Sealed Bids <strong>in</strong> two separate covers (Technical bid and Price bid) <strong>in</strong> d<strong>up</strong>licate will bereceived till 10.05.2013 12:00 noon , by the Mission Director, NRHM Haryana <strong>for</strong> the s<strong>up</strong>ply<strong>of</strong> items <strong>for</strong> <strong>Drug</strong> Warehouses <strong>in</strong> the State <strong>of</strong> Haryana (Annexure-I).2. Qualification Criteria <strong>for</strong> Eligible Bidders: The bidder shall be Orig<strong>in</strong>al Manufacturerhav<strong>in</strong>g valid manufactur<strong>in</strong>g license(a)(b)(c)In case where the bidder is Orig<strong>in</strong>al manufacturer, the bidder must have manufactured ands<strong>up</strong>plied satisfactorily similar item <strong>of</strong> the type specified <strong>in</strong> the Schedule <strong>of</strong> Requirements tothe extent <strong>of</strong> atleast 60% <strong>of</strong> the total quantity specified <strong>in</strong> the Schedule <strong>of</strong> Requirements,dur<strong>in</strong>g the last three years as on the last date <strong>of</strong> the month proceed<strong>in</strong>g the bid open<strong>in</strong>g date <strong>in</strong>premier Health Institutions such as AIIMS, any PGIMER, Govt. Medical Colleges etc.. The listshould specifically <strong>in</strong>dicate the make/model number, manufacturer and the brand nameif any.j) Orig<strong>in</strong>al Brochure <strong>of</strong> the Quoted model highlight<strong>in</strong>g the technicalfeatures/specifications <strong>in</strong> items quoted vis a vis technical Specifications <strong>of</strong> the tenderto check the con<strong>for</strong>mity <strong>of</strong> quoted model to the Technical specifications <strong>of</strong> the NIT.Apart from the above the bidder should also submit a detailed compliance statement<strong>for</strong> the quoted model specify<strong>in</strong>g deviations if any with the Technical Specifications <strong>of</strong>the tender.k) The tender schedule signed by the bidder at all pages with <strong>of</strong>fice seal.l) List <strong>of</strong> Service Centers <strong>of</strong> the manufacturers <strong>in</strong> the State <strong>of</strong> Haryana with completeaddress and details like name, qualifications, phone nos etc <strong>of</strong> the Eng<strong>in</strong>eers/Technicians, who will be provid<strong>in</strong>g after sale service.m) Certificates like CE mark, BIS Certifications or ISO 9000 , ISO 14000 , WHO-GMPstandards <strong>for</strong> the Quoted items as applicable.n) The bidder shall submit a Checklist (Annexure-IX) <strong>for</strong> the list <strong>of</strong> documents enclosedwith their page number. The documents shall be serially arranged as per this CheckList and shall be securely tied or bound.13. PRICE BID-COVER-“B”14. Bid should be clearly typewritten and every correction <strong>in</strong> the bid should <strong>in</strong>variably be attestedwith full signature by the bidder with date, fail<strong>in</strong>g which the bid will be <strong>in</strong>eligible <strong>for</strong> furtherconsideration. There should be no overwrit<strong>in</strong>g/Corrections with fluid.15. The rate quotation <strong>of</strong> the quoted item should be submitted <strong>in</strong> a separate sealed coverS<strong>up</strong>erscribed as “COVER “B”– <strong>Tender</strong> <strong>for</strong> s<strong>up</strong>ply <strong>of</strong> items (Indicat<strong>in</strong>g the gro<strong>up</strong>) <strong>for</strong><strong>Drug</strong> Warehouse <strong>in</strong> the State <strong>of</strong> Haryana due on 10-05-2013 at 12:00 pm addressed toMission Director NRHM Haryana, Bays No. 55-58, Sector 2, Panchkula. .16. a) The rate should be quoted as per pro<strong>for</strong>ma <strong>of</strong> price schedule at Annexure VI .b) The bidder should also <strong>in</strong>dicate rates <strong>of</strong> Comprehensive Ma<strong>in</strong>tenance Contract(CMC) / AMC as <strong>in</strong>dicated <strong>in</strong> technical specifications <strong>of</strong> each item. Total rates <strong>of</strong>CMC/AMC as the case may be, will also be taken <strong>in</strong>to account <strong>for</strong> determ<strong>in</strong><strong>in</strong>g the L1 bid <strong>for</strong> these items. However it will be the discretion <strong>of</strong> the purchaser to enter ornot <strong>in</strong>to the CMC agreement after the warranty period.c) The bidder should also furnish rates <strong>of</strong> spare parts and consumables if applicable <strong>for</strong>the quoted items <strong>in</strong> the price bid which should be valid <strong>for</strong> 5 years after warrantyperiod.d) The total landed price per unit (Includ<strong>in</strong>g all taxes) plus total rates <strong>of</strong> CMC/ AMC <strong>for</strong>next five years after warranty period will be considered <strong>for</strong> determ<strong>in</strong><strong>in</strong>g the L1 rate.e) The rate quoted should be <strong>for</strong> the unit and specifications given. The bidder is strictlyprohibited to change/alter specifications.f) The bidders are required to furnish the break <strong>up</strong> detail <strong>of</strong> landed price <strong>in</strong> Annexure-VI.g) The rates quoted should be FOR dest<strong>in</strong>ation various <strong>Drug</strong> Warehouses <strong>in</strong> the State <strong>of</strong>Haryana.h) For Imported items, the purchaser/Indenter will arrange to get the Customs DutyExemption Certificate as per applicable custom duty notification <strong>in</strong> <strong>for</strong>ce from theGovt. authorities. Hence the bidder should not <strong>in</strong>clude, <strong>in</strong> their bid, custom dutypayable on the goods. However the bidder should <strong>in</strong>dicate separately the customs dutypayable on the goods to be s<strong>up</strong>plied <strong>in</strong> the column provided <strong>in</strong> the price bid. If nospecific <strong>in</strong>dication is made by the bidder <strong>in</strong> their bid, then it will be considered that nocustoms duty is applicable and any claim at a later date on this will not be enterta<strong>in</strong>ed.i) In case <strong>of</strong> imported items also the price should be quoted <strong>in</strong> Indian R<strong>up</strong>ees and thebidder will bear exchange risks/ga<strong>in</strong>s on either way.j) The evaluation <strong>of</strong> the Imported goods will be made after add<strong>in</strong>g any additional customduty as applicable and transportation charges <strong>up</strong>to dest<strong>in</strong>ation.7


k) Each page <strong>of</strong> the price bid should be duly signed by the bidder with <strong>of</strong>fice seal.“Cover B” should also be addressed to the Mission Director NRHM Haryana.PROCEDURE FOR SEALING AND SUBMISSION OF BIDS17. The Cover A <strong>in</strong> orig<strong>in</strong>al and Cover B <strong>in</strong> d<strong>up</strong>licate should be sealed separately, and both thesecovers shall be kept <strong>in</strong> a s<strong>in</strong>gle sealed cover. The bids should reach the Mission DirectorNRHM Haryana on or be<strong>for</strong>e the date and time specified.The Covers should be sealed and submitted as per follow<strong>in</strong>g procedure :-Technical Bids (Cover “A” Orig<strong>in</strong>al) Sealed envelopPrice Bids (Cover “B” Orig<strong>in</strong>al) Sealed envelopPrice Bid (Cover “B” D<strong>up</strong>licate) Sealed envelopAll the above separately sealed covers should be put <strong>in</strong> one s<strong>in</strong>gle sealed envelop andS<strong>up</strong>erscribed <strong>Tender</strong> (Cover “A” and Cover “B”) <strong>for</strong> s<strong>up</strong>ply <strong>of</strong> itemes due on 10-05-2013 at12:00 noon.a. Bids will be opened at on the date and time specified <strong>in</strong> the presence <strong>of</strong> the representatives <strong>of</strong>the bidders who prefer to attend the bid open<strong>in</strong>g.b. Cover “B” <strong>of</strong> the bidders meet<strong>in</strong>g eligibility criteria , evaluated on the basis <strong>of</strong> the detailsfurnished by the bidders <strong>in</strong> cover “A” will alone be opened and the date and time <strong>of</strong> theopen<strong>in</strong>g <strong>of</strong> Cover “B” will be <strong>in</strong>timated to only such eligible/short listed bidders.NOTE: -Any bid which is not submitted <strong>in</strong> accordance with the above procedure shall berejected straightaway.BID SECURITY (EARNEST MONEY DEPOSIT)Each bid must be accompanied with a bid security (EMD) <strong>for</strong> the amount as specified <strong>in</strong>Annexure 1 <strong>in</strong> the <strong>for</strong>m <strong>of</strong> Demand Draft favour<strong>in</strong>g Mission Director NRHM Haryana. Bidsecurity submitted <strong>in</strong> any other <strong>for</strong>m will not be accepted. Any bid submitted without BidSecurity <strong>in</strong> accordance with this clause will be rejected. The bidder quot<strong>in</strong>g <strong>for</strong> the particulargro<strong>up</strong> shall deposit EMD accord<strong>in</strong>gly. Further, if the bidder is quot<strong>in</strong>g <strong>for</strong> multiple gro<strong>up</strong>s,shall submit EMD <strong>for</strong> <strong>in</strong>dividual gro<strong>up</strong> and submit their separate tender document.This Bid Security amount <strong>of</strong> the successful bidder will be reta<strong>in</strong>ed by Mission Director NRHMHaryana till the completion <strong>of</strong> the tender process/period. The Bid Security <strong>of</strong> unsuccessfulbidder would be returned after f<strong>in</strong>alization <strong>of</strong> the tender. The Bid Security amount will notcarry any <strong>in</strong>terest. If the successful bidder fails to execute the agreement and or deposit theper<strong>for</strong>mance security (Security Deposit) with<strong>in</strong> the specified time, or withdraws his bid with<strong>in</strong>the validity period <strong>of</strong> the bid, this bid security amount will be <strong>for</strong>feited. No exemption is8


available to any <strong>org</strong>anization from submission <strong>of</strong> bid security and bids not accompanied by therequisite bid security will be rejected out right.PERFORMANCE BANK GURANTEE (SECURITY DEPOSIT)18. (I) Per<strong>for</strong>mance Security <strong>for</strong> one time order issued by the Mission Director NRHMHaryana.(i) The Successful bidder shall with<strong>in</strong> 14 days <strong>of</strong> the issuance <strong>of</strong> Notification <strong>of</strong> Awardsubmit Per<strong>for</strong>mance Security Deposit equivalent to 10% <strong>of</strong> the Gross value <strong>of</strong> Award(<strong>in</strong>clusive <strong>of</strong> all taxes). The Per<strong>for</strong>mance Security shall be denom<strong>in</strong>ated <strong>in</strong> Indian R<strong>up</strong>ees andshall be <strong>in</strong> one <strong>of</strong> the follow<strong>in</strong>g <strong>for</strong>ms :-a) An irrevocable bank guarantee issued by a nationalized/ scheduled banklocated <strong>in</strong> India <strong>in</strong> the <strong>for</strong>mat provided <strong>in</strong> the Bidd<strong>in</strong>g Documents (Annexure –VII) ; <strong>in</strong> favour <strong>of</strong> “Mission Director NRHM Haryana” payable at Panchkula.b) The irrevocable bank guarantee should be valid <strong>for</strong> 60 days beyond thewarranty period, the Bank Guarantee valid <strong>for</strong> a shorter period will beconsidered as major deviation and could lead to term<strong>in</strong>ation <strong>of</strong> contract and<strong>for</strong>feiture <strong>of</strong> EMD.c) The irrevocable bank guarantee will be discharged after satisfactorycompletion <strong>of</strong> warranty period. The per<strong>for</strong>mance security amount will not carryany <strong>in</strong>terest if provided <strong>in</strong> cash.PERIOD OF VALIDITY OF BIDS19. Bids should be valid <strong>for</strong> 180 days from the open<strong>in</strong>g <strong>of</strong> the Technical bids (Cover “A). A bidvalid <strong>for</strong> a shorter period will be rejected as non-responsive. Mission Director NRHM Haryanawill make every endeavor to f<strong>in</strong>alize the bids <strong>in</strong> the orig<strong>in</strong>al validity period <strong>of</strong> the bids.However if <strong>for</strong> any reason, Mission Director NRHM Haryana is not able to f<strong>in</strong>alize the tenderwith<strong>in</strong> the orig<strong>in</strong>al validity period <strong>of</strong> the bids, Mission Director NRHM Haryana may solicitthe bidders consent <strong>for</strong> an extension <strong>in</strong> the period <strong>of</strong> bid validity. A bidder may refuse therequest without <strong>for</strong>feit<strong>in</strong>g their bid security.PRICES AND OTHER CONDITIONS20. The tentative details <strong>of</strong> the required goods are shown <strong>in</strong> Annexure I. The quantity mentionedis <strong>in</strong> two parts.Part -1: S<strong>in</strong>gle Order: The requirement is <strong>for</strong> exist<strong>in</strong>g hospitals <strong>for</strong> which one time orderswill be placed by the Mission Director NRHM Haryana. These quantities aretentative and may be <strong>in</strong>creased or decreased by 25% as per the decision <strong>of</strong> theMission Director NRHM Haryana. The rates quoted should not vary with thequantum <strong>of</strong> the order or the dest<strong>in</strong>ation.9


21. The bidder should quote the rates <strong>for</strong> the items described as per the specifications (Annexure-VIII) only. Bidder should clearly <strong>in</strong>dicate specifications <strong>of</strong> the quoted model vis-à-vis itscompliance with the technical specification <strong>of</strong> NIT.22. Rates should be quoted on door delivery basis accord<strong>in</strong>g to the unit asked <strong>for</strong>, No bidconditions like “AT CURRENT MARKET RATES” shall be accepted. No handl<strong>in</strong>g, clear<strong>in</strong>g,transport charges etc., will be paid. The deliveries should be made as stipulated <strong>in</strong> the purchaseorder placed with successful bidders.23. (a) If at any time dur<strong>in</strong>g the period <strong>of</strong> contract, the price <strong>of</strong> tendered items is reduced orbrought down by any law or Act <strong>of</strong> the Central or State Government or by the bidderhimself, the bidder shall be morally and statutorily bound to <strong>in</strong><strong>for</strong>m the MissionDirector NRHM Haryana immediately about such reduction <strong>in</strong> the contracted prices.The Mission Director NRHM Haryana is empowered to unilaterally effect suchreduction as is necessary <strong>in</strong> rates <strong>in</strong> case the bidder fails to notify or fails to agree <strong>for</strong>such reduction <strong>of</strong> rates.(b)In case <strong>of</strong> any enhancement <strong>in</strong> Excise Duty or levy<strong>in</strong>g <strong>of</strong> Excise Duty afresh due tostatutory Act <strong>of</strong> the Government after the date <strong>of</strong> submission <strong>of</strong> tenders and dur<strong>in</strong>g thetender period, the additional or fresh excise duty so levied will be allowed to becharged extra as separate item without any change <strong>in</strong> price structure approved underthe <strong>Tender</strong>. For claim<strong>in</strong>g the enhancement <strong>of</strong> additional cost on account <strong>of</strong> the <strong>in</strong>crease<strong>in</strong> Excise Duty, the bidder should produce:-(i)(ii)a certificate from the Excise authority concerned certify<strong>in</strong>g that the itemss<strong>up</strong>plied falls under particular tariff and the rate <strong>of</strong> excise duty charged.Invoices drawn as per Excise rules <strong>for</strong> the items s<strong>up</strong>plied shall be produced.(c ) In case the successful bidder has been enjoy<strong>in</strong>g excise duty exemption on any criteria<strong>of</strong> Turnover etc., such bidder will not be allowed to claim excise duty at later po<strong>in</strong>t <strong>of</strong>time, dur<strong>in</strong>g the currency <strong>of</strong> contract, when the excise duty is chargeable on goodsmanufactured.24. (a) The price quoted by the bidders shall not <strong>in</strong> any case, exceed the controlled price, ifany, fixed by the Central/State Government and the Maximum Retail Price (MRP).The Mission Director NRHM Haryana, at its discretion, will exercise the right torevise the price at any stage so as to con<strong>for</strong>m to the controlled price or MRP as thecase may be. (a) The Purchaser will award the Contract to the successful Bidder whose bid has beendeterm<strong>in</strong>ed to be Responsive/Substantially Responsive and has been determ<strong>in</strong>ed as thelowest evaluated bid, provided further that the Bidder is determ<strong>in</strong>ed to be qualified toper<strong>for</strong>m the Contract satisfactorily.(b)The purchaser will issue notification <strong>of</strong> Award to the lowest evaluated bidder which willtantamount to <strong>for</strong>mation <strong>of</strong> Contract and will be governed by all the terms andconditions stipulated <strong>in</strong> this Bid document.INSPECTION30. The Mission Director NRHM Haryana and or his authorized representative(s) have the right to<strong>in</strong>spect the factories <strong>of</strong> those companies who have quoted <strong>for</strong> this tender, be<strong>for</strong>e, accept<strong>in</strong>g therate quoted by them or be<strong>for</strong>e releas<strong>in</strong>g any order(s) or at any po<strong>in</strong>t <strong>of</strong> time dur<strong>in</strong>g thecont<strong>in</strong>uance <strong>of</strong> tender and has also the right to reject the tender or term<strong>in</strong>ate/cancel the ordersissued or not to reorder based on facts brought out dur<strong>in</strong>g such <strong>in</strong>spections.31. The items/material will be <strong>in</strong>spected by the <strong>in</strong>spection team/agency nom<strong>in</strong>ated by the MissionDirector NRHM Haryana at Pre-Delivery stage. The s<strong>up</strong>plier will <strong>of</strong>fer 100% <strong>in</strong>spection <strong>of</strong> theitems/material be<strong>for</strong>e the dispatch <strong>of</strong> the material well <strong>in</strong> advance. The s<strong>up</strong>pliers are advised to<strong>of</strong>fer <strong>in</strong>spection <strong>of</strong> the material on the day <strong>of</strong> open<strong>in</strong>g the tender . The committee/Agency will<strong>in</strong>spect the material to confirm the s<strong>up</strong>ply <strong>of</strong> the material as per the specifications, specified <strong>in</strong>the purchase order/bidd<strong>in</strong>g documents. Such Committee/Agency will issue the InspectionReport (IR) which will <strong>for</strong>m the base <strong>for</strong> acceptance/rejection <strong>of</strong> the material.32. The right <strong>of</strong> purchaser to <strong>in</strong>spect/test the items/goods if deemed necessary and reject theitems/goods if found not con<strong>for</strong>m<strong>in</strong>g to specification at any po<strong>in</strong>t <strong>of</strong> time after the s<strong>up</strong>ply <strong>of</strong>items/goods shall <strong>in</strong> no way be affected by the fact that the items/goods has already been<strong>in</strong>spected/tested by the purchaser.33. Items which do not meet quality requirements, shall render the relevant s<strong>up</strong>plies liable to berejected. If the items do not con<strong>for</strong>m to statutory standards/ specifications the s<strong>up</strong>plier will beliable <strong>for</strong> relevant action under the exist<strong>in</strong>g laws, and would be responsible <strong>for</strong> remov<strong>in</strong>g theentire stock back with<strong>in</strong> a period <strong>of</strong> 21 days <strong>of</strong> the issuance <strong>of</strong> the letter from the purchaser.The stock shall be taken back at the expense <strong>of</strong> the s<strong>up</strong>plier. The s<strong>up</strong>plier <strong>for</strong> the productcould be blacklisted and no further s<strong>up</strong>plies accepted from him till he is legally cleared. 34. The decision <strong>of</strong> the Mission Director NRHM Haryana, or any Officer or agency authorized byhim, as to the quality <strong>of</strong> the s<strong>up</strong>plied items shall be f<strong>in</strong>al and b<strong>in</strong>d<strong>in</strong>g.ACCEPTANCE OF TENDER35. The Mission Director NRHM Haryana reserves the right to reject the tenders or to accept thetenders <strong>for</strong> the s<strong>up</strong>ply <strong>of</strong> all articles or <strong>for</strong> any one or more <strong>of</strong> the articles tendered <strong>for</strong> <strong>in</strong> thetender without assign<strong>in</strong>g any reason.36. The acceptance <strong>of</strong> the tenders shall be communicated to the bidder <strong>in</strong> writ<strong>in</strong>g.DELIVERY CONDITIONS37. Delivery is F.O.R. Dest<strong>in</strong>ation at various Govt Health Institutions <strong>in</strong> the State <strong>of</strong> Haryana. Theitems should be s<strong>up</strong>plied and <strong>in</strong>stalled at various drug warehouses <strong>in</strong> the State <strong>of</strong> Haryana bythe s<strong>up</strong>plier with<strong>in</strong> 21 days from the issuance <strong>of</strong> Notification <strong>of</strong> Award.38. If the s<strong>up</strong>plier fails to execute the purchase order with<strong>in</strong> the stipulated time, Mission DirectorNRHM Haryana is empowered to make emergency purchases and claim the difference <strong>in</strong> totalcost from the s<strong>up</strong>plier <strong>in</strong> addition to other penal remedies.39. The deliveries shall be made strictly as per the purchase order.PAYMENT PROVISIONS40.
