ECOsshould not refuse under 320(18) if the c<strong>on</strong>victi<strong>on</strong> is c<strong>on</strong>sidered “spent” under theRehabilitati<strong>on</strong> <strong>of</strong> Offenders Act (see Annex 26.3). Paragraph 320(18) will not apply wherean applicant has been cauti<strong>on</strong>ed.Details <strong>of</strong> the possible sentence which a particular <strong>of</strong>fence in England and Wales could attractcan be found <strong>on</strong> the Crown Prosecuti<strong>on</strong> Service website at:http://www.cps.gov.uk/legal/s_to_u/sentencing_manual/.If an ECO cannot adequately determine the possible sentence using this website, or wherethe applicant was found guilty under Scottish law, the ECO should c<strong>on</strong>tact ECO support forassistance.ECOs should note that the applicant does not have to have received a sentence <strong>of</strong> more than12 m<strong>on</strong>ths, nor to have served a sentence <strong>of</strong> more than 12 m<strong>on</strong>ths, but simply that the crimethey were c<strong>on</strong>victed <strong>of</strong> carried a maximum penalty <strong>of</strong> 12 m<strong>on</strong>ths or more. Equally, it does notmatter if the applicant has a summary c<strong>on</strong>victi<strong>on</strong>. Rather if the <strong>of</strong>fence was indictable, it is thepossible sentence that could have been received if tried by a jury that is important. Forexample, Dangerous Driving is punishable by up to six m<strong>on</strong>ths impris<strong>on</strong>ment if dealt with as asummary <strong>of</strong>fence. The sentence rises to a possible 2 years impris<strong>on</strong>ment <strong>on</strong> indictment.Thus, the <strong>of</strong>fence attracts the possible applicati<strong>on</strong> <strong>of</strong> 320(18) regardless as to the mode <strong>of</strong>trial at the case in questi<strong>on</strong>. However, when c<strong>on</strong>sidering whether or not the <strong>of</strong>fence is spent,rehabilitati<strong>on</strong> periods are based <strong>on</strong> actual sentences received (see below).When determining if a refusal under 320(18) is appropriate, the ECO must also take intoaccount any human rights grounds and ensure that the refusal is both proporti<strong>on</strong>ate andreas<strong>on</strong>able.If an applicant disputes the c<strong>on</strong>tent <strong>of</strong> the Police Certificate, the applicant must c<strong>on</strong>tact theAssociati<strong>on</strong> <strong>of</strong> Chief Police Officers <strong>Criminal</strong> Records Office (ACRO). Their c<strong>on</strong>tact detailsare noted at the bottom <strong>of</strong> the Police Certificate.<str<strong>on</strong>g>Refusal</str<strong>on</strong>g> wordingsThe ECO must not make reference to the details <strong>of</strong> the c<strong>on</strong>victi<strong>on</strong> in the refusal notice. Therefusal wording must read "…records held in the United Kingdom indicate that you have beenc<strong>on</strong>victed <strong>of</strong> at least <strong>on</strong>e criminal <strong>of</strong>fence that could have carried a custodial sentence <strong>of</strong> morethan 12 m<strong>on</strong>ths [if that <strong>of</strong>fence had occurred in the United Kingdom]. According to thoserecords, that c<strong>on</strong>victi<strong>on</strong> is not spent…". Where the applicant subsequently request furtherinformati<strong>on</strong> regarding why (s)he has been refused, the ECO may disclose to the applicant inwriting or verbally any additi<strong>on</strong>al informati<strong>on</strong> noted <strong>on</strong> the “Court Certificate for EntryClearance purposes”.The ECO must ensure the refusal notice reflects the c<strong>on</strong>siderati<strong>on</strong> they have given to theproporti<strong>on</strong>ality and the impact <strong>of</strong> human rights and compassi<strong>on</strong>ate c<strong>on</strong>siderati<strong>on</strong>s. Therefusal notice may read "…I have c<strong>on</strong>sidered the compassi<strong>on</strong>ate circumstances <strong>of</strong> yourapplicati<strong>on</strong> [going <strong>on</strong> to explain what they are, if any]. However, I am not satisfied that theyare <strong>of</strong> a sufficiently compelling nature for me to exercise the powers <strong>of</strong> discreti<strong>on</strong> granted tome by paragraph 320(18) <strong>of</strong> the Immigrati<strong>on</strong> Rules.


Spent C<strong>on</strong>victi<strong>on</strong>sThe purpose <strong>of</strong> the Rehabilitati<strong>on</strong> <strong>of</strong> Offenders Act 1974 (“ROA”) is that people may behavebadly at <strong>on</strong>e point in their lives but may nevertheless go <strong>on</strong> to live law abiding lives. Toencourage this process, after a certain period <strong>of</strong> good behaviour, and provided the <strong>of</strong>fencewasn't too serious, the pers<strong>on</strong> is entitled to be treated as a reformed character. The PoliceCertificate should detail whether or not a c<strong>on</strong>victi<strong>on</strong> is spent. The rehabilitati<strong>on</strong> periods arealso set out in ECG Annex 26.3.
