Magistrates of the said Legal Department. Its jurisdiction shall be that of the Court of FirstInstance.(7) The magistrates of the Legal Department of the Supreme Court, a Court of Appeal, a HighCourt and a Court of First Instance shall under the control, direction and authority of the Headsof the said Legal Departments, exercise the powers conferred by the law on the ProcureurGeneral at the Supreme Court, the Procureur General at the Court of Appeal and the StateCounsel respectively.Section 128:(1) The Legal Department shall be a principal party in a criminal trial before the court and shallalways be represented at such trials under pain of rendering the entire proceeding and thedecision null and void.(2) Subject to the powers of the Presiding Magistrate to maintain order in court, the LegalDepartment may intervene at any stage of the trial.(3) The Legal Department shall, at the close of the hearing in every case, address the court ortender written submissions without being denied the right of hearing or stopped when addressingthe court.Section 129: The Legal Department shall be heard even when its submissions are based only onthe civil claim.Section 130: The Legal Department may raise any procedural irregularity and seise thecompetent court with a view to annulling the irregular act.Section 131: Where there is a ruling of no case or where is an acquittal, the Legal Departmentshall not be made to bear the costs of the proceedings or to pay damages to the party prosecuted.CHAPTER IIFUNCTIONS OF THE LEGAL DEPARTMENTSUB-CHAPTER IFUNCTIONS OF THE PROCUREUR GENERAL AT THE SUPREME COURT
