<strong>Alcohol</strong> <strong>Information</strong> <strong>Sheet</strong>INFORMATIONThe Liquor Licensing Act 1988 encompasses ten liquor license categories, withnine <strong>of</strong> these categories applying to the ongoing service <strong>of</strong> alcohol at a specifiedvenue and the tenth, an occasional licence, applying for the specific short termservice <strong>of</strong> alcohol which is the licence normally applicable to events.The majority <strong>of</strong> events, due to their short term nature will require an occasionallicense to allow for the service <strong>of</strong> alcohol. Occasional licenses are intended forpeople who want to sell liquor, but do not have any other liquor license.In addition to arranging the appropriate licence, the event organiser shall ensurethat the following policies are in place wherever liquor is being sold:That there is a variety <strong>of</strong> non alcoholic beverages and potable wateravailable at the eventThat there is in place a written procedure for assisting intoxicatedpersons and written directions for bar staff regarding their obligationsin relation to the serving <strong>of</strong> alcoholThat all bar staff shall have completed the ‘Responsible Service <strong>of</strong><strong>Alcohol</strong>’ CourseWhat Constitutes A Sale?The Act defines a sale to include the following:-(a) agree or attempt to sell;(b) <strong>of</strong>fer or expose for the purpose <strong>of</strong> selling;(c) send, forward or deliver for sale or on sale;(d) barter or exchange;(e) dispose, by lot or chance or by auction;(f) supply, or <strong>of</strong>fer, agree or attempt to supply —(i) in circumstances in which the supplier derives, or would be likely toderive, a direct or indirect pecuniary benefit; or(ii) gratuitously, but with a view to gaining or maintaining custom or othercommercial advantage;or(g) authorise, direct, cause or permit to be done any act referred to in thisdefinition, and includes, in relation to a club, supply to or to the order <strong>of</strong>members otherwise than by way <strong>of</strong> sale, but does not in relation to anyclass <strong>of</strong> licence include the provision <strong>of</strong> a free sample authorised by thisAct.


EXAMPLES OF A SALE Liquor supplied at a function where an “entry fee” is charged to a personattending. Where a limousine is hired out and includes liquor as part <strong>of</strong> the cost. Where a glass <strong>of</strong> champagne is <strong>of</strong>fered (free or otherwise) as part <strong>of</strong> aservice being provided.APPROVALS / NOTIFICATIONS / BOOKINGS<strong>Shire</strong> ApprovalYou need <strong>Shire</strong> approval to consume alcohol in a facility or on land owned ormanaged by the <strong>Shire</strong> <strong>of</strong> <strong>Mundaring</strong> (whether you are providing or selling thealcohol). To gain this approval you will need to complete an ‘Approval toConsume <strong>Alcohol</strong>’ form.Please note <strong>Shire</strong> approval is a prerequisite for Liquor Licence applications.Liquor LicenceIf you plan to sell alcohol you will need approval through the Department <strong>of</strong>Racing, Gaming and Liquor.PoliceThe local Police station should be notified for any events where alcohol is to beconsumed.TIME FRAMESelling Liquor28 days prior – submit ‘Approval to Consume <strong>Alcohol</strong>’ form to <strong>Shire</strong> – (prerequisitefor above and must be submitted first).14 days prior – for events up to 500 people Occasional Liquor Licence applicationto be lodged with the Department <strong>of</strong> Racing Gaming & Liquor. Note, for eventsover 500 people, the form must be lodged 30 days prior (and <strong>Shire</strong> approval 28days before this date).Providing Liquor (not selling)14 days prior – submit <strong>Shire</strong> <strong>of</strong> <strong>Mundaring</strong> ‘Approval to Consume <strong>Alcohol</strong>’.FEESLiquor LicenseThe fee for an Occasional Licence is determined by the number <strong>of</strong> peopleexpected to attend the event, for example $35 for up to 250 people, $80 for251-500 people and so on.<strong>Shire</strong> ApprovalNo charge.
