PERRY SHELLWHEREAS, <strong>Cherokee</strong> Code Chapter 113 regulates Huntingand Fishing within the territorial jurisdiction <strong>of</strong> the<strong>Eastern</strong> <strong>Band</strong> <strong>of</strong> <strong>Cherokee</strong> Indians; andWHEREAS, Chapter 113 needs to be amended for clarityto ensure that all tribal members are able to access tribalfishing waters without charge; andWHEREAS, Chapter 113 additionally needs to beamended to not prevent tribal members from participatingin historically cultural fishing techniques.NOW THEREFORE BE IT ORDAINED by the TribalCouncil <strong>of</strong> the <strong>Eastern</strong> <strong>Band</strong> <strong>of</strong> <strong>Cherokee</strong> Indians assembled,at which a quorum is present, that <strong>Cherokee</strong> CodeChapter 113 is amended to read as follows:Note: This three-page ordinance may be viewed in itsenrety at the TOP Office.Tabled Ordinance No. 324 (<strong>20</strong>10)SUBMITTED By SORNA TASK FORCE and theOFFICE OF THE ATTORNEY GENERALWHEREAS, Pursuant to 127 <strong>of</strong> the Adam Walsh ChildProtection and Safety Act <strong>of</strong> <strong>20</strong>06 (Adam Walsh Act orAct) all federally recognized Indian tribes are entitled toelect whether to carry out the requirements <strong>of</strong> this sectionor delegate the functions to the state(s) in which the triballand is located; andWHEREAS, the <strong>Eastern</strong> <strong>Band</strong> <strong>of</strong> <strong>Cherokee</strong> Indians(Tribe) passed Resolution 726 (<strong>20</strong>07) implementing theprocess <strong>of</strong> carrying out the requirements <strong>of</strong> the AdamWalsh Act for compliance; andWHEREAS, the final guidelines for Title I <strong>of</strong> the AdamWalsh Act, the Sex Offender Registration and NotificationAct (SORNA) were published in the Federal Register onJuly 2, <strong>20</strong>08; andWHEREAS, a SORNA (Sex Offender Registration andNotification Act) Task Force was established in January<strong>20</strong>09 to initiate the required steps for compliance; andWHEREAS, through the work <strong>of</strong> this Task Force, <strong>Cherokee</strong>Code Section 14-50.5 was amended through Ordinance714 (<strong>20</strong>09) to ensure the current tribal sex <strong>of</strong>fenderregistry required the same intake information as that requiredin the Act; andWHEREAS, additional restrictions on registered <strong>of</strong>fenderswere passed establishing additional policy through Ordinance82 (<strong>20</strong>09); andWHEREAS, Chapter 14, Criminal Law, Articles V andVII have been amended to include additional sex <strong>of</strong>fences;andWHEREAS, the tribal sex <strong>of</strong>fender registry ordinancemust be amended to contain the minimal requirements asstated within the Adam Walsh Act.NOW, THEREFORE, BE IT ORDAINED by the <strong>Eastern</strong><strong>Band</strong> <strong>of</strong> <strong>Cherokee</strong> Indians in Tribal Council assembled,at which a quorum is present, that the Tribal Council <strong>of</strong>the <strong>Eastern</strong> <strong>Band</strong> <strong>of</strong> <strong>Cherokee</strong> Indians does hereby amendArticle X <strong>of</strong> Chapter 14 within the <strong>Cherokee</strong> Code to readas follows:Note: This 33-page ordinance may be viewed in its en-rety at the TOP Office.www.nc-cherokee.com/theonefeather
