<strong>Spanking</strong> <strong>is</strong> <strong>not</strong> <strong>child</strong> <strong>abuse</strong>Monday, June 25, 2007Andrea Mrozek <strong>and</strong> Dave Qu<strong>is</strong>tParents know the difference between spanking as a d<strong>is</strong>ciplinary measure <strong>and</strong> <strong>child</strong> <strong>abuse</strong>: In the first, aloving parent uses some small, symbolic level <strong>of</strong> force as an incremental measure among others when a<strong>child</strong> m<strong>is</strong>behaves; in the latter, a <strong>child</strong> <strong>is</strong> subjected to violent force for no reason, or to vicious verbalassaults, or neglect. Even parents who would never spank their own <strong>child</strong>ren underst<strong>and</strong> that difference.And yet th<strong>is</strong> baffles the Senate. They are currently working to remove section 43 from the Criminal Code,which allows parents to spank their <strong>child</strong>ren. By removing it, they aim to teach us that spanking <strong>is</strong> alwayswrong, <strong>and</strong> newly illegal -- that it constitutes <strong>child</strong> <strong>abuse</strong>. In hearing witness testimony on June 18,Senator Sharon Carstairs said, "I define '<strong>abuse</strong>' as hitting a <strong>child</strong>." Senator Jim Munson said, "there <strong>is</strong> nosuch thing to me as reasonable force." He went on: "You either hit a <strong>child</strong> or do <strong>not</strong> hit a <strong>child</strong>, no matterhow hard you hit." It's all very clear: <strong>Spanking</strong> <strong>is</strong> always harmful <strong>and</strong> ought to be banned.<strong>Spanking</strong> remains a point <strong>of</strong> controversy among parents, which <strong>is</strong> prec<strong>is</strong>ely where it should bed<strong>is</strong>cussed. In short, th<strong>is</strong> <strong>is</strong> <strong>not</strong> a matter for the leg<strong>is</strong>lature or Senate. Parenting <strong>is</strong> by its very nature bestleft up to, well, parents. Because they -- by <strong>and</strong> large -- are concerned first <strong>and</strong> foremost with their<strong>child</strong>ren's welfare.However, if spanking <strong>is</strong> <strong>abuse</strong>, it would <strong>not</strong> be enough to argue that we must keep the state out <strong>of</strong> theplayrooms <strong>of</strong> the nation. If th<strong>is</strong> were true, it might indeed warrant action, <strong>not</strong> necessarily from the statebecause parenting <strong>is</strong> <strong>not</strong> a government m<strong>and</strong>ate, but from parents themselves.So for those interested in studies <strong>and</strong> stat<strong>is</strong>tics, the evidence <strong>is</strong> in: <strong>Spanking</strong> as a d<strong>is</strong>ciplinary tool <strong>is</strong> --drum roll please -- neutral. It <strong>is</strong> <strong>not</strong> accurate to say that spanking necessarily has negativerepercussions. In fact there <strong>is</strong> some evidence from reputable studies that it <strong>is</strong>, as always, doneappropriately -- gasp -- good. In one meta-analys<strong>is</strong> publ<strong>is</strong>hed in the Clinical Child <strong>and</strong> <strong>Family</strong> PsychologyReview in 2005, the conclusion was that spanking was a decidedly neutral tool, <strong>and</strong> <strong>child</strong> outcomesdepended on how spanking was used -- except in one case, where "physical d<strong>is</strong>cipline" proved to bepositive. "(O)ne study favour(ed) physical d<strong>is</strong>cipline for reducing drug <strong>abuse</strong>," the researchers write."They also identified an optimal type <strong>of</strong> physical d<strong>is</strong>cipline, called conditional spanking, which led tobetter <strong>child</strong> outcomes than 10 <strong>of</strong> 13 alternative d<strong>is</strong>ciplinary tactics," the study reads.A 30-year longitudinal study on the effects <strong>of</strong> spanking in New Zeal<strong>and</strong>, publ<strong>is</strong>hed in 2006, showed nonegative effects <strong>of</strong> spanking <strong>and</strong>, furthermore, that those who had been spanked "appeared to beparticularly high-functioning <strong>and</strong> achieving members <strong>of</strong> society."Negative memories or emotions should <strong>not</strong> take the upper h<strong>and</strong> in our Upper Chamber. The prem<strong>is</strong>e forthe Senate's bill that spanking <strong>is</strong> always bad, <strong>and</strong> that it constitutes or leads to <strong>abuse</strong>, <strong>is</strong> d<strong>is</strong>puted. There are unintended consequences to th<strong>is</strong> bill. For one, such a law can<strong>not</strong> be easily enforced <strong>and</strong>would require neighbour to spy upon neighbour: Recent reports from Sweden, where spanking wasoutlawed in 1979, suggest <strong>not</strong> only <strong>is</strong> spanking on the r<strong>is</strong>e there, but the state has no way to control it.There <strong>is</strong> also evidence there <strong>of</strong> a r<strong>is</strong>e in youth violence for those ra<strong>is</strong>ed after the spanking ban, thecause <strong>of</strong> which deserves further examination before other countries replicate their example.Worst <strong>of</strong> all, th<strong>is</strong> bill <strong>is</strong> a slap in the face to <strong>child</strong>ren truly suffering <strong>abuse</strong>. If a carefully thought-out swaton the bum as part <strong>of</strong> a wider d<strong>is</strong>cipline plan <strong>is</strong> the same thing as <strong>child</strong> <strong>abuse</strong>, then fighting real <strong>child</strong><strong>abuse</strong> just got a whole lot more difficult. Efforts will be diverted from combating truly despicablebehaviour, toward a broader campaign against conscientious parents.Theodore Dalrymple, a Brit<strong>is</strong>h writer <strong>and</strong> doctor, recently wrote <strong>of</strong> a problem he sees around him: apopulation <strong>of</strong> Brits who are "increasingly unable to d<strong>is</strong>tingu<strong>is</strong>h the trivial from the important <strong>and</strong> thevirtual from the real." With th<strong>is</strong> current bill in the Senate, select senators are trivializing parenthood bymicromanaging how good parents d<strong>is</strong>cipline, while turning attention away from real <strong>abuse</strong>.
