For an unemployed person, the amount of benefits for primary incapacity for work during the firstsix months equals the unemployment allowance he would normally have received if he had notbeen in a state of incapacity for work.As soon as you return to work, the period of primary incapacity for work comes to an end.Nevertheless, if you become ill again within two weeks, the period of incapacity shall beconsidered uninterrupted (falling ill again).A period of maternity leave interrupts the period of primary incapacity for work.A.2. InvalidityThe invalidity period begins after a year of primary incapacity for work. The invalidity isestablished by the Medical Invalidity Council of the RIZIV - INAMI, on the basis of a report by theadvising practitioner of the insurance institution. The end of the invalidity is established by theadvising practitioner or the practitioner-inspector or the Medical Council for Invalidity.To establish the amount of the invalidity benefits, the family situation, the starting date of theincapacity and the possible loss of the sole income are taken into account. A beneficiary withdependants is entitled to an indemnity rate of 65% of his lost income (also limited to 118.5852 EUR,120.9569 EUR, 122.1665 EUR, 123.1437 EUR or 124.0057 EUR, according to the date on whichthe incapacity occurred (cf. above)). For beneficiaries without dependants, the indemnity rate islowered to 55 % (single persons) or 40% (cohabitants) of the same capped income, dependingon whether or not they suffer a loss of their sole income.Only in the following situations, the single persons' rate (55%) is granted to the entitled person:- when the entitled person proves that he lives alone or that he only lives together withpersons who do not receive an income and who are not considered as dependants,- when the entitled person lives together with a person who receives a replacementincome of which the amount is comprised between 896.71 EUR and 986.89 EUR permonth,- when the entitled person lives together with a person who receives a monthlyprofessional income or a professional income combined with a replacement income, ofwhich the amount is comprised between 896.71 EUR and 1,443.54 €.The invalidity period is not interrupted by a resumption of work during less than three months(falling ill again). A period of maternity leave interrupts a period of invalidity. Payment of thesebenefits always takes place between the third last day of the current month and the fifth dayof the following month. During the period of incapacity for work, you are not allowed to work,unless to a limited extent if you officially applied for it with your advising practitioner and if youreceived his permission beforehand.Sometimes, a benefit may be refused (e.g.: for the period in which you are entitled to yoursalary, etc.) or reduced (e.g.: when at the same time you receive an ordinary, a special or asupplementary indemnity for the disabled, etc.).49
