Unauthorized participation in, agitation <strong>of</strong>, or instigation <strong>of</strong> any activity which interferes withingress or egress from <strong>University</strong> facilities, and/or which interrupts any activities <strong>of</strong> the<strong>University</strong> community in its normal functioning.11. The use, possession, sale or distribution <strong>of</strong> non-prescription controlled substances.12. Defacement by writing, drawing, or marking <strong>of</strong> any kind upon any permanent interior or exteriorwall or similar vertical surface, in any medium, including chalk, felt-marker, etc., or anypermanent medium, such as paint, upon any sidewalk, mall, patio, terrace, or street, except asauthorized.13. Disturbance <strong>of</strong> the public peace.14. Unauthorized possession, duplication or use <strong>of</strong> keys or access cards to any <strong>University</strong> premisesor services.15. Unauthorized entry into or use <strong>of</strong> <strong>University</strong> premises.16. Unauthorized entry into faculty or administrative <strong>of</strong>fices.17. Any action without authorization from the <strong>University</strong> which modifies, destroys, discloses, ortakes data, programs or supporting documents residing in or relating in any way to a <strong>University</strong>computer, computer system or computer network, or causes the denial <strong>of</strong> computer systemservice to an authorized user <strong>of</strong> such a system.18. Repetitive violation <strong>of</strong> the <strong>University</strong> Pr<strong>of</strong>essional Dress, Appearance Code, or attendancepolicy.DISCIPLINARY ACTIONA student, faculty member, or any other member <strong>of</strong> the community <strong>of</strong> interest may initiate complaintsagainst a student possibly warranting disciplinary action <strong>for</strong> pr<strong>of</strong>essional misconduct. Referrals <strong>for</strong>student misconduct are sent to the Pr<strong>of</strong>essional Misconduct Committee (PMC). The PMC is comprised <strong>of</strong>faculty appointed by the Program Directors to handle complaints where students may be dismissed ortheir academic progression affected.Pr<strong>of</strong>essional Misconduct Committee ProceduresThe <strong>University</strong> has established a Pr<strong>of</strong>essional Misconduct Committee (PMC) to hear each complaint.PMC membership shall be determined by the Program Directors. A student may be required to appearbe<strong>for</strong>e the PMC or in certain circumstances be allowed to speak to the Committee via telephoneconference.At least five (5) business days in advance <strong>of</strong> the hearing, a student shall be given written notice <strong>of</strong> theallegations against him/her and <strong>of</strong> the opportunity to respond. Hearings be<strong>for</strong>e the PMC shall bein<strong>for</strong>mal. The allegations and evidence against a student shall be presented by the Chair <strong>of</strong> the PMC.The <strong>St</strong>udent then will be given an opportunity to present his/her version <strong>of</strong> events, facts and evidence inhis/her defense. Formal rules <strong>of</strong> evidence do not apply. Documentary evidence and hearsay shall beadmissible, but the PMC shall determine the proper weight to be accorded to hearsay evidence.1. If the PMC finds that the facts do not support the allegation(s), the charges will be dismissed. Thechair <strong>of</strong> the PMC shall transmit the decision in writing to the respective Program Director withintwo (2) business days <strong>of</strong> the hearing. The Program Director will notify the <strong>St</strong>udent in writing <strong>of</strong>the recommendation <strong>of</strong> the PMC within two (2) business days after receiving the PMCrecommendation. The matter is then ended. The PMC record <strong>of</strong> the case shall be destroyed by thechair <strong>of</strong> the PMC ten (10) days after the transmittal <strong>of</strong> the Program Director’s decision.2. If the PMC finds that the facts support the allegation(s) against the <strong>St</strong>udent, the <strong>St</strong>udent shall befound guilty, and the PMC will recommend disciplinary action(s), which can range from writtenwarning to dismissal from the program. The chair <strong>of</strong> the PMC will transmit the Committee’srecommendation(s) in writing to the Program Director within two (2) business days following theconclusion <strong>of</strong> the hearing. The Program Director will review the recommendations <strong>of</strong> the PMCand provide a written response to the <strong>St</strong>udent within two (2) business days outlining the decisionon the matter.3. A student referred to the PMC may not withdraw from the <strong>University</strong> until the findings <strong>of</strong> thePMC have been made and the student has been in<strong>for</strong>med <strong>of</strong> the decision. Applies to all <strong>University</strong> <strong>of</strong> <strong>St</strong> <strong>Augustine</strong> <strong>for</strong> <strong>Health</strong> <strong>Sciences</strong> <strong>St</strong>udents<strong>St</strong>udent’s Right <strong>of</strong> Appeal*Each student has the right to appeal the decisions <strong>of</strong> the PMC and Program Director.To request an appeal, the <strong>St</strong>udent must provide to the Registrar a completed PMC Appeal Request <strong>for</strong>m*along with a written statement <strong>of</strong> the basis <strong>for</strong> his/her appeal within ten (10) business days from the datethe decision letter is mailed to the <strong>St</strong>udent’s last known address.An appeal may be based only on the grounds that:1. The PMC failed to comply with the procedural requirements outlined herein and/or in the <strong>St</strong>udentHandbook.2. There is relevant and material evidence which, in the exercise <strong>of</strong> reasonable diligence, could nothave been produced or which was improperly excluded at the hearing be<strong>for</strong>e the PMC.3. The evidence presented at the Pr<strong>of</strong>essional Misconduct Committee hearing was not sufficientlysubstantial to justify the final decision.If the Registrar has not received the completed <strong>for</strong>m and written statement (email or letter is acceptable)within the specified timeframe the decision <strong>of</strong> the PMC and Program Director will be final and no furtherappeals are available to the <strong>St</strong>udent.If an appeal is filed, the Registrar will within ten (10) business days <strong>for</strong>ward to the Dean <strong>of</strong> the division inwhich the student is enrolled, or designee (hereinafter referred to as Dean), the <strong>St</strong>udent’s completed PMCappeal request <strong>for</strong>m and written statement, along with copies <strong>of</strong> all materials provided to the PMC, andthe written decisions <strong>of</strong> the PMC and Program Director.The Dean has ten (10) business days* to consider the appeal request. The Dean may deny the appeal <strong>for</strong>failure to allege facts which, if true, would be sufficient to constitute grounds <strong>for</strong> appeal. The Dean mayalso modify the decision or approve the appeal request.Should the Dean deny the appeal, the decision <strong>of</strong> the PMC and Program Director will stand affirmed andno further appeals are available to the <strong>St</strong>udent. The <strong>St</strong>udent will be notified in writing <strong>of</strong> the Dean’sdecision regarding the appeal. The decision <strong>of</strong> the Dean regarding the appeal request is final.The <strong>St</strong>udent may continue to participate in academic and co-curricular activities until a finaldetermination is made, including any appeal, except where immediate exclusion is reasonably required<strong>for</strong> the safety and welfare <strong>of</strong> students, faculty, staff, or <strong>University</strong> property. If the decision the <strong>St</strong>udent isappealing includes program dismissal, the <strong>St</strong>udent may continue to attend classes during the appealprocess but he/she is not considered an enrolled student and is there<strong>for</strong>e not eligible <strong>for</strong> financial aid or<strong>for</strong> any financial reimbursement.*Should the Dean, or designee, receive an appeal request during the last fifteen (15) days <strong>of</strong> theterm or during the trimester break, as indicated on the Academic Calendar it will be consideredduring the first ten (10) business days following the first day <strong>of</strong> class <strong>of</strong> the subsequent term.*The PMC Appeal Request <strong>for</strong>m and the procedures associated with the non-academic appealprocess are available on the <strong>St</strong>udents tab in the myUSA portal.Permanent RecordRecords <strong>of</strong> the following will be maintained in the <strong>St</strong>udent Services Office.1. Records <strong>of</strong> the sanctions <strong>of</strong> the Academic Appeals Committee and the Pr<strong>of</strong>essional MisconductCommittee will be maintained permanently.2. Records <strong>of</strong> all other sanctions will be maintained <strong>for</strong> five (5) years from the last day <strong>of</strong> theacademic year in which the incident occurred.3.
