BRIEFINGAN ICAO DOWNGRADE: IMPLICATIONS AND ISSUESFOR THAI AVIATIONMARCH 2015• THE THAI DEPARTMENT OFCIVIL AVIATION MAY BEDOWNGRADED AS A RESULTOF A RECENT SAFETY AUDITCONDUCTED BY THEINTERNATIONAL CIVIL AVIATIONORGANISATION.• THIS DOWNGRADE WILL HAVEREPERCUSSIONS FOR THEGRADING OF THAI CARRIERSACROSS THE INTERNATIONALAVIATION COMMUNITY.• AIRLINES, BANKS AND LESSORSWILL NEED TO CONSIDER HOWBEST TO PROTECT THEIRCOMMERCIAL INTERESTS ANDMANAGE THEIR EXPOSURE TO APOTENTIAL DOWNGRADE.The International Civil Aviation Organization (“ICAO”) has conducted an auditof the Thai Department of Civil Aviation (“DCA”) as part of its Universal SafetyOversight Audit Programme (“USOAP”). This Programme is intended to ensurea consistent global standard for aviation safety and the civil aviationauthorities of ICAO member states are subject to regular audits under theUSOAP by ICAO.“THERE ARE CONCERNSTHAT ICAO WILLDOWNGRADE THAILANDFROM CATEGORY 1 TOCATEGORY 2 AS A RESULTOF THE AUDIT.”The audit covers a broad range of areas relevant to aviation safety and airlineoperations but is intended to assess the performance and expertise of the civilaviation authority and not of individual airlines. Some of the key areas consideredare personnel licensing and training, airworthiness assessment and certification,accident investigation and airline operations oversight and licensing.There are concerns that ICAO will downgrade Thailand from Category 1 toCategory 2 as a result of the audit. Much speculation revolves around theshortage of inspectors and the procedures for granting Air Operator Licences andCertificates (AOL/AOC) and airworthiness and the conflict in allowing the DCA tolicense airlines and operate airports. It is premature to comment on these issues. Itis important to bear in mind that the purpose of the audit is to identify areaswhere the civil aviation authority of an ICAO member state does not meetinternational standards.
