>reschedule the completion date. Such extension shall be communicated to the Contractor by theEngineer-in-charge in writing within 1 month of the date of receipt of such a request. Nonapplicationby the Contractor <strong>for</strong> extension of time shall not be a bar <strong>for</strong> giving a fare <strong>and</strong> reasonableextension by Engineer-in-charge <strong>and</strong> this shall be binding on the Contractor.12.0 COMPENSATION FOR DELAYTime allowed <strong>for</strong> the work shall be strictly followed otherwise the Contractor shall be liable tocompensation at the rate of 0.2 % of the ordered value of the work per day of delay on the part of thecontractor subject to a maximum of 5 % of the total ordered value. The decision of Engineer-inchargeabout the delay shall final <strong>and</strong> binding.13.0 TERMINATIONNot withst<strong>and</strong>ing anything elsewhere provided herein <strong>and</strong> in addition to any other right or remedy of<strong>THSTI</strong> under the contract or otherwise including right of <strong>THSTI</strong> <strong>for</strong> compensation <strong>for</strong> delay, theEngineer-in-charge may, without prejudice to his right against Contractor in respect of any delay,bad workmanship or otherwise or to any claims <strong>for</strong> damage in respect of any breaches of the contract<strong>and</strong> without prejudice to any rights or remedies under any of the provisions of this contract orotherwise <strong>and</strong> whether the date <strong>for</strong> completion has or has not elapsed by intimation in writing,absolutely determine the Contract.A) Default or failure by the contractor in any of the under mentioned cases, including but not limited tothe following shall be the basis of taking action under this clause of the contract.1) Failure to provide at the job site, sufficient labor, material, equipment, machinery, <strong>and</strong> / orfacilities, required <strong>for</strong> the proper <strong>and</strong> / or due execution of the work or any part thereof:2) Failure to execute the works or any of them in accordance with the contract.8


3) Disobedience of any order or instruction of the Site Engineer <strong>and</strong> / or Engineer-in-charge.4) Negligence in carrying out the work or carrying out of work found to be unsatisfactory by theEngineer-in-charge.5) Ab<strong>and</strong>onment of the works or any part thereof.6) Failure to execute the Contract in terms of the <strong>for</strong>m of Contact <strong>for</strong>ming part of the <strong>Tender</strong>Documents within Ten days of notice in this behalf from <strong>THSTI</strong>.7) If the Contractor is incapable of carrying out the work.8) If the Contractor misconduct in any manner.9) If there is any change in the constitution of the Contractor (if a firm) or in the circumstances ororganization of the Contractor, which is detrimental to the interests of <strong>THSTI</strong>.10) Dissolution of the Contractor (If a firm or commencement of liquidation) or winding up(whether voluntary or compulsory) of the Contractor (if a company or appointment of a receiveror Manager of any of the Contractor’s assets <strong>and</strong> / or insolvency or the Contractor (if a soleproprietorship) or of any partner of the Contractor (if a firm).11) Delay in execution of work, which in opinion of Engineer-in-charge shall delay the completionof work beyond the stipulated date of completion.12) Distress, execution, or other legal process being levied on or upon any of the Contractors goods<strong>and</strong> /or assets .13) Death of Contractor (if an individual)14) If the Contractor of any person employed by him shall make or offer <strong>for</strong> any purpose connectedwith the contract any gift, gratuity, royalty, commission, gratification or other inducement(whether money or in any other <strong>for</strong>m) to any employee or agent to <strong>THSTI</strong>.15) If the Contractor shall assign or attempt to assign his interest or any part thereof in the Contract.The decision of the Director <strong>THSTI</strong> as to whether any of the events/ contingencies mentioned in a<strong>for</strong>esaidclauses entitling <strong>THSTI</strong> to terminate the contract has occurred shall be final <strong>and</strong> binding upon the Contractor<strong>and</strong> shall be non obligatory. The reason <strong>for</strong> the termination stated in the notice of termination shall be final<strong>and</strong> binding upon the Contractor <strong>and</strong> shall be non-arbitral. The jobs left however by the Contractor shall begot done at his risk <strong>and</strong> cost through the other agencies <strong>and</strong> the Contract shall be determined accordingly.14.0 PERFORMANCE BANK GUARANTEEThe Contractor is required to furnish per<strong>for</strong>mance guarantee <strong>for</strong> an amount equal to 5 % of theContract value in the <strong>for</strong>m of CDR/FDR/DD/bank guarantee (of nationalized/ Scheduled Bank in ast<strong>and</strong>ard <strong>for</strong>mat ) within two weeks from the date of issue of award letter. The validity period of theper<strong>for</strong>mance security in <strong>for</strong>m of per<strong>for</strong>mance guarantee shall be one year from the date of actualcompletion of work.15.0 PAYMENTa) All the payments towards running account bills shall be advance payments. Any advancepayments so allowed shall be adjusted in the subsequent Running Bill by taking detailedmeasurements thereof. Final payment shall be made only on the basis of detailedmeasurements.b) In addition to above, payment shall be released as mentioned in Appendix.9


16.0 SUBMISSION OF BILLA bill shall be submitted by the Contractor each month on or be<strong>for</strong>e the date fixed by the Engineerin-charge<strong>for</strong> all the works executed in the previous months, <strong>and</strong> the Engineer-in-charge shall take orcause to be taken the requisite measurement <strong>for</strong> the purpose of having the same verified <strong>and</strong> theclaim as far as admissible to be adjusted. If the contractor does not submit the bill within the timefixed a<strong>for</strong>esaid, the Engineer-in-charge may depute a subordinate to measure up the said work in thepresence of the contractor whose counter signature to the measurement list will be sufficient warrant<strong>and</strong> the Engineer-in-charge may prepare the bill. This shall be done at the cost of the contractor <strong>and</strong>the failure of the Contractor to participate <strong>and</strong> countersign the measurements shall <strong>for</strong>eclose his rightto challenge them at any stage thereafter.17.0 FIRMNESS OF RATES :All the rates quoted <strong>and</strong> agreed in the tender shall remain firm till the completion of work. The ratesare to be inclusive of all current taxes <strong>and</strong> levies payable under the respective statutes. However, incase of any variation in Tax or levy is imposed by statutes, after the last date of submission oftender, <strong>and</strong> the contractor thereupon.necessarily <strong>and</strong> properly pays such revised taxes levies, the Contractor shall be allowed to adjust theamount so paid provided incidence of such payment is not, in the opinion of <strong>THSTI</strong> (whose decisionshall be final <strong>and</strong> binding), attributable to delay in execution of the work by the Contractor. TheContractor shall keep necessary books of accounts <strong>and</strong> other documents <strong>for</strong> the purpose of operationof this condition <strong>and</strong> shall allow inspection of the same by a duly authorized representative of<strong>THSTI</strong> <strong>and</strong> further shall furnish such other in<strong>for</strong>mation/ documents the Engineer in charge mayrequired.18.0 DEVIATION / VARIATION EXTENT / EXTRA ITEMS / SUBSTITUTED ITEMS ANDPRICING18.1 GENERALThe Engineer-in-Charge shall have power (i) to make alteration in, omissions from, additions to, orsubstitutions <strong>for</strong> the original specifications, drawings, designs <strong>and</strong> instructions that may appear tohim to be necessary or advisable during the progress of the work, <strong>and</strong> (ii) to omit a part of the worksin case of non-availability of a portion of the site or <strong>for</strong> any other reasons <strong>and</strong> the contractor shall bebound to carry out the works in accordance with any instructions given to him in writing signed bythe Engineer-in-charge <strong>and</strong> such alterations, omissions, additions or substitutions shall <strong>for</strong>m part ofthe contract as if originally provided therein <strong>and</strong> any altered, additional or substituted work whichthe contractor may be directed to do in the manner specified above as part of the works, shall becarried out by the contractor on the same conditions in all respects including price on which heagreed to do the main work except as hereafter provided.18.2 EXTRA ITEMS / PRICINGIn the case of extra item(s) the contractor may within fifteen days of receipt of order or occurrence ofthe item(s) claim rates, supported by proper analysis, <strong>for</strong> the work <strong>and</strong> the engineer-in-charge shallwithin one month of the receipt of the claims supported by analysis, after giving consideration to theanalysis of the rates submitted by the contractor, determine the rates on the basis of the market rates<strong>and</strong> the contractor shall be paid in accordance with the rates so determined.10


18.3 SUBSTITUTED ITEMS / PRICINGIn case of substituted items, the rate <strong>for</strong> the agreement item (to be substituted) <strong>and</strong> substituted itemshall also be determined in the manner as mentioned in the a<strong>for</strong>esaid Para.a) If the market rate <strong>for</strong> the substituted item so determined is more than the market rate of theagreement item (to be substituted) the rate payable to the contractor <strong>for</strong> the substituted item shallbe the rate <strong>for</strong> the agreement item (to be substituted) so increased to the extent of the differencebetween the market rates of substituted item <strong>and</strong> the agreement item (to be substituted).b) If the market rate <strong>for</strong> the substituted item so determined is less than the market rate of theagreement item (to be substituted) the rate payable to the contractor <strong>for</strong> the substituted item shallbe the rate <strong>for</strong> the agreement item (to be substituted) so decreased to the extent of the differencebetween the market rates of substituted item <strong>and</strong> the agreement item (to be substituted).In the case of contract items, substituted items, contract cum substituted items, the limit of increaseshall be 25%of the stipulated quantities of the contract. If these quantities exceed the limits of 25% ofthe stipulated quantities in the contract, the contractor may within fifteen days of receipt of order oroccurrence of the excess, claim revision of the rates, supported by proper analysis <strong>for</strong> the work inexcess of the above mentioned limits, provided that if the rates so claimed are in excess of the ratesspecified in the schedule of quantities the Engineer-in-charge shall within one month of receipt of theclaims supported by analysis, after giving consideration to the analysis of the rates submitted by thecontractor, determine the rates on the basis of the market rates <strong>and</strong> the contractor shall be paid inaccordance with the rates so determined.18.4 The provisions of the preceding paragraph shall also apply to the decrease in the rates of items <strong>for</strong> thework in excess of the limits laid in above para, <strong>and</strong> the Engineer-in-charge shall after giving notice tothe contractor within one month of occurrence of the excess <strong>and</strong> after taking into consideration <strong>and</strong>reply received from him within fifteen days of the receipt of the notice, revise the rates <strong>for</strong> the work inquestion within one month of the expiry of the said period of fifteen days having regard to the marketrates.19.0 WORK OPEN TO INSPECTIONAll work under or in course of execution or being executed in pursuance of the contract shall at alltimes be open to inspection <strong>and</strong> supervision by the Engineer-in-charge <strong>and</strong> his authorizedsubordinates, <strong>and</strong> the Contractor shall at all times during the usual working hours, <strong>and</strong> at all othertimes at which reasonable notice of the intention of the Engineer-in-charge or his subordinate to visitthe works shall have been given to the contractor, either himself be present to receive order <strong>and</strong>instructions, or have a responsible agent duly accredited in writing, present <strong>for</strong> that purpose. Ordergiven to the contractor’s agent shall be considered to have the same <strong>for</strong>ce as if the same had beengiven to the Contractor himself.11


20.0 The Contractor shall abide by the Contract Labour, (Regulation <strong>and</strong> Abolition) Act 1970, <strong>and</strong>Contract Labour (Abolition <strong>and</strong> Regulation) Central rules 1971. The Contractor shall comply withthe provisions of Payment of Wages Act 1936. Minimum Wages Act 1948, Employees Liability Act1938, Workmen’s Compensation Act 1923. Industrial Disputes Act <strong>and</strong> other applicable regulations<strong>and</strong> other labour laws applicable to Contract Labour as mentioned below :1) Industrial Disputes Act.2) Industrial Establishment (St<strong>and</strong>ing orders) Act.3) Trade Unions Act.4) The Factors Act.5) Employees Provident Fund & Miscellaneous Provision Act.6) Employees State Insurance Act.7) Workmen’s Compensation Act.8) Payment of Gratuity Act.9) Minimum Wages Act.10) Payment of Wages Act.11) Equal Remuneration Act.12) Payment of Bonus Act.13) National / Weekly Holiday Act.14) Inter-state Migrant Workmen (Regulation of Employment <strong>and</strong> of service conditions) Act.In addition to above the Contractor shall also comply with all other pertinent statutes including thefollowing :1. The Contractor whose tender is accepted <strong>and</strong> who employs or employed 20 or more workers on anyday of the preceding 12 months in various contracts, that he may have in other departments /establishments of <strong>THSTI</strong> shall obtain a valid license under the Contract labour (R&A) Act 1970 <strong>and</strong>the Contract Labour (Regulation <strong>and</strong> Abolition) (Central) Rules 1971 be<strong>for</strong>e the commencement ofthe work <strong>and</strong> continue to have a valid license until the completion of the work.Any failure to fulfill this requirement shall attract the panel provisions of the Act, which includesimprisonment <strong>for</strong> a term which may extend to three months or with fine or both.2. No Labour below the age of 18 shall be employed on the work.3. The Contractor shall pay to the labour employed by him wages not less than the minimum wages inaccordance with the notification <strong>for</strong> minimum wages issued by Government of N.C.T of Delhi(Labour department) from time to time.4. The Contractor shall maintain proper registers <strong>and</strong> records viz., Muster Roll, Register of Wages,Register of Overtime, Register of fines, Register of Advance <strong>and</strong> wage slip as required under the Act(Section 29 <strong>and</strong> rule 78). The Contractor shall obtain the signature or thumb impression of theworkers concerned against entries relating to him on the register of wages or muster cum wagesregister <strong>and</strong> entries shall be authenticated by the initial of the Contractor or his supervisor.5. The Contractor shall provide PF <strong>and</strong> ESI facilities to the labour <strong>and</strong> record of the same shall beproperly maintained <strong>and</strong> signed by the Contractor.12


6. The Contractor shall issue an employment Card in the prescribed <strong>for</strong>m No. XIV to each workerwithin three days of the employment of the worker. This card shall be maintained up to date.7. The Contractor at his own expense shall arrange <strong>for</strong> the safety provisions as per safety code framedtime to time by CPWD <strong>and</strong> shall at his own expense provide <strong>for</strong> all facilities in connection therewith.Non-fulfillment of such facilities in connection therewith the Contractor shall be liable to paypenalty of Rs.50/-<strong>for</strong> each default / per day.8. The Contractor shall submit by the 4th <strong>and</strong> 19th of every month a true statement showing in respectof the second half of the preceding month <strong>and</strong> the 1st half of current month respectively.i) The number of labours employed by him.ii) Their working hours.iii) The wages paid to them.iv) Accident that may have occurred during the said <strong>for</strong>tnight showing the circumstancesunder which these happened <strong>and</strong> the extend of damage <strong>and</strong> injury caused by these,failing which the contractor shall be liable to pay to <strong>THSTI</strong> a sum not exceeding to Rs.50/-<strong>for</strong> each default. The decision of the Director <strong>THSTI</strong> shall be final in deducting from any bill dueto the Contractor the amount levied as fine.9. In case the Contractor employs less than twenty workers on any day of the preceding 12 months invarious contracts <strong>and</strong> during this contact he shall furnish a certificate to this effect along withmonthly bill.21.0 CONTRACTOR TO SUPPLY LABOUR AND MATERIALThe Contractor shall provide at his own cost all labour <strong>and</strong> general consumable material (exceptsuch special materials if any, as may in accordance with the contract be supplied from the Engineerin-charge’sstores) tools <strong>and</strong> plants, appliances, implements, ladders, tackle, scaffolding etc. requisite<strong>for</strong> the proper execution of the work <strong>and</strong> whether included in the specifications or other documents<strong>for</strong>ming part of the contract or referred to in the conditions or not, or which may be necessary <strong>for</strong> thepurpose of entirely satisfying the Engineer-in-charge. In the event of the Contractor failing toprovide the same, the Engineer-in-charge may provide the same at the expenses of the Contractor.22.0 SAFETY CODE, LABOUR CAMPS SANITARY ARRANGEMENTSThe Contractor shall follow the Safety Code <strong>and</strong> Model Rules <strong>for</strong> the Protection of health <strong>and</strong>Sanitary arrangement <strong>for</strong> Workers as prescribed by the CPWD as regard to safety code <strong>and</strong> first aidfacilities. In case, the Contractor fails to make the a<strong>for</strong>esaid arrangement, the Director <strong>THSTI</strong> shallbe entitled to do so at the risk, responsibility <strong>and</strong> cost of the Contractor.23.0 PAYMENT OF WAGES BY THE CONTRACTORThe Contractor shall directly pay to labour employed by him <strong>and</strong> shall be solely responsible <strong>for</strong>following all Government rules <strong>and</strong> regulations applicable <strong>for</strong> employment.24.0 REMOVAL OF PERSONThe Engineer-in-charge may require the Contractor to remove from the site of the work any personor persons in the Contractor’s employment who may found to be incompetent or due to misconduct<strong>and</strong> the Contractor shall <strong>for</strong>thwith comply with such requirement / instructions.13


25.0 WORKS TO BE CARRIED OUT UNDER DIRECTION OF ENGINEER-IN-CHARGEAll works shall be executed subject to the approval in all respect of the Engineer-in-charge who shallbe entitled to direct at what point or points <strong>and</strong> in what manner these are to be commenced, <strong>and</strong>carried out from time to time.26.0 ARBITRATIONAny claim, dispute or difference arising out of or in connection with this agreement <strong>and</strong> whichcannot be settled by mutual consultations, shall be referred to sole Arbitration or an Arbitrator to beappointed by mutual consultations. The award of the Arbitrator shall be final <strong>and</strong> binding betweenthe parties as per the terms <strong>and</strong> conditions of the Agreement to be executed on award of contract.The Arbitration proceeding shall be governed by the Arbitration <strong>and</strong> Conciliation Ordinance dated26th March, 1996 <strong>and</strong> shall be conducted in Delhi.27.0 LIEN IN RESPECT OF CLAIM IN OTHER CONTRACTSAny Sum of money due <strong>and</strong> payable to the Contractor (including the security deposit refundable tohim) under the contract may be withheld or retained by way of lien by the <strong>THSTI</strong> in respect ofpayment of a Sum of money arising out of or under any other contract made by the Contractor withthe <strong>THSTI</strong>.It is an agreed term of the contract that the Sum of money so withheld or retained under this clauseby the <strong>THSTI</strong> will be kept with held or retained as such by the <strong>THSTI</strong> or till his claim arising out ofthe same contract or any other contract is either mutually settled or determined by the arbitrationclause or by the competent court, as the case may be <strong>and</strong> that the Contractor shall have no claim <strong>for</strong>interest or damages whatsoever on this account or any other ground in respect of any sum of moneywithheld or retained under this clause <strong>and</strong> duly notified as such to the Contractor.ENGINEER (IEE)14


SPECIAL CONDITIONS OF CONTRACT1. PRICES<strong>Tender</strong>ers price shall be deemed to include all materials, tools <strong>and</strong> tackles etc. required <strong>for</strong> “ <strong>Supply</strong>,<strong>Installation</strong> ,<strong>Testing</strong> <strong>and</strong> <strong>commissioning</strong> of 250 KVA Servo stabilizer at <strong>THSTI</strong> 496, Udyog ViharPhase-III, Gurgaon Haryana” whether specifically mentioned or not. The contractor shall alsoinclude in his price all taxes, duties or other levies (viz., Excise duty, Custom duty, VAT, D. VAT,Service tax, Octroi etc.) which are legally leviable on the fabrication of wooden work. The prices arefirm & fixed during the currency of contract. However in case of any statuary variation inTaxes/Duties after the last date of submission of <strong>Tender</strong> the same shall be adjusted. The bidder maythere<strong>for</strong>e indicate the percentage cost of material <strong>and</strong> labor to be considered <strong>for</strong> the payment ofadjustment of statuary variation in Taxes/Duties as mentioned above2. DEVIATIONThe deviation in quantities shall be allowed to the extent of + 25% on the awarded rates.3. PERFORMANCE TESTINGThe work shall be carried out to the entire satisfaction of the Engineer-in-charge of <strong>THSTI</strong>. Anydefects or shortcomings found shall be immediately rectified or made good by the Contractor at hisown cost.4. ABNORMAL RATESThe Contractor is expected to quoted rate <strong>for</strong> each item after careful analysis of cost involved <strong>for</strong> theper<strong>for</strong>mance of the complete item considering all specifications <strong>and</strong> conditions of contract this willavoid loss of profit or gain in case of curtailment or change of specifications <strong>for</strong> any items. In case itis noticed that the rates quoted by the tenderer <strong>for</strong> any item are unusually low it will be sufficientcause <strong>for</strong> the rejection of the tender unless the owner is convinced about the reasonableness of therates on scrutiny of the analysis <strong>for</strong> such rate to be furnished by the tenderer on dem<strong>and</strong>.5. OTHER CONDITION TO ADHERE BY TENDERER5.1 The work is to be carried out as per the specifications in the tender <strong>and</strong> relevant st<strong>and</strong>ards of CPWD.5.2 The material should be got approved be<strong>for</strong>e start of work.5.3 The contractor shall clear the site after completion of work in all respect.5.4 All the material used shall be one of the stipulated makes as per approved list of material.5.5 The contractor shall comply with safety codes <strong>for</strong> Fire precaution, health requirement, scaffolds &ladders etc.5.6 No T & P shall be issued by <strong>THSTI</strong>.5.7 All dismantled material <strong>for</strong> which credit is not being given in the tender shall be h<strong>and</strong>ed over to thesite engineer stored at proper place.15


5.8 Contractor shall be fully responsible <strong>for</strong> safety of his workers <strong>and</strong> incase of any accident / mishapthe entire responsibility shall be on the contractor.5.9 The work shall be executed without any loss / damage to the <strong>THSTI</strong>’s properties.6. WATER & POWER FOR FABRICATION<strong>THSTI</strong> shall provide power & water at one point <strong>for</strong> the proper execution of the work free of costunder normal circumstances. In case <strong>THSTI</strong> is not in a position to supply the water <strong>and</strong> / or power,the Contractor will make his own arrangement so that the work does not suffer. However no claim ofthe Contractor whatsoever shall be entertained by <strong>THSTI</strong> on this account.7. REJECTION OF DEFECTIVE MATERIAL7.1 If on test any portion of execution of work are found to be defective or not fulfilling the intent or themeaning of the specifications, the same shall be replaced or repaired to the entire satisfaction ofEngineer-in-charge, <strong>THSTI</strong> <strong>and</strong> their owner / owner’s representatives.7.2 In case the contractor fails to remove the defects, within a period considered reasonable, <strong>THSTI</strong>reserves the right to take necessary remedial measures through other agencies <strong>and</strong> all expenses thusincurred would be recovered from the Contractor.8. CO-ORDINATIONWork shall be carried out in such a manner that the work of other agencies operating at the site is nothampered due to any action of the contractor. Proper co-ordination with other agencies will becontractor’s responsibility. In case of any dispute the decision of <strong>THSTI</strong> shall be final & binding onthe contractor.9. CERTIFICATION OF VIRTUAL COMPLETIONThe work shall not be considered as completed until the Engineer-in-charge has certified in writingthat the works have been virtually completed <strong>and</strong> the guarantee period shall commence <strong>for</strong>m the dateof such certificate.10. DATE OF COMMENCEMENT & COMPLETIONThe contractor shall be allowed admittance to the site on the date of commencement as stated inappendix <strong>and</strong> he shall there upon <strong>and</strong> <strong>for</strong>thwith begin the works <strong>and</strong> shall regularly proceed with <strong>and</strong>complete the same on or be<strong>for</strong>e the date of completion stated in appendix subject nevertheless to theprovisions <strong>for</strong> extension of time hereinafter contained.11. CLEARANCE OF SITEThe contractor shall have to remove all waste (melba) <strong>and</strong> other unwanted material from site of workbe<strong>for</strong>e h<strong>and</strong>ing over the installation to the <strong>THSTI</strong>. The work shall not be treated as complete in allrespects unless these requirements are fulfilled by him. In the event of contractor failing to do so, the<strong>THSTI</strong> shall have right to get the site cleared at his cost.12. TESTING OF INSTALLATIONAll work shall be tested as stipulated in the latest CPWD specification.16


13. DRAWINGSOn the award of work the contractor shall immediately proceed with the preparation of Drawingaccording to the work data to be carried out. Two sets of such working drawing including make ofall items shall be submitted to the owner/owner’s representative <strong>for</strong> his approval to ensure that workwill carried out to ensure that work will carried out in accordance with specification <strong>and</strong> drawingincluding such changes as may have mutually agreed upon. All the drawing shall be received by theowner/ owner’s representative <strong>for</strong> his approval within 10 days of award of work.Successful vendors after receipt of order must furnish detail bar chart showing the various activityw.r.t. time <strong>and</strong> he must organize co-ordination meeting at the site to review the progress of work.14. GUARANTEEThe contractor shall guarantee that all the material <strong>and</strong> components supplied <strong>and</strong> installed by himshall be free from defects due to faulty, material or workmanship, that the electrical installation shallper<strong>for</strong>m satisfactorily, specifically the successful per<strong>for</strong>mance of the system.The period of the guarantee shall be (12) twelve months from the date of h<strong>and</strong>ing over the completeinstallations to <strong>THSTI</strong> During this period any or all components found to be defective shall bereplaced or repaired free of charge <strong>and</strong> any shortcomings found in the system as specified shall beremoved at no extra cost. The contractor shall provide the necessary personnel <strong>and</strong> tools <strong>for</strong> fulfillingthe above guarantee.If the defects are not removed within a reasonable time the <strong>THSTI</strong> may arrange to do at thecontractor’s risk <strong>and</strong> cost, without prejudice to any other rights.15. INTERPRETATIONIn interpretation of specifications, the following orders of decreasing importance shall be followed:-a) Schedule of quantitiesb) Additional specificationsc) Schedule of fiscal aspectsd) Special Conditions of contractse) General condition of contractMatters not covered by the specification given in this contract as a whole shall be covered byrelevant <strong>and</strong> latest Indian St<strong>and</strong>ard codes/ C.P.W.D code. If such codes on a particular subject havenot been framed, the decision of the owner/ owner’s representative shall be final <strong>and</strong> binding.16. MEASUREMENTSMeasurements shall be in Running feet (RFT) system <strong>and</strong> running account bills as per schedule ofrates shall be prepared <strong>and</strong> submitted <strong>for</strong> the work done based on joint measurement.17. SAFETY MEASURESIt shall squarely be the responsibility of the Contractor (including sub-contractors) to comply withthe safety requirements. Determent panel <strong>and</strong> legal action shall be taken in the event of any failureon the part of the contractor to discharge the safety obligations which are laid down in the contract.17Engineer (IEE)


OTHER ADDITIONAL CONDITIONS1. The servo stabilizer should confirm to be relevant latest IS specification with technical specification etc.as required (enclosed Annexture-1).2. The price quoted should be inclusive of required first fill of oil as per manufacturer specification.3. <strong>THSTI</strong> reserves the right to reject the tender without assigning any reason thereof.4. Supplier/ Agency should submit their valid Pan No. & TIN No. as required.5. The model number, Make, <strong>and</strong> a printed literature of the product shall submit positively.6. Authorized certificate should enclosed in case of principal manufacturing company is not quotingdirectly.7. The successful contractor will have to provide pre-dispatch inspection <strong>for</strong> servo Stabilizer / Regulator tothe officers from <strong>THSTI</strong> at manufacture’s unit. All the test facilities etc. during the inspection shall beprovided by the bidder, without any extra charges to <strong>THSTI</strong>.8.
